This Marketplace Disclaimer explains the role of ToyRental.ca and the responsibilities of users who list, request, rent, lend, borrow, pick up, deliver, transport, operate, or otherwise use items through the ToyRental.ca platform.

By creating an account, listing an item, requesting a booking, approving a booking, paying a platform fee, communicating through the platform, or otherwise using ToyRental.ca, you acknowledge and agree to this Marketplace Disclaimer, our Terms of Use, our Privacy Policy, and any other policies posted on ToyRental.ca.

Important: ToyRental.ca is a marketplace platform only. ToyRental.ca is not a party to rental agreements between owners and renters. Owners and renters are solely responsible for the rental arrangement, the item, payment of the rental price, deposits, pickup, delivery, return, safety, legality, loss, damage, theft, injury, and any dispute between them.

1. ToyRental.ca Is a Marketplace Only

ToyRental.ca provides an online marketplace where users may post listings, browse available items, send booking requests, communicate after a booking is confirmed, and arrange rentals directly with each other.

ToyRental.ca does not own, inspect, control, possess, rent, sell, supply, maintain, repair, store, deliver, install, operate, or guarantee any item listed on the platform unless expressly stated in writing by ToyRental.ca.

ToyRental.ca is not the owner, renter, lessor, lessee, broker, agent, insurer, guarantor, employer, contractor, partner, joint venturer, carrier, transportation provider, escrow provider, or legal representative of any user.

Any rental arrangement is made directly between the item owner and the renter. ToyRental.ca is not a party to that agreement and does not assume the obligations of either party.


2. Owner and Renter Agreements Are Separate From ToyRental.ca

Owners and renters are responsible for deciding the specific terms of each rental, including but not limited to:

  • the rental price;
  • security deposit requirements;
  • pickup and return times;
  • pickup, delivery, loading, unloading, and transport arrangements;
  • item condition at pickup and return;
  • fuel, battery level, cleaning, maintenance, accessories, attachments, keys, manuals, and parts;
  • late fees, cancellation expectations, damage charges, replacement costs, and cleaning fees;
  • safe operation, proper use, training, supervision, and protective equipment;
  • permits, licences, insurance, age requirements, and legal compliance;
  • what happens if an item is lost, stolen, damaged, seized, unsafe, unavailable, defective, or returned late.

ToyRental.ca may provide tools to help users communicate and organize bookings, but ToyRental.ca does not create, control, enforce, or guarantee the private agreement between the owner and renter.


3. Platform Fees and Rental Payments

ToyRental.ca may charge a platform fee, booking fee, administration fee, service fee, or similar fee for the use of the platform. Unless otherwise stated at checkout, this fee is separate from the rental amount, security deposit, delivery fee, damage deposit, cleaning fee, late fee, or any other amount agreed to between the owner and renter.

Unless ToyRental.ca expressly states otherwise, the rental amount and any deposit are arranged and paid directly between the owner and renter. ToyRental.ca is not responsible for collecting, holding, refunding, enforcing, guaranteeing, or disputing direct owner/renter payments.

Payment of a ToyRental.ca platform fee does not mean ToyRental.ca has inspected the item, approved the item, guaranteed the owner, guaranteed the renter, guaranteed the rental, guaranteed the item’s condition, or accepted responsibility for the rental arrangement.


4. No Insurance, Guarantee, Warranty, or Damage Protection

ToyRental.ca does not provide insurance, damage protection, theft protection, loss protection, liability coverage, roadside assistance, equipment breakdown coverage, legal protection, reimbursement coverage, or any financial guarantee for owners or renters unless expressly stated in writing by ToyRental.ca.

Owners and renters are responsible for determining whether they need their own insurance or other protection before participating in a rental. This may include, depending on the item and situation, personal insurance, business insurance, vehicle insurance, trailer insurance, boat insurance, equipment insurance, liability insurance, property insurance, or other applicable coverage.

ToyRental.ca does not guarantee that an insurance policy will cover any rental, item, use, damage, injury, loss, theft, accident, or claim. Users should contact their own insurance provider and obtain written confirmation where appropriate.


5. Item Condition, Suitability, and Availability

ToyRental.ca does not guarantee that any listing is accurate, complete, current, available, safe, legal, functional, clean, properly maintained, suitable for a specific purpose, or free from defects.

Owners are responsible for ensuring that their listings are accurate and that their items are lawful, safe, clean, complete, available, properly maintained, and suitable for the rental being offered.

Renters are responsible for reviewing the listing, asking questions, inspecting the item before accepting it, confirming the item is suitable for their intended use, and refusing to use any item that appears unsafe, damaged, defective, incomplete, illegal, or unsuitable.

Both parties should take clear photos and/or video of the item, accessories, attachments, fuel level, condition, serial numbers where appropriate, and any visible damage at pickup and return.


6. Safety and Proper Use

Many items listed on ToyRental.ca may involve risk, including but not limited to tools, trailers, vehicles, recreational equipment, party equipment, lawn equipment, construction equipment, watercraft, machinery, electrical equipment, children’s items, and heavy or moving objects.

Users are solely responsible for safe handling, transport, setup, supervision, operation, storage, and return of rented items.

Renters must not use an item unless they have the required knowledge, ability, training, licence, supervision, protective equipment, and legal authority to use it safely and lawfully.

Owners should provide reasonable instructions, warnings, manuals, limitations, and safety information where appropriate. However, ToyRental.ca does not verify that instructions are complete, accurate, sufficient, or followed.

Users must not use any item in a careless, reckless, unlawful, impaired, unsafe, abusive, overloaded, modified, or prohibited manner.

Safety notice: If an item appears unsafe, damaged, defective, unstable, overloaded, improperly installed, missing parts, missing safety guards, or otherwise dangerous, do not use it. Stop use immediately and communicate with the other party. In an emergency, contact emergency services.

7. Legal Compliance, Licences, Permits, and Age Requirements

Users are solely responsible for complying with all applicable laws, bylaws, regulations, permits, licences, rules, safety standards, manufacturer instructions, insurance requirements, and contractual obligations that apply to the listing, rental, possession, transport, delivery, operation, storage, and return of any item.

Some items may require a licence, permit, certification, training, minimum age, insurance, registration, inspection, safety equipment, or other legal requirement. ToyRental.ca does not verify that a user has met those requirements.

Users must not list, request, rent, provide, transport, or use any item in a way that is illegal, unsafe, prohibited, restricted, stolen, counterfeit, infringing, dangerous, or otherwise unsuitable for the platform.

Users must be legally capable of entering into rental arrangements. ToyRental.ca may restrict access, listings, bookings, payments, or communications where age, identity, safety, legal, or policy concerns exist.


8. Prohibited and Restricted Items

Users must not list or rent items that violate ToyRental.ca policies or applicable law. Prohibited or restricted items may include, without limitation:

  • illegal items or items intended for illegal use;
  • stolen, counterfeit, or unauthorized goods;
  • weapons, ammunition, explosives, or dangerous weapon accessories;
  • hazardous chemicals, toxins, regulated substances, or unsafe materials;
  • items that require special licensing or authorization unless all legal requirements are met;
  • items that are unsafe, recalled, defective, contaminated, or not fit for use;
  • items that infringe intellectual property rights;
  • items that create an unreasonable risk of injury, damage, nuisance, or unlawful activity.

ToyRental.ca may remove listings, restrict accounts, cancel access, or take other action where it believes a listing or user activity may violate law, policy, safety expectations, or platform integrity.


9. Pickup, Delivery, Transport, Loading, and Return

Owners and renters are responsible for arranging pickup, delivery, loading, unloading, transport, storage, and return. ToyRental.ca does not supervise or guarantee these arrangements.

Users are responsible for ensuring that any vehicle, trailer, hitch, straps, tie-downs, ramps, lifting equipment, storage location, operator, driver, and transportation method is lawful, safe, suitable, and properly insured.

Owners and renters should confirm the return deadline, return location, required accessories, cleaning expectations, fuel level, battery charge, packaging, keys, manuals, attachments, and any return inspection process before the item is released.


10. Contact Release and User Communication

ToyRental.ca may restrict or delay the release of contact information until certain booking steps are completed, such as owner approval or payment of a platform fee.

Users agree to communicate respectfully, honestly, and lawfully. Users must not harass, threaten, mislead, defraud, spam, intimidate, impersonate, or pressure other users.

ToyRental.ca may monitor, review, restrict, preserve, or disclose communications where permitted by law and where necessary for safety, support, fraud prevention, dispute review, legal compliance, platform protection, or enforcement of our policies.


11. Damage, Loss, Theft, Late Return, and Disputes

Owners and renters are solely responsible for resolving disputes involving rental payments, deposits, late returns, cleaning, damage, loss, theft, missing parts, missing accessories, unsafe use, misuse, cancellation, no-shows, item condition, injury, property damage, or any other issue arising from a rental.

ToyRental.ca may provide support tools, communication records, timestamps, booking records, or administrative review where appropriate, but ToyRental.ca is not required to investigate, mediate, adjudicate, enforce, reimburse, compensate, or resolve disputes between users.

Any support review by ToyRental.ca is discretionary and does not make ToyRental.ca a party to the rental agreement. ToyRental.ca may decline to take action where evidence is insufficient, the dispute is outside the platform’s role, or the matter should be handled directly between users, insurers, payment providers, law enforcement, courts, tribunals, or other appropriate authorities.


12. Refund Reviews

ToyRental.ca may allow users to request review of certain platform fees or platform-related charges. A refund request does not guarantee a refund.

ToyRental.ca may approve, reject, partially approve, escalate, or require additional information for refund requests at its discretion, subject to applicable law and the terms presented at the time of payment.

Refunds, where approved and processed, are generally returned to the original payment method. Banks, card issuers, and payment processors may take additional time to display the refund.

ToyRental.ca is not responsible for refunding direct rental payments, deposits, cash payments, e-transfers, off-platform payments, or other amounts exchanged directly between owners and renters unless ToyRental.ca expressly collected and agreed to refund those amounts.


13. No Background Checks or Identity Guarantee

ToyRental.ca may provide account features such as email verification, phone verification, profile information, reviews, ratings, booking history, or other trust indicators. These features are provided for convenience only.

Unless expressly stated, ToyRental.ca does not guarantee the identity, background, honesty, reliability, financial ability, insurance coverage, skill, training, licensing, safety, legality, or suitability of any user.

Users are responsible for using their own judgment before meeting, releasing an item, accepting an item, making payment, collecting a deposit, or entering into a rental arrangement.


14. Reviews, Ratings, and User Content

Reviews, ratings, listings, messages, descriptions, photos, prices, availability, user profiles, and other user content are created by users and may not be verified by ToyRental.ca.

ToyRental.ca does not guarantee that user content is accurate, complete, current, lawful, or reliable. ToyRental.ca may remove, edit, limit, hide, or moderate user content where it believes action is appropriate.


15. Taxes and Business Obligations

Users are responsible for determining and complying with any tax, reporting, licensing, registration, business, consumer protection, safety, or other obligations that may apply to their rental activity.

ToyRental.ca does not provide tax, accounting, legal, insurance, or professional advice. Users should obtain advice from qualified professionals where appropriate.


16. Platform Availability and Changes

ToyRental.ca may modify, suspend, restrict, interrupt, or discontinue any part of the platform at any time, including listings, booking tools, messaging, payment features, support features, account access, search features, or policy enforcement tools.

ToyRental.ca does not guarantee uninterrupted access, error-free operation, specific search placement, booking volume, listing performance, rental income, renter interest, owner approval, or successful completion of any rental.


17. Assumption of Risk

Users acknowledge that renting, lending, borrowing, transporting, operating, storing, or using physical items involves risk. These risks may include property damage, financial loss, personal injury, illness, death, theft, legal claims, regulatory issues, insurance denial, third-party claims, and disputes with other users.

Users voluntarily assume the risks associated with their own use of the platform and their own participation in rental arrangements with other users.


18. Limitation of Liability

To the maximum extent permitted by applicable law, ToyRental.ca and its owners, operators, directors, officers, employees, contractors, service providers, and representatives are not liable for any loss, damage, injury, claim, dispute, cost, expense, lost profit, lost opportunity, business interruption, property damage, personal injury, death, theft, fraud, misrepresentation, defective item, unsafe item, illegal use, user conduct, rental disagreement, payment dispute, deposit dispute, insurance denial, or third-party claim arising from or related to a user’s listing, rental, communication, meeting, pickup, delivery, transport, operation, storage, return, or use of an item.

Nothing in this Marketplace Disclaimer is intended to exclude or limit liability that cannot be excluded or limited under applicable law.


19. User Responsibility to Protect Themselves

ToyRental.ca encourages users to take reasonable precautions, including:

  • reviewing profiles, ratings, listings, photos, and descriptions carefully;
  • asking questions before approving or accepting a rental;
  • confirming total costs, deposits, delivery fees, and payment method in writing;
  • confirming pickup and return times in writing;
  • inspecting the item before use and before return;
  • taking photos and/or videos at pickup and return;
  • checking safety features, accessories, manuals, parts, and attachments;
  • using proper protective equipment;
  • confirming licences, permits, training, insurance, and legal requirements;
  • meeting in safe locations where appropriate;
  • not proceeding with a rental that feels unsafe, suspicious, unlawful, or unclear.

20. Relationship to Other ToyRental.ca Policies

This Marketplace Disclaimer is part of the policies that govern use of ToyRental.ca. It should be read together with our Terms of Use, Privacy Policy, and any other policies, checkout terms, support rules, listing rules, or safety notices posted on the platform.

If there is a conflict between this Marketplace Disclaimer and the Terms of Use, the Terms of Use will apply to the extent of the conflict, unless otherwise required by applicable law.

Summary: ToyRental.ca helps owners and renters connect. ToyRental.ca does not own the listed items, does not inspect or guarantee them, does not provide insurance, and is not a party to the rental agreement. Owners and renters are responsible for their own agreements, payments, deposits, safety, legal compliance, damage, loss, theft, and disputes.
