1. Introduction

This Refund and Credit Policy explains how ToyRental.ca handles refund requests, platform credits, failed bookings, cancelled rentals, user disputes, payment errors, and other payment-related issues involving ToyRental.ca fees.

This policy applies to ToyRental.ca platform fees, booking fees, connection fees, administrative fees, listing fees, featured listing fees, subscription fees, advertising fees, promotional fees, and any other fees charged directly by ToyRental.ca.

This policy does not apply to rental money paid directly between users. Rental payments, deposits, damage deposits, security deposits, delivery fees, pickup fees, late fees, cleaning fees, repair charges, replacement charges, cancellation charges, or any other money exchanged directly between a host and renter are the sole responsibility of those users.

By creating an account, posting a listing, requesting a rental, approving a rental, paying a ToyRental.ca fee, or otherwise using ToyRental.ca, you agree to this Refund and Credit Policy.

2. Important Summary

ToyRental.ca is an online advertising, listing, communication, booking request, and connection platform. ToyRental.ca is not a rental company, insurer, escrow provider, payment holder, collection agency, court, arbitrator, mediator, guarantor, or party to rental agreements between users.

ToyRental.ca does not collect, hold, manage, process, release, guarantee, or refund rental money between hosts and renters.

ToyRental.ca fees are separate from rental money between users. ToyRental.ca fees are charged for platform-related services, including access to booking tools, connection features, messaging access, administrative processing, listing tools, account tools, advertising tools, and other platform features.

Refunds from ToyRental.ca are limited and are not guaranteed. In most situations, if ToyRental.ca decides that a remedy is appropriate, the remedy will be a ToyRental.ca credit rather than a cash refund.

Cash refunds are generally reserved for rare circumstances, payment errors, duplicate charges, technical errors, situations where ToyRental.ca determines a cash refund is appropriate, or situations where a refund is required by applicable law.

3. Definitions

For the purpose of this policy:

  • “ToyRental.ca Fee” means any fee charged directly by ToyRental.ca, including a platform fee, booking fee, connection fee, administrative fee, listing fee, featured listing fee, subscription fee, advertising fee, promotional fee, or other platform-related fee.
  • “Rental Money” means any money paid or allegedly owed between a host and renter, including rental charges, deposits, damage deposits, security deposits, late fees, delivery fees, pickup fees, cleaning fees, fuel charges, repair costs, replacement costs, cancellation charges, or other rental-related amounts.
  • “Host” means a user who posts, owns, controls, manages, approves, or offers an item for rent.
  • “Renter” means a user who browses, requests, reserves, rents, uses, receives, transports, possesses, or returns an item listed by a host.
  • “Credit” means a ToyRental.ca platform credit that may be applied toward future eligible ToyRental.ca fees, subject to this policy and any additional credit terms shown at the time the credit is issued.
  • “Refund” means a return of money paid directly to ToyRental.ca for a ToyRental.ca fee.
  • “Booking Request” means a request made through ToyRental.ca by a renter to rent an item from a host.
  • “Approved Booking” means a booking request that has been accepted, approved, or confirmed by a host through the platform.
  • “Platform Service” means the online services ToyRental.ca provides, including listing tools, search tools, booking request tools, messaging tools, connection tools, account tools, administrative tools, review tools, and related website functionality.

4. ToyRental.ca Fees Are Separate From Rental Money

ToyRental.ca fees are not rental payments to hosts.

ToyRental.ca fees are not damage deposits, security deposits, insurance premiums, protection plans, escrow payments, payment guarantees, compensation funds, or money held for the benefit of a host or renter.

A ToyRental.ca fee may be charged for platform-related services, including:

  • Submitting or processing a booking request.
  • Connecting a renter with a host.
  • Unlocking or enabling platform messaging features.
  • Providing account, listing, booking, and administrative tools.
  • Maintaining booking records within the platform.
  • Providing listing visibility or promotional tools.
  • Providing access to platform features connected to a rental request.
  • Operating, maintaining, supporting, and improving the platform.

A ToyRental.ca fee does not guarantee that a rental will occur, that a host will release an item, that a renter will appear, that an item will be available, that an item will be safe, that an item will match its description, that a user will pay rental money, that a deposit will be returned, or that a dispute will be resolved.

5. Rental Payments Between Users Are Not ToyRental.ca Refunds

Hosts and renters handle rental money directly with each other.

ToyRental.ca does not collect, receive, hold, manage, release, refund, or guarantee rental money between users.

If a renter pays a host directly, any request for a refund of that rental payment must be made directly to the host.

If a host collects a deposit, damage deposit, security deposit, or other rental-related amount directly from a renter, any dispute about that money must be handled directly between the host and renter.

ToyRental.ca is not responsible for recovering or refunding rental money, deposits, damage deposits, security deposits, repair charges, replacement charges, late fees, cleaning fees, delivery fees, pickup fees, or any other user-to-user payment.

6. General Refund Position

ToyRental.ca refunds are limited.

In most cases, ToyRental.ca fees are non-refundable once the platform service connected to the fee has been made available, performed, processed, activated, used, or partially used.

Where ToyRental.ca decides that a remedy is appropriate, ToyRental.ca will usually issue a platform credit instead of a cash refund.

Cash refunds may be considered in rare circumstances, at ToyRental.ca’s discretion, or where required by applicable law.

Nothing in this policy limits, excludes, or reduces any non-waivable legal rights that a user may have under applicable consumer protection, payment, or other laws.

7. Platform Credits Are the Normal Remedy

If ToyRental.ca determines that a user should receive a remedy for a platform-related issue, the normal remedy will be a ToyRental.ca credit.

A credit may be issued for reasons such as:

  • A platform technical issue that materially affected the booking request process.
  • A duplicate platform fee charge that ToyRental.ca decides should be handled as a credit.
  • A booking request issue where ToyRental.ca decides a goodwill credit is appropriate.
  • A support issue where ToyRental.ca decides a credit is appropriate.
  • A promotional adjustment.
  • A customer service adjustment.
  • Any other situation where ToyRental.ca decides, in its discretion, that a credit is appropriate.

A credit is not an admission of fault, liability, wrongdoing, breach of contract, legal responsibility, or platform error by ToyRental.ca.

8. Credit Rules

Unless ToyRental.ca states otherwise in writing when issuing a credit, all credits are subject to the following rules:

  • Credits have no cash value.
  • Credits are not cash refunds.
  • Credits are not transferable.
  • Credits may only be used by the account to which they are issued.
  • Credits may only be used on ToyRental.ca.
  • Credits may only be applied toward eligible ToyRental.ca fees.
  • Credits cannot be exchanged for cash.
  • Credits cannot be sold, assigned, gifted, traded, or transferred.
  • Credits cannot be used to pay rental money directly to a host.
  • Credits cannot be used as a damage deposit, security deposit, or insurance payment.
  • Credits may expire.
  • Credits may be subject to additional limits shown at the time of issue.
  • Credits may be reduced, cancelled, revoked, or corrected if issued by mistake, fraud, abuse, chargeback, account misuse, or policy violation.

Unless a different expiry period is stated when the credit is issued, credits expire twelve months after the date they are issued.

If an account is suspended, restricted, or terminated for violation of ToyRental.ca policies, any unused credits may be cancelled, unless prohibited by applicable law.

9. When a Cash Refund May Be Considered

ToyRental.ca may consider a cash refund in limited circumstances, including:

  • A proven duplicate charge for the same ToyRental.ca fee.
  • A ToyRental.ca fee charged because of a clear platform payment processing error.
  • A ToyRental.ca fee charged to the wrong account because of a verified platform error.
  • A ToyRental.ca fee charged after ToyRental.ca cancelled or disabled the applicable platform service before it was made available.
  • A ToyRental.ca fee charged for a platform service that ToyRental.ca confirms was not provided at all.
  • An unauthorized charge that ToyRental.ca confirms was not caused by the user, the user’s account access, the user’s device, or the user’s failure to protect login information.
  • A situation where ToyRental.ca determines, in its sole discretion, that a cash refund is appropriate.
  • A situation where a refund is required by applicable law.

ToyRental.ca may require information, documents, screenshots, payment records, account records, bank records, email confirmations, booking details, or other evidence before reviewing or approving a refund request.

Approval of a refund in one situation does not require ToyRental.ca to approve a refund in any other situation.

10. Issues That Usually Do Not Qualify for a Cash Refund

ToyRental.ca generally does not issue cash refunds for issues arising from the rental arrangement between users.

Unless required by applicable law, the following usually do not qualify for a cash refund from ToyRental.ca:

  • A host cancelling the rental.
  • A renter cancelling the rental.
  • A host declining a rental request.
  • A renter changing their mind.
  • A host changing their mind.
  • A host not showing up.
  • A renter not showing up.
  • A host being late.
  • A renter being late.
  • Bad weather.
  • Road closures, traffic, travel delays, or transportation problems.
  • A renter no longer needing the item.
  • A renter finding another rental elsewhere.
  • A host renting the item to someone else outside the platform.
  • A host forgetting to update availability.
  • A host failing to respond after approval.
  • A renter failing to respond after approval.
  • A disagreement over rental price, deposit, damage deposit, late fee, cleaning fee, delivery fee, pickup fee, or replacement cost.
  • A disagreement over payment made directly between users.
  • A host refusing to return a deposit.
  • A renter refusing to pay a host.
  • An item not being as described by the host.
  • An item being unavailable.
  • An item being damaged, dirty, defective, unsafe, incomplete, unsuitable, or not working.
  • An item not meeting the renter’s expectations.
  • An item not being suitable for the renter’s intended use.
  • A renter not knowing how to operate the item.
  • A renter using the item improperly.
  • A host failing to provide instructions.
  • A host providing incorrect or incomplete instructions.
  • Injury, death, property damage, accident, unsafe use, misuse, or negligence.
  • Damage to the item.
  • Theft of the item.
  • Loss of the item.
  • Late return of the item.
  • Non-return of the item.
  • Missing parts, missing accessories, missing keys, missing cords, missing chargers, or missing attachments.
  • A user being dissatisfied with another user.
  • A negative rental experience between users.
  • A user failing to read the listing, booking details, messages, price, rules, or policies.
  • A user entering the wrong dates, times, location, or information.
  • A user creating duplicate booking requests by mistake.
  • A user’s account being suspended, restricted, or terminated for violating ToyRental.ca policies.
  • A listing being removed for violating ToyRental.ca policies.
  • A user choosing to complete payment or rental arrangements outside ToyRental.ca.
  • A user failing to inspect the item before accepting it.
  • A user failing to document item condition before or after the rental.
  • A user failing to obtain insurance, permits, licences, training, safety equipment, or written agreements.

ToyRental.ca may still review any situation and may decide to issue a credit, partial credit, goodwill adjustment, warning, account restriction, listing removal, or other platform action.

11. Host Cancellation

If a host cancels, refuses to proceed, fails to release an item, or fails to meet the renter, the renter must resolve any rental money or deposit issue directly with the host.

ToyRental.ca is not responsible for host cancellations, host no-shows, host delays, host mistakes, host misrepresentations, or host refusal to release an item.

ToyRental.ca may, in its discretion, review the situation and may issue a ToyRental.ca credit where appropriate.

Repeated host cancellations, no-shows, or unreliable conduct may result in warnings, listing removal, reduced visibility, account restrictions, suspension, or termination.

12. Renter Cancellation

If a renter cancels, changes their mind, fails to appear, arrives late, refuses the item, or does not complete the rental, the renter must resolve any rental money or deposit issue directly with the host.

ToyRental.ca is not responsible for renter cancellations, renter no-shows, renter delays, renter mistakes, renter payment disputes, or renter refusal to proceed.

ToyRental.ca fees are generally not refundable because a renter cancels, changes their mind, finds another item, no longer needs the item, or fails to complete the rental.

ToyRental.ca may, in its discretion, review the situation and may issue a ToyRental.ca credit where appropriate.

13. Host Declines a Booking Request

If a renter submits a booking request and the host declines the request before the renter pays a ToyRental.ca fee, no ToyRental.ca refund is required because no ToyRental.ca fee has been paid.

If ToyRental.ca charges a fee before host approval in a future version of the platform, ToyRental.ca will determine whether the fee is refundable, credited, automatically reversed, or handled in another way based on the checkout terms shown at the time of payment and applicable law.

ToyRental.ca may design its booking flow so that ToyRental.ca fees are only charged after host approval. In that case, a declined request will normally not create a ToyRental.ca refund issue.

14. Expired Booking Requests

A booking request may expire if a host does not respond within the platform’s response period or if the requested rental time passes.

If no ToyRental.ca fee was paid, no refund is owed.

If a ToyRental.ca fee was paid and ToyRental.ca determines that the platform service was not provided or the fee was charged in error, ToyRental.ca may issue a credit, refund, reversal, or other remedy in accordance with this policy and applicable law.

15. Failed Checkout, Cancelled Checkout, and Expired Checkout

If a user begins checkout but does not complete payment, no ToyRental.ca fee should be charged.

If a checkout session expires or is cancelled before payment is completed, no ToyRental.ca refund is required because no completed ToyRental.ca payment occurred.

If a user believes they were charged despite a failed, cancelled, or expired checkout, the user should contact ToyRental.ca support with payment records so the issue can be reviewed.

16. Duplicate Charges

If a user believes they were charged twice for the same ToyRental.ca fee, they should contact ToyRental.ca support as soon as possible.

ToyRental.ca may ask for:

  • The account email address.
  • The booking number or booking reference.
  • The payment date.
  • The amount charged.
  • The payment processor receipt.
  • A screenshot or copy of the bank or card record showing the duplicate charge.
  • Any other information reasonably needed to investigate.

If ToyRental.ca confirms a duplicate ToyRental.ca charge, ToyRental.ca may reverse, refund, or credit the duplicate charge, subject to payment processor rules and applicable law.

17. Unauthorized Charges

If a user believes a ToyRental.ca fee was charged without authorization, the user should contact ToyRental.ca support immediately.

ToyRental.ca may investigate account activity, login records, booking records, device information, payment processor records, messages, and related information.

ToyRental.ca may deny a refund request if the charge resulted from the user’s account activity, shared login information, failure to protect account credentials, authorized use by someone with access to the account or device, or other circumstances showing that the charge was not caused by ToyRental.ca error.

Nothing in this section limits any non-waivable rights the user may have under applicable law or payment network rules.

18. Technical Errors

If a technical issue on ToyRental.ca materially affects a ToyRental.ca fee, booking request, checkout process, account feature, or platform service, ToyRental.ca may review the issue.

If ToyRental.ca determines that a platform technical error caused an incorrect ToyRental.ca fee, a duplicate charge, a failed service, or a materially unfair result, ToyRental.ca may issue a credit, refund, reversal, correction, or other remedy.

ToyRental.ca is not responsible for technical issues caused by user devices, user internet connection, user browser settings, third-party apps, email spam filters, bank systems, payment card issuers, payment processor outages, map provider errors, hosting provider outages, or other third-party services outside ToyRental.ca’s reasonable control.

19. Item Condition, Item Safety, and Item Performance

ToyRental.ca does not own, inspect, test, certify, insure, maintain, repair, supervise, deliver, or control items listed by users.

A renter’s dissatisfaction with an item, including concerns about condition, safety, cleanliness, performance, missing parts, defects, instructions, suitability, or availability, is a dispute between the renter and host.

ToyRental.ca generally does not issue cash refunds of ToyRental.ca fees because an item:

  • Was not as described.
  • Was unavailable.
  • Was dirty.
  • Was damaged.
  • Was defective.
  • Did not work.
  • Was unsafe.
  • Was missing parts or accessories.
  • Was difficult to use.
  • Was not suitable for the renter’s intended use.
  • Was not properly explained by the host.
  • Did not meet the renter’s expectations.

ToyRental.ca may still take platform-level action against a host or listing where ToyRental.ca receives credible reports of unsafe, misleading, fraudulent, unlawful, or repeated problematic listings.

20. Injury, Death, Damage, Theft, Loss, and Non-Return

ToyRental.ca does not provide insurance and does not compensate users for injury, death, property damage, theft, loss, non-return, late return, repair costs, replacement costs, lost income, lost business, lost opportunity, or other losses arising from a rental.

ToyRental.ca fees are not insurance, protection plans, damage deposits, security deposits, guarantees, or compensation funds.

Hosts accept the risk that items may be damaged, stolen, lost, misused, returned late, returned dirty, returned incomplete, or not returned at all.

Renters accept the risk that items may be unsafe, defective, unsuitable, unavailable, misdescribed, or not as expected.

Claims involving injury, death, property damage, theft, loss, non-return, damage, accidents, unsafe use, misuse, negligence, or criminal conduct should be handled directly between users, insurers, legal advisors, law enforcement, courts, or other appropriate authorities.

21. Disputes Between Hosts and Renters

ToyRental.ca is not responsible for resolving disputes between hosts and renters.

User disputes may include, without limitation:

  • Disputes about payment.
  • Disputes about deposits.
  • Disputes about damage.
  • Disputes about cleaning.
  • Disputes about late return.
  • Disputes about missing parts.
  • Disputes about item condition.
  • Disputes about item safety.
  • Disputes about item performance.
  • Disputes about cancellations.
  • Disputes about no-shows.
  • Disputes about pickup or return.
  • Disputes about delivery.
  • Disputes about instructions.
  • Disputes about insurance.
  • Disputes about licences or permits.
  • Disputes about personal injury or property damage.

ToyRental.ca may review a dispute for platform safety, fraud prevention, policy enforcement, account moderation, listing moderation, or support purposes. However, ToyRental.ca does not guarantee that it will investigate, mediate, decide, resolve, compensate, refund, credit, or take action on any dispute.

ToyRental.ca does not act as a court, arbitrator, mediator, collection agency, insurer, payment guarantor, escrow agent, law enforcement agency, or legal representative.

22. Chargebacks and Payment Disputes

If a user has a concern about a ToyRental.ca fee, the user should contact ToyRental.ca support before starting a chargeback or payment dispute.

ToyRental.ca may dispute chargebacks where ToyRental.ca believes the charge was authorized, valid, disclosed, correctly processed, or connected to platform services that were made available.

A chargeback or payment dispute may result in:

  • Temporary account restriction.
  • Suspension of booking features.
  • Suspension of messaging features.
  • Cancellation of credits.
  • Review of account activity.
  • Collection of unpaid ToyRental.ca fees where permitted by law.
  • Permanent account termination for fraud, abuse, repeated disputes, or policy violations.

ToyRental.ca will not restrict a user solely for exercising a legal right that cannot be waived.

23. Promotions, Discounts, Coupons, and Free Credits

ToyRental.ca may offer promotions, discounts, coupons, referral credits, launch credits, goodwill credits, advertising credits, or other incentives.

Unless ToyRental.ca states otherwise in writing, promotional credits and discounts:

  • Have no cash value.
  • Are not refundable.
  • Are not transferable.
  • May expire.
  • May be limited to one account, one user, one booking, one listing, one category, one city, one region, or one promotional period.
  • May not be combined with other promotions unless ToyRental.ca allows it.
  • May be changed, suspended, revoked, or cancelled at any time.
  • May be revoked if ToyRental.ca suspects fraud, abuse, self-dealing, fake accounts, duplicate accounts, manipulation, or policy violations.

If a user receives a discount or credit and the related transaction is cancelled, reversed, refunded, disputed, or found to be abusive, ToyRental.ca may cancel or reverse the discount or credit.

24. Featured Listings, Advertising, and Promotional Fees

ToyRental.ca may offer paid featured listings, promoted listings, advertising placements, category boosts, homepage placements, search boosts, or other visibility-related services.

Unless stated otherwise at the time of purchase, fees for featured listings, promoted listings, advertising placements, category boosts, homepage placements, search boosts, or similar promotional tools are generally non-refundable once the promotion has started, been scheduled, been displayed, been activated, or been made available.

ToyRental.ca does not guarantee clicks, views, impressions, messages, booking requests, approvals, rentals, income, ranking, conversion, or results from any promotional feature.

If a promoted listing is removed because the user violated ToyRental.ca policies, the promotional fee is generally not refundable.

If ToyRental.ca removes a promoted listing without user fault before the promotional service begins or before a material portion of the promotional service is delivered, ToyRental.ca may issue a credit, refund, extension, replacement promotion, or other adjustment in its discretion and subject to applicable law.

25. Subscription Fees

ToyRental.ca may offer subscription plans in the future.

If subscriptions are offered, the subscription terms shown at the time of purchase will explain the subscription price, billing period, renewal terms, cancellation method, included features, and any refund or credit terms.

Unless stated otherwise at the time of purchase or required by law, subscription fees are generally non-refundable once a billing period begins.

Cancelling a subscription generally stops future renewal charges but does not automatically refund charges for the current billing period unless ToyRental.ca states otherwise or applicable law requires otherwise.

26. Taxes and Payment Processor Fees

ToyRental.ca fees may be subject to applicable taxes.

If a refund is approved, the refund may include or exclude taxes depending on the nature of the refund, the original charge, payment processor rules, tax rules, and applicable law.

Payment processor fees, bank fees, currency conversion fees, foreign transaction fees, card issuer fees, overdraft fees, insufficient funds fees, or other third-party fees may not be refundable by ToyRental.ca.

ToyRental.ca is not responsible for fees charged by banks, card issuers, payment processors, mobile wallets, financial institutions, or other third parties.

27. Currency

Unless otherwise stated, ToyRental.ca fees are charged in Canadian dollars.

If a payment method or financial institution converts currency, the user is responsible for any exchange rate, conversion fee, foreign transaction fee, or difference between the charged amount and any refunded amount caused by currency conversion.

28. Refund Request Deadline

To help ToyRental.ca review issues efficiently, users should submit refund or credit requests as soon as possible and preferably within fourteen days after the ToyRental.ca fee was charged or the issue occurred.

Late requests may be denied if ToyRental.ca cannot reasonably verify the issue, if records are unavailable, if the platform service was already used, if the request appears stale, or if the delay prejudices ToyRental.ca’s ability to investigate.

Nothing in this section limits any refund, cancellation, or dispute right that cannot be waived under applicable law.

29. How to Request a Refund or Credit

To request a refund or credit, contact ToyRental.ca support using the support method provided on the platform.

A request should include:

  • Your full name.
  • Your account email address.
  • The booking number or reference number, if applicable.
  • The listing title, if applicable.
  • The date of the charge.
  • The amount charged.
  • A copy or screenshot of the ToyRental.ca receipt, if available.
  • A clear explanation of the issue.
  • Any relevant screenshots, messages, payment records, bank records, or supporting documents.
  • The remedy you are requesting.

ToyRental.ca may request additional information before reviewing or deciding the request.

Failure to provide requested information may result in the request being delayed or denied.

30. Review Process

ToyRental.ca may review refund and credit requests using available information, including:

  • Account records.
  • Booking records.
  • Payment records.
  • Checkout records.
  • Platform logs.
  • Listing records.
  • Messages sent through ToyRental.ca.
  • Support messages.
  • User reports.
  • Technical error reports.
  • Payment processor records.
  • Fraud, abuse, or policy violation indicators.

ToyRental.ca may approve, partially approve, deny, or request more information about a refund or credit request.

ToyRental.ca’s decision is final, subject to applicable law.

31. Refund Method

If ToyRental.ca approves a cash refund, the refund will usually be issued to the original payment method used for the ToyRental.ca fee.

ToyRental.ca may not be able to refund to a different payment method.

If the original payment method is closed, expired, unavailable, or unable to receive the refund, ToyRental.ca may require additional information or may issue a credit instead, where permitted by law.

Refund processing times may depend on the payment processor, card issuer, bank, financial institution, or third-party payment provider.

32. Partial Refunds and Partial Credits

ToyRental.ca may issue partial refunds or partial credits where ToyRental.ca determines that a full refund or full credit is not appropriate.

ToyRental.ca may consider factors such as:

  • Whether the platform service was fully or partially provided.
  • Whether the user used any platform features.
  • Whether the issue was caused by ToyRental.ca, the user, another user, or a third party.
  • Whether the request was submitted promptly.
  • Whether the user provided enough information.
  • Whether the user violated ToyRental.ca policies.
  • Whether a credit would be a more appropriate remedy.
  • Whether applicable law requires a different result.

33. Abuse, Fraud, and Misuse

ToyRental.ca may deny refund or credit requests and may restrict, suspend, or terminate accounts if ToyRental.ca believes a user is abusing the refund or credit process.

Abuse may include:

  • False refund claims.
  • False reports about hosts, renters, listings, or payments.
  • Submitting altered screenshots or documents.
  • Creating duplicate accounts to obtain credits.
  • Repeatedly booking and cancelling to obtain credits.
  • Requesting credits for issues caused by the user.
  • Using chargebacks after receiving platform services.
  • Attempting to obtain both a refund and a credit for the same issue.
  • Claiming an unauthorized charge after authorizing account access or payment.
  • Coordinating with another user to manipulate refunds, credits, reviews, bookings, or fees.
  • Any other conduct ToyRental.ca considers fraudulent, abusive, misleading, or unfair.

ToyRental.ca may revoke credits, reverse adjustments, restrict account features, remove listings, suspend accounts, terminate accounts, or take other action where fraud or abuse is suspected.

34. Account Suspension and Refunds

If ToyRental.ca suspends, restricts, or terminates an account because the user violated ToyRental.ca policies, the user is generally not entitled to a refund of ToyRental.ca fees.

Examples include suspension or termination for:

  • Fraud.
  • Unsafe conduct.
  • Harassment.
  • Threats.
  • Spam.
  • Scams.
  • False listings.
  • Misleading listings.
  • Illegal listings.
  • Prohibited items.
  • Payment disputes caused by user misconduct.
  • Repeated cancellations or no-shows.
  • Damage, theft, or non-return complaints.
  • Attempts to bypass ToyRental.ca rules or security.
  • Violation of the Terms of Use or other ToyRental.ca policies.

Nothing in this section limits any refund required by applicable law.

35. Listing Removal and Refunds

If ToyRental.ca removes, hides, disables, or restricts a listing because the listing or user violates ToyRental.ca policies, the user is generally not entitled to a refund of any ToyRental.ca fees related to that listing.

If ToyRental.ca removes or disables a listing without user fault before a paid platform service has been provided, ToyRental.ca may issue a credit, refund, extension, replacement service, or other remedy in its discretion and subject to applicable law.

36. Platform Downtime

ToyRental.ca may be unavailable, interrupted, delayed, or affected by technical issues from time to time.

Temporary platform downtime, maintenance, delays, email delivery issues, search issues, map issues, hosting issues, payment processor issues, or third-party service issues do not automatically qualify for a refund.

ToyRental.ca may issue credits or other adjustments where ToyRental.ca determines that a platform issue materially affected a paid platform service.

37. No Insurance, Guarantee, or Compensation Fund

ToyRental.ca does not provide insurance of any kind.

ToyRental.ca fees do not create insurance, protection coverage, a damage fund, a theft fund, a refund pool, a compensation fund, an escrow arrangement, or a guarantee.

ToyRental.ca does not compensate users for:

  • Theft.
  • Loss.
  • Damage.
  • Non-return.
  • Late return.
  • Injury.
  • Death.
  • Property damage.
  • Lost income.
  • Lost rental opportunities.
  • Lost business.
  • Repair costs.
  • Replacement costs.
  • Legal fees.
  • Insurance deductibles.
  • User misconduct.
  • Unsafe items.
  • Defective items.
  • Failed rentals.

Users are responsible for obtaining their own insurance, written agreements, deposits, safety procedures, and legal remedies.

38. Legal Rights

This policy is intended to apply to the maximum extent permitted by law.

Nothing in this policy is intended to limit, exclude, waive, or reduce any legal right that cannot be limited, excluded, waived, or reduced under applicable law.

If any part of this policy conflicts with a non-waivable legal right, the legal right will apply only to the extent required by law, and the rest of this policy will continue to apply.

39. Changes to This Policy

ToyRental.ca may update this Refund and Credit Policy from time to time.

When we update this policy, we will change the “Last Updated” date at the top of this page.

ToyRental.ca may provide additional notice or require renewed acceptance for material changes.

Your continued use of ToyRental.ca after the updated policy is posted means you accept the updated policy. If you do not agree with the updated policy, you must stop using ToyRental.ca.

  • You understand this Refund and Credit Policy.
  • You agree to this Refund and Credit Policy.
  • You understand that ToyRental.ca fees are separate from rental money between hosts and renters.
  • You understand that ToyRental.ca does not collect, hold, manage, or refund rental money between hosts and renters.
  • You understand that ToyRental.ca does not provide insurance.
  • You understand that ToyRental.ca refunds are limited.
  • You understand that ToyRental.ca credits are usually the normal remedy for platform-related issues.
  • You understand that disputes between hosts and renters must be handled directly between those users.
