ToyRental.ca is an online advertising, listing, communication, booking request, and connection platform. ToyRental.ca allows users to advertise items for rent and allows other users to discover, request, and arrange rentals directly with those listing owners.
ToyRental.ca does not own, inspect, test, certify, insure, deliver, maintain, repair, operate, supervise, train users on, or control any item listed, requested, rented, used, transported, stored, or returned through the platform.
By creating an account, posting a listing, requesting a rental, approving a rental, sending a message, paying a ToyRental.ca fee, using an item, releasing an item, accepting an item, transporting an item, or otherwise using ToyRental.ca, you agree to this Safety and Risk Policy.
If you do not understand or do not agree with this Safety and Risk Policy, do not use ToyRental.ca, do not post listings, do not request rentals, do not approve rentals, do not release items, and do not accept or use rented items.
Renting, lending, borrowing, transporting, storing, operating, supervising, or returning items can involve serious risks.
Risks may include, without limitation, property damage, equipment damage, vehicle damage, trailer damage, watercraft damage, electrical hazards, fire hazards, fall hazards, crushing hazards, cutting hazards, impact hazards, moving-part hazards, weather-related risks, transportation risks, improper use, lack of training, lack of supervision, item defects, mechanical failure, user negligence, theft, loss, late return, non-return, financial loss, personal injury, serious injury, or death.
You are responsible for your own safety, your own property, your own choices, your own conduct, your own rental arrangements, and your own decision to list, request, approve, release, accept, transport, use, supervise, store, or return any item.
ToyRental.ca is not responsible for injury, death, property damage, theft, loss, damage, unsafe use, improper use, improper instruction, lack of instruction, lack of training, lack of supervision, defective items, recalled items, illegal items, failed rentals, disputes, or user misconduct, to the maximum extent permitted by law.
For the purpose of this Safety and Risk Policy:
ToyRental.ca does not inspect, test, approve, certify, verify, maintain, repair, clean, sanitize, supervise, insure, store, deliver, transport, or operate any item listed or rented by users.
ToyRental.ca does not guarantee that any item:
Users are responsible for deciding whether an item is safe, suitable, lawful, complete, properly maintained, properly explained, and appropriate for the intended use.
ToyRental.ca does not provide insurance of any kind.
ToyRental.ca does not insure hosts, renters, listings, items, rental agreements, rental money, deposits, ToyRental.ca fees, damage, theft, loss, late return, non-return, property damage, personal injury, death, business loss, income loss, missed rentals, accidents, unsafe use, defective items, transportation, pickup, delivery, storage, operation, supervision, or user conduct.
ToyRental.ca fees are not insurance premiums, protection plans, damage deposits, security deposits, guarantees, compensation funds, reimbursement funds, or escrow payments.
Hosts are responsible for confirming whether their own insurance covers renting their item to other people.
Renters are responsible for confirming whether their own insurance covers their rental, possession, transportation, operation, use, or storage of rented items.
Some insurance policies may exclude peer-to-peer rentals, commercial use, rented equipment, borrowed equipment, trailers, vehicles, watercraft, tools, machinery, event equipment, party equipment, outdoor equipment, recreational equipment, or use by third parties.
ToyRental.ca does not guarantee that any user has insurance or that any insurance policy will apply.
You use ToyRental.ca at your own risk.
Hosts post listings and rent items at their own risk.
Renters request, accept, transport, operate, use, store, supervise, and return items at their own risk.
Users meet each other, exchange property, exchange money, collect deposits, release items, accept items, provide instructions, receive instructions, and make rental arrangements at their own risk.
Users are responsible for their own decisions, including whether to proceed with a rental, whether to meet another user, whether to accept payment, whether to release an item, whether to accept an item, whether to use an item, whether to require a deposit, whether to require identification, whether to require a written agreement, whether to require insurance, and whether to stop or cancel a rental.
By using ToyRental.ca, you acknowledge and accept that rentals may involve known and unknown risks.

Before requesting or accepting an item, a renter should:

A renter must not use an item while impaired, distracted, unqualified, untrained, unlicensed where a licence is required, physically unable to safely use the item, or otherwise unable to operate the item safely.
A renter must stop using an item immediately if the item appears unsafe, defective, damaged, unstable, incomplete, improperly assembled, improperly installed, overheating, malfunctioning, or unsuitable.
Renters are responsible for learning and following the safe and proper operation of every item they rent.
Users must follow all applicable:
Users must not remove, disable, bypass, alter, modify, or interfere with guards, warnings, safety devices, locks, brakes, lights, emergency shutoffs, stabilizers, safety straps, protective components, or any other safety feature.
Users must not overload, misuse, abuse, modify, dismantle, repair, sub-rent, transfer, sell, abandon, hide, pawn, or use an item for an unlawful, unsafe, or unintended purpose.
Some items may require training, experience, licences, permits, certifications, insurance, safety equipment, adult supervision, or professional operation.
Hosts are responsible for clearly disclosing known training, experience, licence, permit, supervision, safety equipment, and operating requirements in the listing and before release of the item.
Renters are responsible for confirming that they have all required training, experience, licences, permits, insurance, supervision, and safety equipment before accepting or using an item.
ToyRental.ca does not verify that hosts or renters have required training, experience, licences, permits, certifications, insurance, or qualifications.
ToyRental.ca is not responsible for fines, penalties, tickets, charges, enforcement action, property damage, injury, death, or other harm caused by a user failing to comply with training, experience, licence, permit, insurance, or safety requirements.
Some items carry higher safety, legal, financial, or injury risk. These may include, without limitation, tools, power equipment, machinery, trailers, vehicle-related items, watercraft-related items, recreational items, outdoor equipment, inflatable items, event equipment, party equipment, heating equipment, electrical equipment, lifting equipment, access equipment, and items used by or around children.
Hosts listing higher-risk items should use extra caution, provide clear warnings, document item condition, confirm user suitability, and consider written rental agreements, deposits, proof of identity, proof of insurance, proof of licence, or refusal to rent where appropriate.
Renters requesting higher-risk items should use extra caution, ask questions, obtain instructions, inspect the item, confirm legal requirements, use proper safety equipment, and avoid using the item if they are not competent to do so safely.
ToyRental.ca may restrict, remove, reject, or prohibit higher-risk listings at any time.
ToyRental.ca may prohibit or restrict certain items, categories, listings, rentals, users, or uses at any time.
Users must not list, request, rent, promote, provide, or arrange illegal, unsafe, stolen, counterfeit, recalled, prohibited, or restricted items.
Prohibited or restricted items may include, without limitation:
ToyRental.ca may remove any listing or restrict any account if we believe an item is unsafe, prohibited, restricted, illegal, misleading, or inappropriate.
ToyRental.ca is intended for users who are at least 18 years old.
Minors may not create accounts, post listings, request rentals, approve rentals, pay ToyRental.ca fees, or enter rental arrangements through ToyRental.ca.
Some items may be used by or around children only under appropriate adult supervision. Hosts must clearly disclose if an item is intended for children, has age limits, has weight limits, has capacity limits, requires adult setup, requires adult supervision, or has specific child-safety rules.
Renters are responsible for supervising children and ensuring that any item used by or around children is age-appropriate, properly assembled, properly installed, properly supervised, and used safely.
ToyRental.ca is not responsible for injury, death, property damage, unsafe supervision, lack of supervision, improper setup, improper installation, or unsafe use involving children or minors.
Hosts should inspect items before every rental.
Renters should inspect items before accepting them.
An inspection should consider, where applicable:
If an item appears unsafe, defective, incomplete, unstable, damaged, improperly assembled, improperly installed, or different from what was agreed, the user should not proceed with the rental unless the issue is resolved safely and lawfully.
ToyRental.ca strongly recommends that hosts and renters document the condition of the item before and after every rental.

ToyRental.ca may maintain platform records, but ToyRental.ca does not guarantee that platform records will prove item condition, resolve disputes, recover money, recover items, establish fault, or replace a written rental agreement between users.

Hosts and renters are responsible for deciding whether to use their own written rental agreement, waiver, checklist, deposit form, inspection form, or other document.

Users are responsible for safe pickup, delivery, loading, unloading, securing, transport, and return of items.
Hosts should clearly explain any pickup, loading, unloading, delivery, setup, takedown, transport, or return requirements.
Renters should confirm whether they have the proper vehicle, equipment, straps, assistance, experience, licence, permit, or insurance needed to safely transport the item.
Users should not attempt to lift, load, unload, tow, move, assemble, install, operate, or transport an item if they cannot do so safely and lawfully.
ToyRental.ca is not responsible for injury, death, property damage, vehicle damage, trailer damage, improper loading, improper unloading, improper securing, improper towing, improper transport, delivery delays, pickup disputes, return disputes, or transportation-related incidents.
Some items may require setup, installation, assembly, anchoring, leveling, inflation, electrical connection, water connection, propane connection, fuel, batteries, charging, calibration, inspection, or other preparation before use.
Hosts must disclose known setup, installation, assembly, anchoring, connection, and preparation requirements.
Renters are responsible for confirming that setup, installation, assembly, connection, and use can be performed safely, lawfully, and according to all instructions and applicable rules.
Users must not use an item that appears improperly assembled, improperly installed, unstable, unsecured, damaged, defective, overloaded, or unsafe.
ToyRental.ca is not responsible for injury, death, property damage, item damage, or other harm arising from setup, installation, assembly, connection, anchoring, operation, supervision, takedown, or removal.
Tools, equipment, machinery, power items, and similar rentals can involve serious risks.
Hosts listing these items should clearly disclose the item’s condition, intended use, limitations, safety requirements, required experience, required protective equipment, required accessories, known defects, and any restrictions.
Renters should not use tools, equipment, machinery, or power items unless they are competent to do so safely and lawfully.
Users must follow all manufacturer instructions, warning labels, safety procedures, and legal requirements.
ToyRental.ca is not responsible for injury, death, property damage, defective equipment, misuse, lack of training, lack of protective equipment, improper operation, improper maintenance, or improper supervision.
Trailers, towing equipment, vehicle-related items, and similar rentals may require special care, proper vehicle compatibility, safe loading, legal weight limits, working lights, brakes, tires, straps, couplers, safety chains, licences, insurance, permits, and compliance with road safety laws.
Hosts listing trailers or vehicle-related items should clearly disclose known requirements, limitations, condition, capacity, compatibility, and safety information.
Renters are responsible for confirming that they can lawfully and safely tow, transport, load, unload, secure, park, and use the item.
ToyRental.ca does not verify vehicle compatibility, towing capacity, licences, insurance, permits, roadworthiness, or legal compliance.
ToyRental.ca is not responsible for tickets, fines, collisions, vehicle damage, trailer damage, cargo damage, property damage, injury, death, improper towing, improper loading, improper securing, or road safety incidents.
Watercraft-related items, outdoor equipment, recreational items, camping items, sports items, and similar rentals may involve weather, water, terrain, wildlife, physical ability, supervision, legal, equipment, and environmental risks.
Hosts should disclose known safety requirements, legal requirements, skill requirements, condition, limitations, required equipment, and restrictions.
Renters are responsible for confirming that they can safely and lawfully use the item, that conditions are safe, that proper safety equipment is used, and that all laws and rules are followed.
ToyRental.ca is not responsible for weather conditions, water conditions, trail conditions, venue conditions, outdoor hazards, user ability, lack of supervision, improper use, injury, death, property damage, or loss.
Party, event, inflatable, game, entertainment, and similar rentals may require proper setup, supervision, anchoring, capacity limits, age limits, weight limits, surface requirements, weather limits, electrical safety, takedown procedures, and venue approval.
Hosts should clearly disclose setup requirements, supervision requirements, capacity limits, age limits, weight limits, safety rules, weather restrictions, electrical requirements, and prohibited use.
Renters are responsible for safe setup, supervision, operation, use, takedown, venue approval, and compliance with all rules and instructions.
Renters should not use party, event, inflatable, game, or entertainment items in unsafe weather, unsafe locations, overcrowded conditions, unsupervised conditions, or in a way that violates the host’s instructions or applicable rules.
ToyRental.ca is not responsible for injury, death, property damage, improper setup, improper supervision, weather-related incidents, venue disputes, electrical issues, or unsafe use.
Some items may involve electrical, battery, fuel, propane, heating, charging, fire, ventilation, or carbon monoxide risks.
Hosts must disclose known electrical, battery, fuel, propane, heating, charging, ventilation, fire, or related safety requirements.
Renters are responsible for using items only in safe, lawful, properly ventilated, properly supervised, and appropriate locations.
Users must follow all instructions, warning labels, laws, fire codes, venue rules, and safety requirements.
ToyRental.ca is not responsible for fires, electrical damage, battery issues, fuel issues, heating issues, ventilation issues, property damage, injury, death, or other harm.
Hosts are responsible for accurately describing the cleanliness and condition of their items.
Renters are responsible for inspecting items before use and deciding whether an item is clean, safe, and suitable for their needs.
Users should disclose and consider relevant cleaning requirements, sanitation requirements, pet exposure, smoke exposure, food exposure, outdoor use, chemical exposure, dust, mould, odours, or allergens where relevant.
ToyRental.ca does not inspect, clean, sanitize, disinfect, or certify items.
ToyRental.ca is not responsible for illness, allergic reactions, contamination, odours, cleanliness disputes, sanitation disputes, or cleaning-related damage, to the maximum extent permitted by law.
Weather, site conditions, venue rules, terrain, ground conditions, water conditions, road conditions, space limitations, access limitations, power availability, lighting, supervision, and environmental conditions may affect whether an item can be used safely.
Hosts should disclose known weather, site, venue, surface, space, access, power, or environmental restrictions.
Renters are responsible for confirming that the item can be used safely and lawfully at the intended location and under the conditions present.
Users should not use an item where weather, site, venue, environmental, or other conditions make use unsafe or unlawful.
ToyRental.ca is not responsible for bad weather, unsuitable sites, unsafe venues, unsafe ground conditions, unsafe water conditions, road conditions, power issues, venue cancellations, permits, or environmental hazards.
Hosts accept the risk that their item may be damaged, lost, stolen, misused, returned late, returned dirty, returned incomplete, or not returned at all.
Renters accept responsibility for the possession, care, custody, control, use, storage, transportation, and return of items they rent.
ToyRental.ca does not guarantee item return, item condition, deposit collection, deposit return, repair payment, replacement payment, debt collection, insurance coverage, law enforcement action, or court recovery.
Users are responsible for resolving damage, theft, loss, late return, non-return, missing parts, repair cost, replacement cost, and deposit disputes directly with each other or through insurance, law enforcement, court, small claims court, legal counsel, or other available processes.
ToyRental.ca does not collect, hold, manage, release, guarantee, or refund rental money between hosts and renters.
Rental payments, deposits, damage deposits, security deposits, late fees, cleaning fees, delivery fees, pickup fees, repair charges, replacement charges, and cancellation charges are handled directly between users.
Users accept the risk of payment disputes, unpaid amounts, deposit disputes, chargebacks, cash disputes, e-transfer disputes, bank delays, fraud, scams, and financial loss.
ToyRental.ca is not responsible for unpaid rental charges, deposits not returned, hosts refusing to refund, renters refusing to pay, payment fraud, fake payments, bounced payments, reversed payments, or disputes over rental money.
Users are responsible for their own personal safety when communicating, meeting, picking up items, returning items, delivering items, accepting payments, or exchanging property.
ToyRental.ca does not supervise, verify, attend, monitor, control, or guarantee any meeting between users.
Users should use caution when meeting people they do not know, sharing personal information, visiting private locations, accepting cash, releasing valuable property, or allowing others to attend their home, business, storage location, or pickup location.
ToyRental.ca is not responsible for assault, theft, robbery, threats, harassment, trespass, property damage, fraud, unsafe meetings, unsafe locations, personal injury, death, or other harm arising from users meeting or communicating with each other.
ToyRental.ca is not responsible for user misconduct.
User misconduct may include, without limitation:

Users may report safety concerns, unsafe listings, unsafe users, fraud, theft, damage, prohibited items, harassment, or policy violations to ToyRental.ca.
ToyRental.ca may review reports for safety, support, moderation, fraud prevention, legal compliance, policy enforcement, or platform improvement purposes.
ToyRental.ca does not guarantee that reports will be investigated, that users will be contacted, that listings will be removed, that accounts will be suspended, that refunds or credits will be issued, that money will be recovered, that property will be recovered, or that disputes will be resolved.
Emergencies, crimes, threats, thefts, injuries, accidents, dangerous situations, or immediate safety concerns should be reported to emergency services, law enforcement, insurers, medical professionals, legal advisors, or other appropriate authorities.
ToyRental.ca may remove, hide, restrict, suspend, or disable any listing, account, message, review, profile, content, feature, or platform activity at any time if ToyRental.ca believes it creates legal, safety, financial, operational, reputational, technical, or user risk.
ToyRental.ca may take action based on complaints, user reports, messages, booking records, platform logs, payment records, listing content, public information, third-party reports, law enforcement requests, payment processor notices, or ToyRental.ca’s own review.
ToyRental.ca’s decision to allow a listing or user to remain on the platform does not mean ToyRental.ca has approved, inspected, certified, verified, insured, endorsed, or guaranteed that listing, user, or item.
ToyRental.ca does not provide legal, insurance, safety, engineering, mechanical, electrical, tax, accounting, medical, training, inspection, or professional advice.
Any safety information, checklist, article, warning, tooltip, platform notice, or policy language provided by ToyRental.ca is general information only and may not apply to your specific item, rental, location, user, or situation.
Users are responsible for obtaining professional advice where appropriate.
