1. Introduction

This Host Responsibilities Policy explains the duties, responsibilities, risks, and expectations that apply to users who post listings, offer items for rent, approve rental requests, release items, collect rental money, collect deposits, provide instructions, or otherwise act as a host on ToyRental.ca.

ToyRental.ca is an online advertising, listing, communication, booking request, and connection platform. ToyRental.ca allows hosts to advertise items for rent and allows renters to discover, request, and arrange rentals directly with hosts.

ToyRental.ca is not a rental company, owner, operator, supplier, broker, agent, insurer, inspector, guarantor, payment holder, escrow provider, repair provider, delivery provider, mediator, arbitrator, court, or party to rental agreements between users.

By creating a listing, offering an item for rent, approving a rental request, communicating with a renter, releasing an item, collecting rental money, collecting a deposit, or otherwise acting as a host, you agree to this Host Responsibilities Policy.

If you do not agree with this policy, do not post listings, do not offer items for rent, do not approve rental requests, and do not release items through ToyRental.ca.

2. Relationship to Other Policies

This Host Responsibilities Policy is part of ToyRental.ca’s legal and safety rules and should be read together with our:

  • Terms of Use.
  • Privacy Policy.
  • Refund and Credit Policy.
  • Safety and Risk Policy.
  • Community Guidelines and Prohibited Items Policy.
  • Rental Agreement Notice.
  • Any other policy, warning, notice, or rule posted on ToyRental.ca.

If you act as a host, you are responsible for understanding and following all ToyRental.ca policies that apply to your listings, your items, your communications, your rental arrangements, your payments, and your conduct.

3. Host Definition

For the purpose of this policy, a “host” means any user who owns, controls, manages, lists, advertises, offers, approves, supplies, releases, delivers, or rents an item through ToyRental.ca.

A host may be an individual, business, sole proprietor, company, organization, or other person or entity permitted to use ToyRental.ca.

If you post a listing or offer an item for rent, you are responsible for that listing, that item, and your rental arrangement with the renter.

4. Host Assumption of Risk

Hosts list and rent items at their own risk.

By listing or renting an item, you understand and accept that the item may be:

  • Damaged.
  • Lost.
  • Stolen.
  • Misused.
  • Returned late.
  • Returned dirty.
  • Returned incomplete.
  • Returned with missing parts or accessories.
  • Returned in worse condition.
  • Not returned at all.

You also understand and accept that a rental may result in disputes, unpaid amounts, deposit disputes, chargebacks, repair costs, replacement costs, insurance issues, lost rental income, legal claims, property damage, personal injury, serious injury, or death.

ToyRental.ca is not responsible for theft, loss, damage, non-return, late return, missed rental income, repair costs, replacement costs, unpaid rental money, unpaid deposits, injury, death, property damage, user misconduct, or disputes arising from your decision to list or rent an item.

5. No Insurance From ToyRental.ca

ToyRental.ca does not provide insurance of any kind.

ToyRental.ca does not insure your items, your listings, your rental income, your deposits, your renters, your property, your business, your home, your vehicle, your trailer, your tools, your equipment, your event items, your recreational items, or any rental arrangement.

ToyRental.ca fees are not insurance premiums, damage deposits, security deposits, protection plans, compensation funds, reimbursement funds, guarantees, or escrow payments.

Before renting any item, you should contact your own insurance provider and confirm whether your policy covers peer-to-peer rentals, commercial rental activity, third-party use, theft, damage, loss, non-return, injury, death, property damage, and other rental-related risks.

ToyRental.ca does not guarantee that any insurance policy will cover your rental activity.

6. Ownership and Authority to Rent

You may only list items that you own or have full legal authority to rent.

You must not list or rent:

  • Stolen property.
  • Borrowed property without permission.
  • Leased property without permission.
  • Financed property where rental is prohibited.
  • Employer-owned property without authorization.
  • Business-owned property without authorization.
  • Items subject to ownership disputes.
  • Items subject to court orders, liens, seizure orders, restrictions, or legal claims that prevent rental.

By posting a listing, you represent that you have the legal right to offer the item for rent.

7. Lawful and Permitted Items Only

You are responsible for ensuring that every item you list is lawful to own, possess, advertise, rent, transport, and use.

You must not list illegal, unsafe, stolen, counterfeit, recalled, prohibited, restricted, misleading, or inappropriate items.

You must comply with all laws, regulations, bylaws, licence requirements, permit requirements, safety standards, insurance requirements, manufacturer instructions, venue rules, and ToyRental.ca policies that apply to your item and rental activity.

ToyRental.ca may remove any listing or restrict any account if ToyRental.ca believes an item is illegal, unsafe, prohibited, restricted, misleading, high-risk, or inappropriate for the platform.

8. Recalled, Dangerous, or Defective Items

You must not list or rent any item that is recalled, known to be dangerous, known to be defective, or unsafe for ordinary or intended use.

Before listing and before each rental, you should confirm that the item:

  • Is not subject to a safety recall.
  • Is not subject to a recall order.
  • Has not been voluntarily recalled because of a health or safety danger.
  • Has no known defect that makes it unsafe.
  • Has all required safety parts, guards, warnings, instructions, and labels.
  • Has not been modified in a way that makes it unsafe or unlawful.
  • Can be safely used for the purpose described in the listing.

If you learn that an item is recalled, dangerous, defective, unsafe, or prohibited after posting it, you must remove the listing immediately and stop renting the item.

9. Accurate Listings

Your listing must be accurate, complete, current, and not misleading.

Your listing should clearly disclose:

  • What the item is.
  • The item’s true condition.
  • Photos showing the actual item.
  • The rental price.
  • The rental rate type, such as hourly, daily, weekly, or monthly.
  • Availability.
  • Approximate location or service area.
  • Pickup, return, or delivery expectations.
  • Known damage.
  • Known defects.
  • Missing parts or accessories.
  • Limitations.
  • Safety requirements.
  • Training, experience, licence, permit, supervision, or insurance requirements.
  • Deposit expectations, if any.
  • Cleaning, fuel, battery, accessory, or return requirements.
  • Restrictions on use.

You must not use fake photos, misleading descriptions, bait-and-switch pricing, hidden mandatory fees, false availability, false condition claims, false safety claims, or false ownership claims.

10. Pricing, Deposits, and Rental Money

ToyRental.ca does not collect, hold, manage, release, guarantee, or refund rental money between hosts and renters.

As a host, you are responsible for setting and communicating your own rental price, deposits, damage deposits, security deposits, late fees, cleaning fees, delivery fees, pickup fees, fuel charges, repair charges, replacement charges, cancellation fees, and any other rental-related amounts.

You must clearly communicate any required rental money before the renter commits to the rental.

You are responsible for collecting rental money directly from the renter if you choose to do so.

ToyRental.ca is not responsible for unpaid rental charges, unpaid deposits, fake payment confirmations, reversed payments, chargebacks, cash disputes, e-transfer disputes, bank delays, renter refusal to pay, deposit disputes, or collection of money.

11. Taxes and Business Obligations

You are responsible for determining whether your rental activity is personal, business, commercial, taxable, licensed, regulated, or otherwise subject to legal obligations.

You are responsible for reporting income, collecting taxes where required, remitting taxes where required, keeping records, obtaining permits, obtaining licences, obtaining insurance, and complying with all business, tax, zoning, municipal, safety, and legal requirements that apply to your rental activity.

ToyRental.ca does not provide legal, tax, accounting, insurance, safety, or business advice.

12. Item Inspection Before Listing

Before listing an item, you should inspect it carefully.

You should confirm that the item is:

  • Safe.
  • Lawful to rent.
  • Properly maintained.
  • Properly assembled.
  • Properly repaired.
  • Clean enough for rental use.
  • Free from dangerous defects.
  • Not recalled.
  • Not missing required safety parts.
  • Suitable for the rental use described in the listing.

If the item is not safe or suitable for rental use, do not list it.

13. Item Inspection Before Each Rental

You should inspect the item before every rental, even if the item was inspected previously.

Your inspection should consider, where applicable:

  • Visible damage.
  • Loose parts.
  • Missing parts.
  • Leaks.
  • Cracks.
  • Wear.
  • Corrosion.
  • Cleanliness.
  • Stability.
  • Brakes.
  • Lights.
  • Locks.
  • Safety guards.
  • Warning labels.
  • Power cords.
  • Batteries.
  • Chargers.
  • Fuel levels.
  • Tires.
  • Straps.
  • Attachments.
  • Accessories.
  • Manuals.
  • Anything else relevant to safe use.

Do not release an item if it appears unsafe, defective, incomplete, improperly assembled, improperly installed, unstable, recalled, or unlawful to rent.

14. Disclosure of Defects, Risks, and Requirements

You must disclose known defects, damage, risks, limits, restrictions, missing parts, special requirements, and safety concerns before the renter accepts the item.

You should disclose:

  • Known damage.
  • Known defects.
  • Missing parts.
  • Missing accessories.
  • Known hazards.
  • Required protective equipment.
  • Required training or experience.
  • Required licences or permits.
  • Required insurance.
  • Age, weight, capacity, height, load, or use limits.
  • Weather restrictions.
  • Indoor or outdoor use restrictions.
  • Setup, installation, anchoring, transport, or supervision requirements.
  • Prohibited uses.

You must not hide important safety or condition information from a renter.

15. Instructions, Manuals, Demonstrations, and Warnings

You are responsible for deciding what instructions, manuals, demonstrations, warnings, and safety information should be provided to the renter.

Where appropriate, you should provide:

  • Written instructions.
  • Manufacturer manuals.
  • Safety warnings.
  • Setup instructions.
  • Operating instructions.
  • Transport instructions.
  • Loading and unloading instructions.
  • Cleaning instructions.
  • Return instructions.
  • Emergency shutoff instructions.
  • Demonstrations where reasonable and safe.

You should not release an item if you believe the renter does not understand how to use it safely or lawfully.

16. Renter Suitability

You are responsible for deciding whether you are comfortable renting to a renter.

Before releasing an item, you may choose to consider:

  • The renter’s questions and understanding of the item.
  • The renter’s planned use.
  • The renter’s experience.
  • The renter’s ability to transport the item safely.
  • The renter’s ability to use the item safely.
  • Whether licences, permits, insurance, training, or supervision are required.
  • Whether identification or a written agreement is appropriate.
  • Whether a deposit is appropriate.
  • Whether the renter appears impaired, unsafe, dishonest, unprepared, or unsuitable.

You may refuse to rent your item if you are not comfortable proceeding, provided your refusal does not violate applicable law or ToyRental.ca policy.

17. Written Rental Agreements

ToyRental.ca is not a party to rental agreements between hosts and renters.

You are responsible for deciding whether to use your own written rental agreement, waiver, inspection form, deposit receipt, condition checklist, damage agreement, or other document.

A written rental agreement may help clarify:

  • The item being rented.
  • The rental dates and times.
  • The rental price.
  • The deposit amount.
  • Payment method.
  • Pickup and return details.
  • Condition at pickup.
  • Condition at return.
  • Permitted use.
  • Prohibited use.
  • Damage responsibility.
  • Late return fees.
  • Cleaning requirements.
  • Replacement cost.
  • Missing parts.
  • Safety requirements.
  • Insurance requirements.
  • Cancellation terms.
  • What happens if the item is damaged, lost, stolen, returned late, returned dirty, returned incomplete, or not returned.

ToyRental.ca does not provide legal advice and does not guarantee that any written rental agreement, waiver, checklist, or document will be valid, enforceable, complete, or suitable for your rental.

18. Photos and Documentation Before Release

You should document the item’s condition before releasing it to a renter.

Documentation may include:

  • Photos.
  • Videos.
  • Serial numbers.
  • Accessory lists.
  • Condition checklists.
  • Written notes.
  • Fuel levels.
  • Battery charge levels.
  • Odometer or hour meter readings, if applicable.
  • Pickup time.
  • Pickup location.
  • Deposit receipt.
  • Payment record.
  • Signed rental agreement, if used.

ToyRental.ca may maintain platform records, but ToyRental.ca does not guarantee that platform records will prove condition, resolve disputes, recover money, recover items, or establish responsibility.

19. Photos and Documentation on Return

You should inspect and document the item when it is returned.

You should compare the returned item against the pre-rental condition record and check:

  • Visible damage.
  • Missing parts.
  • Missing accessories.
  • Cleanliness.
  • Fuel level.
  • Battery level.
  • Operating condition.
  • Late return.
  • Unusual wear.
  • Misuse indicators.
  • Whether all agreed items were returned.

If there is a dispute, you are responsible for handling it directly with the renter or through insurance, legal advice, law enforcement, small claims court, or other available processes.

20. Pickup, Delivery, Loading, and Unloading

If you offer pickup, delivery, loading, unloading, setup, takedown, or transportation help, you are responsible for doing so safely and lawfully.

You should clearly communicate:

  • Pickup address or meeting location.
  • Return address or meeting location.
  • Pickup time.
  • Return time.
  • Delivery availability.
  • Delivery fee, if any.
  • Loading requirements.
  • Vehicle requirements.
  • Number of people required to move the item.
  • Equipment required to move the item.
  • Restrictions on transport.
  • Who is responsible for damage during loading, unloading, delivery, or return.

ToyRental.ca is not responsible for injury, death, property damage, vehicle damage, trailer damage, item damage, delivery delays, failed pickup, failed return, improper loading, improper unloading, improper securing, or transport-related incidents.

21. Setup, Installation, and Supervision

Some items may require setup, installation, assembly, anchoring, levelling, inflation, electrical connection, water connection, propane connection, fuel, charging, calibration, supervision, or takedown.

You are responsible for disclosing all known setup, installation, assembly, anchoring, supervision, and takedown requirements.

If you provide setup or installation, you are responsible for doing so safely and lawfully.

If the renter is responsible for setup or installation, you should clearly explain what is required and whether the renter needs special tools, training, experience, safety equipment, or assistance.

ToyRental.ca is not responsible for injury, death, property damage, improper setup, improper installation, improper assembly, lack of supervision, unsafe location, unsafe weather, or unsafe use.

22. Higher-Risk Items

If you list higher-risk items, you must use extra caution.

Higher-risk items may include:

  • Tools.
  • Power equipment.
  • Machinery.
  • Trailers.
  • Vehicle-related items.
  • Watercraft-related items.
  • Outdoor equipment.
  • Recreational equipment.
  • Inflatables.
  • Party rentals.
  • Event items.
  • Heating equipment.
  • Electrical equipment.
  • Lifting equipment.
  • Access equipment.
  • Items used by or around children.

You should clearly disclose safety rules, limits, experience requirements, protective equipment, supervision requirements, and prohibited uses.

You should refuse to release higher-risk items if you believe the renter is not able to use them safely and lawfully.

23. Items Used by or Around Children

If an item may be used by or around children, you must use extra caution.

You should clearly disclose:

  • Age limits.
  • Weight limits.
  • Capacity limits.
  • Adult supervision requirements.
  • Setup requirements.
  • Weather restrictions.
  • Surface restrictions.
  • Anchoring requirements.
  • Cleaning condition.
  • Known defects or missing parts.
  • Safety rules.

You must not list recalled, unsafe, broken, unsanitary, incomplete, or inappropriate child-related items.

ToyRental.ca is not responsible for injury, death, lack of supervision, improper setup, unsafe use, or child-related rental incidents.

24. Cleanliness, Sanitation, and Allergens

You are responsible for accurately describing the cleanliness and condition of your item.

Where relevant, you should disclose:

  • Pet exposure.
  • Smoke exposure.
  • Food exposure.
  • Outdoor use.
  • Dust.
  • Mould concerns.
  • Odours.
  • Chemical exposure.
  • Cleaning requirements.
  • Sanitation limitations.

ToyRental.ca does not clean, sanitize, inspect, or certify items.

25. Communication With Renters

You should communicate clearly, honestly, and respectfully with renters.

You should respond to reasonable questions about:

  • Item condition.
  • Availability.
  • Price.
  • Deposit.
  • Pickup and return.
  • Delivery.
  • Instructions.
  • Safety.
  • Licences or permits.
  • Insurance.
  • Restrictions.
  • Cancellation expectations.

You must not harass, threaten, abuse, mislead, pressure, discriminate against, spam, or scam renters.

26. Cancellation and Availability

You are responsible for keeping your listing availability accurate.

If you approve a rental and later cannot proceed, you should notify the renter as soon as possible.

ToyRental.ca is not responsible for host cancellations, missed rentals, renter inconvenience, renter losses, bad weather, scheduling conflicts, unavailable items, or disputes caused by cancellation.

Repeated cancellations, no-shows, inaccurate availability, or unreliable host conduct may result in warnings, listing removal, reduced visibility, account restriction, suspension, or termination.

27. Damage, Theft, Loss, and Non-Return

If your item is damaged, lost, stolen, returned late, returned dirty, returned incomplete, or not returned, you are responsible for handling the issue directly with the renter.

You may need to use your own rental agreement, deposit, insurance, police report, legal advice, small claims court, collection process, or other available remedy.

ToyRental.ca may review reports for platform safety or policy enforcement, but ToyRental.ca does not guarantee recovery of items, money, deposits, repair costs, replacement costs, lost income, or damages.

28. Reviews and Renter Feedback

ToyRental.ca may allow hosts to review renters after eligible rentals.

Reviews must be honest, relevant, and based on real rental experiences.

You must not post fake, misleading, retaliatory, abusive, discriminatory, defamatory, or private information in reviews.

ToyRental.ca may remove or restrict reviews that violate policy.

29. Reporting Problems

You may report safety concerns, fraud, damage, theft, non-return, harassment, prohibited items, or policy violations to ToyRental.ca.

ToyRental.ca may review reports and may take platform action, but ToyRental.ca does not guarantee that any report will be investigated, that any user will be removed, that any listing will be removed, that any money will be recovered, or that any item will be returned.

Emergencies, crimes, threats, thefts, injuries, accidents, or dangerous situations should be reported to emergency services, law enforcement, insurers, legal advisors, or other appropriate authorities.

30. Host Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless ToyRental.ca and its owners, operators, directors, officers, employees, contractors, agents, affiliates, service providers, successors, and assigns from any claims, demands, damages, losses, liabilities, fines, penalties, costs, expenses, and legal fees arising from or related to:

  • Your listings.
  • Your items.
  • Your rental arrangements.
  • Your rental terms.
  • Your rental money or deposits.
  • Your instructions or failure to provide instructions.
  • Your failure to disclose defects, hazards, limits, or requirements.
  • Your failure to inspect, maintain, repair, clean, or safely provide an item.
  • Your release of an item to a renter.
  • Your communication with renters.
  • Your violation of law or ToyRental.ca policy.
  • Any injury, death, property damage, theft, loss, damage, non-return, late return, or dispute involving your item or rental.

31. No Guarantee of Rental Income

ToyRental.ca does not guarantee listing views, messages, booking requests, approvals, rentals, income, profit, search ranking, featured placement, renter quality, renter reliability, or successful rental outcomes.

ToyRental.ca may change search results, listing visibility, categories, platform features, fees, rules, and availability at any time.

32. Enforcement

ToyRental.ca may remove listings, restrict features, suspend accounts, terminate accounts, reduce listing visibility, remove reviews, block messages, cancel credits, deny refunds, or take other platform action where ToyRental.ca believes a host has violated this policy or created risk.

ToyRental.ca is not required to provide warnings before taking action.

33. Changes to This Policy

ToyRental.ca may update this Host Responsibilities Policy from time to time.

When we update this policy, we will change the “Last Updated” date at the top of this page.

ToyRental.ca may provide additional notice or require renewed acceptance for material changes.

Your continued use of ToyRental.ca after an updated policy is posted means you accept the updated policy. If you do not agree with the updated policy, you must stop acting as a host on ToyRental.ca.

35. Host Acceptance

By posting a listing, approving a rental request, communicating with a renter, releasing an item, collecting rental money, collecting a deposit, or otherwise acting as a host on ToyRental.ca, you confirm that:

  • You have read this Host Responsibilities Policy.
  • You understand this Host Responsibilities Policy.
  • You agree to this Host Responsibilities Policy.
  • You are at least 18 years old.
  • You own the item or have legal authority to rent it.
  • Your item is lawful to rent.
  • Your item is not stolen, counterfeit, recalled, prohibited, unsafe, or knowingly defective.
  • Your listing is accurate and not misleading.
  • You are responsible for the item, its condition, safety, legality, instructions, rental terms, deposits, and payment arrangements.
  • You understand that ToyRental.ca does not provide insurance.
  • You understand that ToyRental.ca does not collect, hold, manage, release, guarantee, or refund rental money between you and renters.
  • You understand that you rent your item at your own risk.
  • You understand that ToyRental.ca is not responsible for theft, loss, damage, non-return, late return, injury, death, property damage, user disputes, or lost rental income.
