1. Introduction

Welcome to ToyRental.ca. These Terms of Use govern your access to and use of ToyRental.ca, including our website, mobile-friendly website, listings, booking request tools, messaging tools, user accounts, reviews, payment-related tools, support tools, and all other services, features, pages, forms, content, and functionality made available through ToyRental.ca.

In these Terms, “ToyRental.ca,” “we,” “us,” and “our” means ToyRental.ca and its owners, operators, administrators, contractors, service providers, affiliates, successors, and assigns.

“User,” “you,” and “your” means any person who visits, browses, accesses, creates an account, posts a listing, requests a rental, approves a rental, messages another user, pays a ToyRental.ca fee, submits content, or otherwise uses ToyRental.ca.

By accessing or using ToyRental.ca, you agree to be bound by these Terms of Use, our Privacy Policy, Refund and Credit Policy, Safety and Risk Policy, Community Guidelines, and any other policies, notices, or rules posted on ToyRental.ca from time to time.

If you do not agree with these Terms, do not access or use ToyRental.ca.

2. Important Legal Notice

ToyRental.ca is an online advertising, listing, communication, and connection platform. We provide tools that allow users to advertise items for rent, discover listings, communicate with each other, and arrange rentals directly with each other.

ToyRental.ca is not a rental company. ToyRental.ca is not the owner, operator, supplier, seller, lessor, renter, borrower, bailee, carrier, delivery provider, broker, agent, insurer, repairer, inspector, guarantor, employer, partner, joint venturer, representative, or trustee of any user.

ToyRental.ca does not own, inspect, test, certify, insure, deliver, store, maintain, repair, operate, supervise, control, or guarantee any item listed, rented, requested, discussed, or advertised on the platform.

Rental arrangements are made directly between the listing owner and the renter. ToyRental.ca is not a party to the rental agreement or rental transaction between users.

Users use ToyRental.ca at their own risk. Users list items at their own risk. Users rent items at their own risk. Users meet, pay, release items, accept items, transport items, operate items, store items, and return items at their own risk.

3. Definitions

For the purpose of these Terms:

  • “Platform” means ToyRental.ca and all related services, pages, tools, software, forms, listings, accounts, communications, and features.
  • “Host” means a user who posts, owns, controls, manages, or offers an item for rent.
  • “Renter” means a user who browses, requests, reserves, rents, uses, receives, transports, or returns an item listed by a host.
  • “Listing” means an advertisement, post, page, profile, description, photo, price, availability calendar, rental term, or other content relating to an item offered for rent.
  • “Item” means any product, tool, toy, game, equipment, trailer, machine, device, party item, outdoor item, vehicle-related item, watercraft-related item, recreational item, accessory, attachment, or other property listed, advertised, rented, or discussed on the platform.
  • “Rental Agreement” means any agreement, understanding, arrangement, conversation, booking, exchange, written contract, verbal agreement, or direct deal between a host and renter.
  • “Rental Money” means any payment, rental charge, deposit, damage deposit, security deposit, late fee, delivery fee, pickup fee, fuel charge, cleaning fee, repair charge, replacement charge, cancellation charge, or other amount paid between host and renter.
  • “ToyRental.ca Fee” means any platform fee, booking fee, connection fee, administrative fee, listing fee, featured listing fee, subscription fee, advertising fee, promotional fee, or other fee charged by ToyRental.ca for use of platform services.
  • “Content” means any text, photo, image, video, message, profile information, listing information, review, rating, file, document, link, or other material submitted, uploaded, posted, transmitted, displayed, or made available by a user.

4. Eligibility

You must be at least 18 years old to create an account, post a listing, request a rental, approve a rental, pay a ToyRental.ca fee, or otherwise use ToyRental.ca for rental-related activity.

By using ToyRental.ca, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into binding agreements.
  • You will use ToyRental.ca only for lawful purposes.
  • You will comply with all applicable laws, regulations, bylaws, rules, permits, licensing requirements, and safety requirements.
  • All information you provide to ToyRental.ca is true, accurate, current, and complete.
  • You are not prohibited from using ToyRental.ca under these Terms or applicable law.

ToyRental.ca may refuse, restrict, suspend, or terminate access to any user at any time where we believe the user is underage, has provided false information, has violated these Terms, has created risk, or may cause harm to ToyRental.ca, another user, or the public.

5. Account Registration and Security

Some features require an account. You agree to provide accurate and complete account information and to keep your account information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree not to:

  • Create an account using false, misleading, or stolen information.
  • Impersonate another person or business.
  • Create multiple accounts to avoid restrictions, reviews, suspensions, fees, or enforcement action.
  • Allow another person to use your account.
  • Use another person’s account without permission.
  • Sell, transfer, rent, or assign your account.
  • Use ToyRental.ca for fraud, abuse, spam, harassment, or unlawful conduct.

You must notify ToyRental.ca immediately if you believe your account has been accessed without authorization or if your login information has been compromised.

ToyRental.ca is not responsible for losses caused by unauthorized account access unless required by applicable law.

6. Email Verification and Platform Communications

ToyRental.ca may require email verification before allowing access to certain features, including posting listings, requesting rentals, approving rentals, messaging users, or receiving booking-related notifications.

By creating an account, you agree that ToyRental.ca may send you service-related communications, including account verification emails, booking request emails, approval or decline emails, message notifications, platform notices, safety alerts, policy updates, password reset emails, support messages, and other communications necessary to operate the platform.

ToyRental.ca may also send marketing or promotional communications where permitted by law. Where required, marketing messages will include an unsubscribe option.

You are responsible for keeping your email address accurate and for checking your email and platform messages. ToyRental.ca is not responsible for missed messages, emails delivered to spam or junk folders, failed delivery, incorrect email addresses, or communication delays.

7. Role of ToyRental.ca

ToyRental.ca provides platform tools only. We do not control users, listings, items, rental payments, rental agreements, item condition, item safety, item availability, pickup, delivery, return, deposits, damage claims, insurance, or user conduct.

ToyRental.ca does not guarantee:

  • That any user is honest, safe, reliable, insured, trained, licensed, or qualified.
  • That any listing is accurate, complete, current, lawful, or not misleading.
  • That any item exists, is available, is safe, is functional, is clean, is suitable, or is as described.
  • That any rental will occur.
  • That any host will release an item.
  • That any renter will pay, return, or properly use an item.
  • That any payment, deposit, refund, repair cost, or replacement cost will be made.
  • That any dispute will be resolved.
  • That any item will be returned undamaged, on time, clean, complete, or at all.

ToyRental.ca may offer support, moderation, reporting tools, safety suggestions, booking records, or communication tools, but these tools do not make ToyRental.ca responsible for any rental transaction, item, user, accident, dispute, loss, injury, or damage.

8. Rental Agreements Are Between Users Only

Any rental agreement is made directly between the host and the renter. ToyRental.ca is not a party to that agreement.

Hosts and renters are solely responsible for discussing, agreeing on, documenting, and enforcing the terms of their rental, including:

  • The item being rented.
  • The rental price.
  • The rental period.
  • The pickup time and location.
  • The return time and location.
  • Delivery arrangements, if any.
  • Deposits or security deposits, if any.
  • Payment method.
  • Cancellation terms.
  • Late fees.
  • Damage responsibility.
  • Cleaning responsibility.
  • Fuel, battery charge, accessories, attachments, keys, manuals, chargers, cords, parts, or related items.
  • Safe use and operating instructions.
  • Training, experience, licences, permits, insurance, or supervision requirements.
  • Inspection before and after the rental.
  • What happens if the item is lost, stolen, damaged, misused, returned late, returned dirty, returned incomplete, or not returned.

ToyRental.ca strongly recommends that users create their own written rental agreement, take photos or videos before and after the rental, confirm identification where appropriate, keep payment records, document item condition, and use common sense before meeting or exchanging property.

9. Rental Money Between Hosts and Renters

ToyRental.ca does not collect, hold, process, manage, release, guarantee, refund, or distribute rental money between hosts and renters.

Rental payments, deposits, damage deposits, security deposits, delivery fees, late fees, cleaning fees, repair costs, replacement costs, cancellation fees, and all other rental-related amounts are handled directly between the host and renter.

ToyRental.ca is not responsible for:

  • Unpaid rental charges.
  • Failed payments.
  • Cash disputes.
  • E-transfer disputes.
  • Chargebacks.
  • Deposits not returned.
  • Damage deposits kept by hosts.
  • Renters refusing to pay.
  • Hosts refusing to refund.
  • Bank delays.
  • Payment fraud.
  • Disputes over pricing, deposits, late fees, cleaning fees, repair costs, replacement costs, or cancellation charges.

Users are responsible for choosing safe and appropriate payment methods. Users should be cautious when sending money to people they do not know.

10. ToyRental.ca Platform Fees

ToyRental.ca may charge a separate platform fee, booking fee, connection fee, administrative fee, listing fee, featured listing fee, subscription fee, advertising fee, promotional fee, or other fee for access to or use of certain platform services.

ToyRental.ca fees are separate from rental money between host and renter.

ToyRental.ca fees are not:

  • Rental payments to the host.
  • Damage deposits.
  • Security deposits.
  • Insurance premiums.
  • Guarantees.
  • Protection plans.
  • Compensation funds.
  • Escrow payments.
  • Payments held on behalf of the host or renter.

ToyRental.ca fees may be charged for platform-related services, including access to booking tools, connection features, messaging, listing visibility, administrative processing, account features, support tools, advertising tools, or other platform services.

All applicable ToyRental.ca fees should be displayed before payment. By paying a ToyRental.ca fee, you authorize the charge and agree to the applicable Refund and Credit Policy.

ToyRental.ca may change its fees, fee structure, free features, paid features, promotions, or pricing at any time. Fee changes do not affect completed payments unless required by law.

11. Refunds and Credits

ToyRental.ca refunds are limited and are not guaranteed.

In most cases, if ToyRental.ca decides that a remedy is appropriate for a platform-related issue, the remedy will be a ToyRental.ca credit rather than a cash refund.

Refunds may be considered only in rare circumstances, at ToyRental.ca’s discretion, and subject to applicable law.

ToyRental.ca generally does not issue refunds for problems between hosts and renters, including:

  • A host cancelling or refusing to proceed.
  • A renter cancelling or changing their mind.
  • A host or renter not showing up.
  • Bad weather.
  • Scheduling conflicts.
  • Item condition disputes.
  • Item performance disputes.
  • Item availability disputes.
  • Payment disputes between users.
  • Deposit disputes between users.
  • Damage, theft, loss, late return, missing parts, or dirty items.
  • A user being dissatisfied with another user.
  • A user failing to read a listing, message, policy, or rental term.

ToyRental.ca credits have no cash value, are not transferable, and may expire. Additional rules may be set out in the Refund and Credit Policy.

Nothing in these Terms limits any non-waivable legal rights a user may have under applicable law.

12. No Insurance

ToyRental.ca does not provide insurance of any kind.

ToyRental.ca does not provide insurance for hosts, renters, listings, items, rental transactions, rental payments, deposits, damage, theft, loss, non-return, injury, death, property damage, business loss, income loss, vehicle damage, equipment damage, watercraft damage, trailer damage, tool damage, accidents, negligence, misuse, defective items, unsafe operation, or any other claim or loss.

Users are solely responsible for obtaining their own insurance if they want or need coverage.

Hosts should contact their own insurer before renting items to others. Renters should contact their own insurer before using rented items. Some insurance policies may not cover peer-to-peer rentals, commercial activity, borrowed items, rented items, tools, trailers, vehicles, watercraft, party equipment, recreational items, or other rental-related use.

ToyRental.ca does not guarantee that any user has insurance or that any insurance policy will apply.

13. Assumption of Risk

By using ToyRental.ca, you understand and accept that renting, lending, borrowing, transporting, operating, storing, supervising, and returning items can involve risk.

Risks may include, without limitation:

  • Theft.
  • Loss.
  • Damage.
  • Non-return.
  • Late return.
  • Misuse.
  • Unsafe operation.
  • Mechanical failure.
  • Electrical failure.
  • Product defects.
  • Improper instructions.
  • Lack of training.
  • Lack of supervision.
  • Property damage.
  • Personal injury.
  • Serious injury.
  • Death.
  • Financial loss.
  • Legal disputes.
  • Insurance denial.

Users voluntarily assume all risks associated with using ToyRental.ca, posting listings, requesting rentals, approving rentals, meeting other users, exchanging money, releasing items, accepting items, transporting items, operating items, supervising use, and returning items.

ToyRental.ca is not responsible for any injury, death, property damage, financial loss, theft, loss, damage, non-return, dispute, accident, or harm arising from or related to any user, item, listing, rental agreement, rental transaction, or use of the platform, to the maximum extent permitted by law.

14. Host Responsibilities

Hosts are solely responsible for the items they list and rent.

By posting a listing or approving a rental, a host represents and warrants that:

  • The host owns the item or has full legal authority to rent it.
  • The item is not stolen, counterfeit, illegal, recalled, prohibited, or unsafe to rent.
  • The listing is accurate, complete, and not misleading.
  • The photos reasonably show the item being offered.
  • The item is in the condition described.
  • The host has disclosed known defects, limitations, hazards, special requirements, and restrictions.
  • The host will comply with all laws, bylaws, regulations, permits, safety standards, and licensing requirements.
  • The host will not rent an item where doing so is unlawful or unsafe.
  • The host will not rent an item to a person the host believes cannot safely or legally use it.

Hosts are responsible for:

  • Inspecting items before each rental.
  • Maintaining items in safe and proper condition.
  • Providing accurate descriptions and photos.
  • Setting accurate availability.
  • Setting rental prices and terms.
  • Disclosing risks, defects, missing parts, limits, and special conditions.
  • Providing operating instructions where required or appropriate.
  • Providing safety warnings where required or appropriate.
  • Providing manuals where available.
  • Explaining safe and proper use to the renter where appropriate.
  • Determining whether the renter requires training, experience, licences, permits, safety gear, supervision, or insurance.
  • Confirming pickup and return arrangements.
  • Collecting rental money or deposits directly from the renter, if applicable.
  • Deciding whether to release the item.
  • Documenting condition before and after rental.
  • Handling disputes directly with the renter.
  • Reporting theft, fraud, or criminal conduct to the appropriate authorities.

Hosts accept the risk that their item may be damaged, lost, stolen, misused, returned late, returned dirty, returned incomplete, or not returned at all.

15. Renter Responsibilities

Renters are solely responsible for deciding whether to request, accept, transport, use, operate, supervise, store, and return any item.

By requesting or accepting a rental, a renter represents and warrants that:

  • The renter will use the item lawfully and safely.
  • The renter will not use an item unless they understand how to use it properly.
  • The renter will follow all applicable laws, bylaws, regulations, permits, safety rules, and licensing requirements.
  • The renter will follow manufacturer instructions and host instructions.
  • The renter will use appropriate safety equipment where required or appropriate.
  • The renter will not misuse, abuse, overload, modify, damage, hide, sell, pawn, transfer, sub-rent, abandon, or fail to return the item.
  • The renter will return the item on time, clean, complete, and in the agreed condition, subject to ordinary agreed use.

Renters are responsible for:

  • Reading the listing carefully.
  • Asking questions before renting.
  • Inspecting the item before accepting it.
  • Refusing the item if it appears unsafe, defective, incomplete, or different from what was agreed.
  • Confirming total rental cost and deposit terms directly with the host.
  • Confirming pickup, return, and cancellation expectations.
  • Confirming whether licences, permits, insurance, training, or safety equipment are required.
  • Using the item only for its intended purpose.
  • Stopping use immediately if the item appears unsafe, defective, damaged, or unsuitable.
  • Keeping the item secure while in the renter’s possession.
  • Returning all parts, accessories, keys, manuals, chargers, cords, attachments, and related items.
  • Handling disputes directly with the host.

Renters accept the risk that an item may not be as described, may not be available, may not function as expected, may be unsafe, may be unsuitable for the renter’s intended purpose, or may not meet the renter’s expectations.

16. Safety Requirements

Safety is the responsibility of users. ToyRental.ca does not inspect, test, certify, approve, or supervise items or users.

Hosts should not release an item unless they are satisfied that the renter can receive, transport, use, supervise, and return the item safely and lawfully.

Renters should not accept or use an item unless they understand how to use it safely and lawfully.

Users must not use any item while impaired, distracted, untrained, unqualified, unlicensed where a licence is required, or unable to safely operate the item.

Users must comply with all manufacturer instructions, warning labels, host instructions, applicable laws, occupational safety rules, traffic laws, boating laws, trailer laws, equipment laws, municipal bylaws, fire codes, event rules, venue rules, and any other rules that apply to the item or activity.

ToyRental.ca is not responsible for any accident, unsafe use, misuse, improper instruction, lack of instruction, lack of training, lack of supervision, equipment failure, item defect, product recall, personal injury, death, property damage, or other harm.

17. Prohibited Listings and Prohibited Conduct

ToyRental.ca may prohibit or restrict certain items, listings, categories, users, conduct, or rental activity at any time.

Users may not list, request, rent, promote, advertise, or facilitate:

  • Illegal items or illegal services.
  • Stolen property.
  • Counterfeit goods.
  • Weapons, firearms, ammunition, explosives, or weapon accessories.
  • Illegal drugs, controlled substances, cannabis products, drug paraphernalia, or intoxicants.
  • Alcohol, tobacco, vaping products, or age-restricted consumable products.
  • Hazardous chemicals, toxic substances, dangerous materials, or regulated substances.
  • Recalled products or items known to be unsafe.
  • Items that cannot legally be rented, transferred, operated, or possessed.
  • Items that require a licence, permit, insurance, certification, or training unless all requirements are clearly disclosed and legally followed.
  • Adult sexual products or adult services.
  • Human services, escort services, or companionship services.
  • Animals, unless specifically permitted by ToyRental.ca.
  • Medical devices or health-related equipment where rental would be unsafe, unlawful, or inappropriate.
  • Items that infringe intellectual property rights.
  • Anything that promotes hate, violence, exploitation, harassment, fraud, or unlawful activity.

Users may not:

  • Use ToyRental.ca for fraud, scams, theft, harassment, threats, intimidation, abuse, discrimination, or unlawful conduct.
  • Post false, misleading, deceptive, incomplete, or bait-and-switch listings.
  • Manipulate reviews, ratings, prices, locations, availability, or search results.
  • Upload viruses, malware, harmful code, spam, phishing links, or malicious content.
  • Scrape, copy, harvest, or misuse platform data.
  • Attempt to bypass security, rate limits, account restrictions, moderation tools, or access controls.
  • Use automated tools, bots, crawlers, or scripts without written permission from ToyRental.ca.
  • Interfere with the operation of ToyRental.ca.
  • Use ToyRental.ca to violate another person’s privacy, intellectual property rights, or legal rights.
  • Post another person’s personal information without permission.
  • Encourage another user to violate these Terms.

ToyRental.ca may remove any listing, restrict any content, suspend any account, or report conduct to authorities where we believe it is appropriate.

18. Listing Review, Moderation, and Removal

ToyRental.ca may review, moderate, edit, hide, reject, remove, suspend, or disable any listing, content, message, account, review, profile, or platform activity at any time.

ToyRental.ca may take action for any reason, including where we believe content or conduct:

  • Violates these Terms.
  • Violates another ToyRental.ca policy.
  • Creates legal, safety, financial, reputational, technical, or operational risk.
  • May be false, misleading, unsafe, unlawful, abusive, fraudulent, or inappropriate.
  • May harm ToyRental.ca, another user, or the public.

ToyRental.ca is not required to pre-screen listings or content. The fact that a listing appears on ToyRental.ca does not mean ToyRental.ca has reviewed, approved, inspected, endorsed, verified, insured, certified, or guaranteed the listing, item, host, renter, or rental.

19. User Content

Users are responsible for all content they submit, upload, post, send, or display on ToyRental.ca.

By submitting content, you represent and warrant that:

  • You own the content or have the right to use and share it.
  • The content is accurate and not misleading.
  • The content does not violate any law.
  • The content does not violate another person’s privacy, publicity, intellectual property, contractual, or other rights.
  • The content does not contain unlawful, abusive, threatening, defamatory, obscene, hateful, discriminatory, fraudulent, or harmful material.

By submitting content to ToyRental.ca, you grant ToyRental.ca a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to host, store, reproduce, display, publish, modify, resize, crop, format, distribute, promote, and otherwise use the content for the purpose of operating, improving, protecting, advertising, and promoting ToyRental.ca.

You understand that your listings, photos, descriptions, prices, general location, profile details, ratings, and reviews may be visible to other users and may be visible publicly.

ToyRental.ca may remove or restrict content at any time, but ToyRental.ca is not obligated to do so.

20. Photos, Images, and Listing Media

Hosts are responsible for all photos and media uploaded to listings.

Listing photos must accurately show the item being offered. Users may not upload photos they do not have permission to use. Users may not upload misleading stock images, unrelated photos, stolen photos, or photos that misrepresent the item.

ToyRental.ca may resize, crop, compress, watermark, reorder, remove, or moderate listing media.

21. Messaging Between Users

ToyRental.ca may provide messaging tools to allow users to communicate about listings and rentals.

Users are solely responsible for their messages and communications.

ToyRental.ca may access, store, review, moderate, or use messages for support, safety, security, dispute review, fraud prevention, legal compliance, policy enforcement, and platform operation.

Users must not use messaging to:

  • Harass, threaten, abuse, intimidate, or discriminate against another person.
  • Send spam, scams, phishing attempts, malware, or misleading information.
  • Request or provide illegal goods or services.
  • Share another person’s private information without permission.
  • Send inappropriate, offensive, hateful, or unlawful content.
  • Interfere with ToyRental.ca operations or policies.

Users should use caution when sharing personal information, addresses, phone numbers, payment details, identification, or other sensitive information.

22. Reviews and Ratings

ToyRental.ca may allow users to leave reviews or ratings about listings, hosts, renters, or rental experiences.

Reviews must be honest, relevant, and based on genuine experiences.

Users may not post reviews that are:

  • Fake.
  • Misleading.
  • Paid for or incentivized without disclosure.
  • Retaliatory or abusive.
  • Defamatory.
  • Discriminatory.
  • Threatening.
  • Unrelated to the rental experience.
  • Containing private personal information.
  • Designed to manipulate ratings or search results.

ToyRental.ca may remove, hide, restrict, or edit reviews that violate these Terms or our policies. ToyRental.ca does not guarantee the accuracy, fairness, or completeness of reviews or ratings.

23. Identity, Verification, and Trust

ToyRental.ca may provide account verification, email verification, phone verification, profile tools, rating tools, review tools, or other trust-related features.

These features do not guarantee that a user is honest, safe, reliable, insured, qualified, trained, licensed, or suitable.

ToyRental.ca does not guarantee the identity of any user. Users are responsible for conducting their own due diligence before communicating, meeting, paying, releasing items, accepting items, or entering into rental arrangements.

24. Location, Maps, and Distance Information

ToyRental.ca may use user-provided location information, browser location, IP-based location, approximate coordinates, listing locations, city information, province information, map tools, and distance calculations to show listings and improve search results.

Location and distance information may be approximate and may not be accurate.

Users should not rely on ToyRental.ca location or distance information as a guarantee of address, travel time, availability, pickup location, delivery area, or service area.

Hosts should avoid publicly posting exact addresses unless they are comfortable doing so. Users should use caution when arranging pickup or return locations.

25. Pickup, Delivery, Meetups, and Personal Safety

Users are responsible for their own safety when meeting, picking up items, returning items, delivering items, accepting payments, or exchanging property.

ToyRental.ca does not supervise meetups, pickup, delivery, loading, unloading, transport, operation, storage, or return of items.

Users should use caution, meet in safe locations where appropriate, tell someone where they are going, inspect items carefully, document the exchange, and avoid proceeding with any rental if they feel unsafe or uncomfortable.

ToyRental.ca is not responsible for any assault, theft, robbery, fraud, accident, injury, property damage, unsafe meeting, unsafe location, or other harm arising from a user meeting or exchange.

26. Cancellations, No-Shows, and Failed Rentals

Hosts and renters are responsible for agreeing on cancellation terms directly with each other.

ToyRental.ca is not responsible for cancellations, no-shows, late arrivals, early returns, failed pickups, failed returns, scheduling conflicts, weather problems, changed plans, or unavailable items.

ToyRental.ca may, in its discretion, provide platform support, account review, warnings, restrictions, credits, or other platform-level action, but ToyRental.ca does not guarantee compensation, refunds, recovery, or dispute resolution.

27. Damage, Theft, Loss, Late Return, and Non-Return

Hosts accept the risk that an item may be damaged, lost, stolen, misused, returned late, returned dirty, returned incomplete, or not returned at all.

Renters accept responsibility for the possession, care, custody, control, use, storage, transport, and return of items they rent.

ToyRental.ca is not responsible for recovering items, collecting debts, collecting deposits, enforcing rental agreements, obtaining payment, obtaining repair costs, obtaining replacement costs, filing police reports, filing insurance claims, or pursuing legal action.

Users are responsible for pursuing their own remedies directly with each other, through insurance, law enforcement, civil court, small claims court, collections, or other available processes.

ToyRental.ca may cooperate with lawful requests from law enforcement or legal authorities where required or appropriate.

28. Taxes and Business Responsibilities

Users are responsible for determining whether their rental activity is personal, business, commercial, taxable, licensed, regulated, or otherwise subject to legal obligations.

Hosts are responsible for reporting rental income and collecting, charging, reporting, or remitting any applicable taxes, fees, permits, or charges.

ToyRental.ca does not provide tax, accounting, legal, insurance, or business advice.

Users should obtain professional advice where appropriate.

29. Third-Party Services

ToyRental.ca may use third-party services, including hosting providers, email providers, payment processors, analytics providers, map providers, fraud-prevention tools, database providers, storage providers, security tools, and other service providers.

Third-party services may have their own terms, policies, fees, limitations, and privacy practices.

ToyRental.ca is not responsible for third-party service outages, errors, delays, payment failures, data handling, security incidents, policy changes, fees, or decisions.

If ToyRental.ca uses a third-party payment processor for ToyRental.ca fees, that payment processor may process payment information according to its own terms and privacy policy.

30. Intellectual Property

ToyRental.ca, including its name, branding, logo, design, layout, software, code, database structure, text, graphics, icons, platform features, and original content, is owned by or licensed to ToyRental.ca and is protected by applicable intellectual property laws.

Users may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, scrape, frame, mirror, or create derivative works from ToyRental.ca without written permission, except as permitted by law or necessary for normal platform use.

Users retain ownership of their own content, subject to the licence granted to ToyRental.ca in these Terms.

31. Feedback and Suggestions

If you provide ToyRental.ca with feedback, ideas, suggestions, improvements, bug reports, feature requests, business ideas, or other submissions, you agree that ToyRental.ca may use them without restriction, compensation, credit, or obligation to you.

ToyRental.ca’s collection, use, disclosure, storage, and protection of personal information is described in our Privacy Policy.

By using ToyRental.ca, you agree to the Privacy Policy.

Users should not post or send personal information they do not want shared with other users or used for platform-related purposes.

33. Platform Availability and Changes

ToyRental.ca may be unavailable, interrupted, delayed, insecure, or error-prone from time to time.

ToyRental.ca does not guarantee uninterrupted access, continuous operation, error-free service, successful bookings, rental income, user responses, message delivery, listing visibility, search ranking, data availability, or platform performance.

ToyRental.ca may update, modify, suspend, restrict, replace, discontinue, or remove any feature, service, listing category, account tool, payment tool, messaging tool, review tool, policy, or part of the platform at any time.

34. Account Suspension, Restriction, and Termination

ToyRental.ca may warn, restrict, suspend, disable, or terminate any account or listing at any time, with or without notice, where ToyRental.ca believes it is appropriate.

Reasons may include, without limitation:

  • Violation of these Terms or another ToyRental.ca policy.
  • False, misleading, unsafe, fraudulent, or unlawful listings.
  • Unsafe conduct.
  • Fraud, theft, non-return, damage complaints, payment complaints, or repeated disputes.
  • Harassment, threats, discrimination, abuse, spam, scams, or misuse of messaging.
  • Attempts to bypass platform rules, fees, restrictions, security, or moderation.
  • Legal, safety, security, technical, financial, operational, or reputational risk.
  • Requests from law enforcement, regulators, payment processors, hosting providers, or legal authorities.

ToyRental.ca is not liable for losses resulting from account restriction, suspension, termination, listing removal, or platform enforcement action, to the maximum extent permitted by law.

35. Reporting Problems

Users may report listings, users, messages, reviews, safety concerns, fraud, theft, or policy violations to ToyRental.ca.

ToyRental.ca may review reports and may take action in its discretion. ToyRental.ca does not guarantee that any report will be investigated, that action will be taken, that a user will be removed, that a listing will be removed, that money will be recovered, that an item will be recovered, or that a dispute will be resolved.

Emergencies, crimes, threats, thefts, violence, injuries, accidents, and dangerous situations should be reported to the appropriate emergency services, law enforcement, insurer, legal authority, or professional advisor.

36. Disclaimer of Warranties

ToyRental.ca is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, ToyRental.ca disclaims all warranties, representations, and conditions of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, security, reliability, and error-free operation.

ToyRental.ca does not warrant, represent, or guarantee that:

  • The platform will be secure, uninterrupted, accurate, complete, current, or error-free.
  • Listings will be accurate, lawful, safe, complete, or available.
  • Users will be honest, safe, qualified, licensed, insured, trained, or reliable.
  • Items will be safe, clean, functional, legal, available, suitable, insured, properly maintained, or as described.
  • Rentals will occur or be successful.
  • Messages or emails will be delivered or received.
  • Fees, deposits, refunds, credits, payments, damages, or replacement costs will be paid.
  • Disputes will be resolved.

37. Limitation of Liability

To the maximum extent permitted by law, ToyRental.ca and its owners, operators, directors, officers, employees, contractors, agents, affiliates, service providers, successors, and assigns are not liable for any direct, indirect, incidental, special, consequential, punitive, aggravated, exemplary, economic, or other damages or losses arising from or related to ToyRental.ca, users, listings, items, rentals, rental agreements, payments, deposits, communications, meetings, pickup, delivery, transport, use, operation, storage, return, disputes, or platform activity.

This limitation applies to losses including, without limitation:

  • Theft.
  • Loss of property.
  • Damage to property.
  • Non-return of items.
  • Late return of items.
  • Loss of use.
  • Repair costs.
  • Replacement costs.
  • Lost rental income.
  • Lost profits.
  • Lost business opportunities.
  • Loss of goodwill.
  • Personal injury.
  • Serious injury.
  • Death.
  • Property damage.
  • Vehicle damage.
  • Equipment damage.
  • Trailer damage.
  • Watercraft damage.
  • Accidents.
  • Unsafe use.
  • Improper instruction.
  • Lack of training.
  • Lack of supervision.
  • User misconduct.
  • False listings.
  • Payment disputes.
  • Deposit disputes.
  • Chargebacks.
  • Platform downtime.
  • Data loss.
  • Unauthorized account access.
  • Third-party service failures.
  • Emotional distress or inconvenience.

To the maximum extent permitted by law, ToyRental.ca’s total cumulative liability for any claim or series of related claims will not exceed the greater of:

  • The ToyRental.ca fees actually paid by you to ToyRental.ca in the three months immediately before the event giving rise to the claim; or
  • One hundred Canadian dollars.

Some laws may not allow certain exclusions or limitations of liability. In those cases, ToyRental.ca’s liability is limited to the maximum extent permitted by law.

38. Release of ToyRental.ca

To the maximum extent permitted by law, you release ToyRental.ca and its owners, operators, directors, officers, employees, contractors, agents, affiliates, service providers, successors, and assigns from all claims, demands, damages, losses, liabilities, costs, expenses, actions, causes of action, and disputes arising from or related to:

  • Your listings.
  • Your rental requests.
  • Your rental agreements with other users.
  • Your payments or deposits with other users.
  • Your communications with other users.
  • Your meetings with other users.
  • Your decision to rent, lend, borrow, release, accept, transport, use, operate, store, supervise, or return any item.
  • Any theft, loss, damage, non-return, accident, injury, death, property damage, or dispute involving any user or item.

39. Indemnity

You agree to defend, indemnify, and hold harmless ToyRental.ca and its owners, operators, directors, officers, employees, contractors, agents, affiliates, service providers, successors, and assigns from and against any claims, demands, damages, losses, liabilities, costs, expenses, fines, penalties, settlements, and legal fees arising from or related to:

  • Your use of ToyRental.ca.
  • Your account.
  • Your listings.
  • Your content.
  • Your messages or communications.
  • Your rental agreements.
  • Your rental payments or deposits.
  • Your rental activity.
  • Your items.
  • Your use, misuse, operation, transport, storage, supervision, or return of any item.
  • Your damage to property.
  • Your injury to another person.
  • Your violation of these Terms or another ToyRental.ca policy.
  • Your violation of any law, bylaw, regulation, permit, licence, safety rule, or third-party right.
  • Any dispute between you and another user.
  • Any claim that ToyRental.ca is responsible for your conduct, item, listing, rental, payment, deposit, damage, loss, theft, injury, death, or dispute.

40. Disputes Between Users

ToyRental.ca is not responsible for disputes between users.

Disputes between hosts and renters must be handled directly between those users.

ToyRental.ca may, but is not required to, provide platform records, review complaints, moderate accounts, remove listings, issue warnings, suspend users, terminate users, or take other platform-level action.

ToyRental.ca does not act as a court, arbitrator, mediator, collection agency, insurer, payment guarantor, escrow provider, law enforcement agency, or legal representative for any user.

ToyRental.ca does not guarantee recovery of money, deposits, items, repair costs, replacement costs, income, damages, or losses.

41. Disputes With ToyRental.ca

Before starting any legal claim against ToyRental.ca, you agree to first contact ToyRental.ca and attempt to resolve the issue informally.

Any notice of dispute should include your name, account email, a description of the issue, the outcome you are seeking, and any relevant documents or records.

Nothing in this section prevents ToyRental.ca from seeking urgent court relief where necessary to protect the platform, users, intellectual property, confidential information, safety, security, or legal rights.

42. Governing Law and Jurisdiction

These Terms and your use of ToyRental.ca are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.

Subject to any mandatory rights you may have under applicable law, any dispute involving ToyRental.ca shall be brought in the courts located in Ontario, Canada.

43. No Waiver

ToyRental.ca’s failure to enforce any part of these Terms does not waive ToyRental.ca’s right to enforce that part or any other part later.

44. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining parts will continue in full force and effect.

45. Assignment

You may not assign or transfer your account, rights, or obligations under these Terms without ToyRental.ca’s written permission.

ToyRental.ca may assign or transfer these Terms, the platform, user accounts, listings, data, rights, or obligations in connection with a merger, acquisition, sale, restructuring, financing, transfer of assets, change of control, or operation of law.

46. Changes to These Terms

ToyRental.ca may update these Terms from time to time.

When we update these Terms, we will change the “Last Updated” date at the top of this page.

ToyRental.ca may provide additional notice or require renewed acceptance for material changes.

Your continued use of ToyRental.ca after updated Terms are posted means you accept the updated Terms. If you do not agree with the updated Terms, you must stop using ToyRental.ca.

47. Entire Agreement

These Terms, together with the Privacy Policy, Refund and Credit Policy, Safety and Risk Policy, Community Guidelines, and any other policies posted by ToyRental.ca, form the entire agreement between you and ToyRental.ca regarding your use of the platform.

These Terms replace any prior or current understandings, statements, representations, discussions, or agreements between you and ToyRental.ca regarding the platform.

  • You understand that ToyRental.ca does not collect or manage rental money between hosts and renters.
  • You understand that ToyRental.ca does not provide insurance of any kind.
  • You understand that you use the platform, list items, rent items, meet users, exchange money, release items, accept items, operate items, and return items at your own risk.
