1. Introduction

This Rental Agreement Notice explains the relationship between ToyRental.ca, hosts, and renters. It also explains that rental agreements, rental payments, deposits, pickup, return, damage, theft, loss, safety, and disputes are handled directly between the host and renter.

ToyRental.ca is an online advertising, listing, communication, booking request, and connection platform. ToyRental.ca provides tools that allow users to advertise items for rent, discover listings, submit booking requests, approve or decline requests, message each other, and arrange rentals directly with each other.

ToyRental.ca is not a party to the rental agreement between a host and renter.

By posting a listing, requesting a rental, approving a rental, messaging about a rental, paying a ToyRental.ca fee, releasing an item, accepting an item, or proceeding with a rental, you agree to this Rental Agreement Notice.

2. ToyRental.ca Is Not the Rental Provider

ToyRental.ca is not the owner, renter, supplier, lessor, borrower, bailee, broker, agent, insurer, inspector, delivery provider, payment holder, escrow provider, guarantor, mediator, arbitrator, court, employer, partner, or representative of any user.

ToyRental.ca does not own, inspect, test, certify, insure, maintain, repair, deliver, operate, store, supervise, or control any item listed, requested, rented, used, transported, or returned through the platform.

ToyRental.ca does not guarantee that any item exists, is available, is safe, is lawful, is insured, is suitable, is properly maintained, is as described, or will be returned.

3. The Rental Agreement Is Between Host and Renter

Any rental agreement is made directly between the host and the renter.

The host and renter are responsible for deciding whether to proceed with a rental and for agreeing on all rental terms.

ToyRental.ca is not responsible for creating, reviewing, enforcing, interpreting, or guaranteeing the rental agreement between the host and renter.

A booking request, approval, message, platform fee, status update, or contact release on ToyRental.ca does not make ToyRental.ca a party to the rental agreement.

4. Users Should Create Their Own Rental Terms

Hosts and renters should clearly agree on rental terms before money is exchanged or an item is released.

Rental terms may include:

  • The item being rented.
  • The rental start date and time.
  • The rental end date and time.
  • The rental price.
  • The payment method.
  • The deposit amount, if any.
  • Damage deposit or security deposit terms.
  • Pickup location.
  • Return location.
  • Delivery terms, if any.
  • Late return fees, if any.
  • Cleaning requirements.
  • Fuel, battery, charging, accessory, or missing-part requirements.
  • Permitted use.
  • Prohibited use.
  • Safety requirements.
  • Instruction requirements.
  • Supervision requirements.
  • Licence, permit, training, or insurance requirements.
  • Cancellation terms.
  • Weather terms, if relevant.
  • Setup, installation, takedown, loading, unloading, or transport responsibilities.
  • What happens if the item is damaged, lost, stolen, returned late, returned dirty, returned incomplete, or not returned.

ToyRental.ca recommends that users keep written records of important rental terms.

5. Written Agreements Are Recommended

ToyRental.ca recommends that hosts and renters consider using a written rental agreement, especially for higher-value, higher-risk, longer-term, business, event, trailer, tool, equipment, recreational, or child-related rentals.

A written rental agreement may help users document:

  • The parties to the rental.
  • The item being rented.
  • The rental period.
  • The rental price.
  • Payment status.
  • Deposit amount.
  • Condition at pickup.
  • Condition at return.
  • Accessories included.
  • Serial numbers.
  • Replacement value.
  • Damage responsibility.
  • Late return fees.
  • Cleaning rules.
  • Permitted and prohibited uses.
  • Safety requirements.
  • Insurance requirements.
  • Pickup and return details.
  • Signatures or confirmations.

ToyRental.ca does not provide legal advice and does not guarantee that any rental agreement, waiver, checklist, receipt, or form will be valid, enforceable, complete, or suitable for a specific rental.

6. Rental Money Is Between Users

ToyRental.ca does not collect, hold, manage, process, release, guarantee, or refund rental money between hosts and renters.

Rental money includes:

  • Rental payments.
  • Deposits.
  • Damage deposits.
  • Security deposits.
  • Late fees.
  • Cleaning fees.
  • Delivery fees.
  • Pickup fees.
  • Fuel charges.
  • Battery or charging charges.
  • Repair charges.
  • Replacement charges.
  • Cancellation charges.
  • Any other rental-related amount paid directly between users.

Hosts and renters are responsible for deciding how and when rental money is paid.

ToyRental.ca is not responsible for unpaid rental money, fake payment confirmations, reversed payments, chargebacks, cash disputes, e-transfer disputes, deposit disputes, refund disputes, collection issues, or any other user-to-user payment issue.

7. ToyRental.ca Fees Are Separate

ToyRental.ca may charge platform fees, booking fees, connection fees, administrative fees, listing fees, featured listing fees, subscription fees, advertising fees, promotional fees, or other platform-related fees.

ToyRental.ca fees are separate from rental money between hosts and renters.

ToyRental.ca fees are not:

  • Rental payments to the host.
  • Damage deposits.
  • Security deposits.
  • Insurance premiums.
  • Protection plans.
  • Guarantees.
  • Escrow payments.
  • Compensation funds.

ToyRental.ca fees are governed by the Refund and Credit Policy.

8. No Insurance

ToyRental.ca does not provide insurance of any kind.

ToyRental.ca does not insure hosts, renters, listings, items, rental agreements, rental money, deposits, ToyRental.ca fees, damage, theft, loss, late return, non-return, injury, death, property damage, or user disputes.

Hosts and renters are responsible for obtaining their own insurance if they want or need coverage.

Users should contact their own insurance providers before proceeding with a rental.

9. Host Responsibilities in the Rental Agreement

The host is responsible for the item being offered for rent.

The host should make sure the renter understands:

  • What item is being rented.
  • The item’s condition.
  • Known defects or damage.
  • Missing parts or accessories.
  • Safety risks.
  • Required instructions.
  • Required training or experience.
  • Required licence, permit, insurance, or supervision.
  • Pickup and return expectations.
  • Payment and deposit expectations.
  • Damage and late return expectations.
  • Cleaning and return condition expectations.

The host should not release an item if the host believes the rental is unsafe, unlawful, fraudulent, or inappropriate.

10. Renter Responsibilities in the Rental Agreement

The renter is responsible for deciding whether to rent, accept, transport, use, operate, supervise, store, and return the item.

The renter should make sure they understand:

  • The total rental cost.
  • The deposit terms.
  • The rental period.
  • Pickup and return details.
  • How to safely use the item.
  • Known risks, defects, limits, or restrictions.
  • Required licences, permits, training, experience, insurance, or supervision.
  • What happens if the item is damaged, lost, stolen, returned late, returned dirty, returned incomplete, or not returned.

The renter should not accept or use an item if the renter does not understand how to use it safely and lawfully.

11. Inspection Before Pickup or Release

Hosts and renters should inspect the item before the renter accepts it.

The inspection should consider:

  • Visible condition.
  • Existing damage.
  • Cleanliness.
  • Missing parts.
  • Included accessories.
  • Safety features.
  • Warning labels.
  • Operating condition.
  • Fuel, battery, charge, tires, fluids, or other relevant details.
  • Whether the item matches the listing and rental agreement.

If the item appears unsafe, defective, incomplete, damaged, different from what was agreed, or unsuitable, the renter should not accept the item unless the issue is resolved safely and lawfully.

12. Inspection on Return

Hosts and renters should inspect the item when it is returned.

The return inspection should consider:

  • Whether the item was returned on time.
  • Whether the item is clean.
  • Whether the item is complete.
  • Whether parts or accessories are missing.
  • Whether there is new damage.
  • Whether fuel, battery, or other agreed return conditions are met.
  • Whether there is a dispute about condition.

Users should document the return condition with photos, videos, written notes, and messages where appropriate.

13. Photos, Videos, and Records

ToyRental.ca strongly recommends that users document rentals carefully.

Useful records may include:

  • Photos before pickup.
  • Videos before pickup.
  • Photos on return.
  • Videos on return.
  • Serial numbers.
  • Accessory lists.
  • Condition checklists.
  • Payment records.
  • Deposit receipts.
  • Messages confirming terms.
  • Signed agreements, if used.

ToyRental.ca does not guarantee that any records will resolve a dispute, prove fault, recover money, recover property, or establish liability.

14. Damage, Theft, Loss, Late Return, and Non-Return

Hosts and renters should clearly agree on what happens if an item is damaged, lost, stolen, returned late, returned dirty, returned incomplete, or not returned.

ToyRental.ca is not responsible for:

  • Recovering items.
  • Recovering money.
  • Recovering deposits.
  • Collecting repair costs.
  • Collecting replacement costs.
  • Collecting late fees.
  • Deciding who is at fault.
  • Enforcing rental agreements.
  • Filing police reports.
  • Filing insurance claims.
  • Starting legal claims.
  • Resolving disputes.

Users are responsible for handling these issues directly with each other or through insurance, law enforcement, legal advice, small claims court, or other available processes.

15. Cancellations and No-Shows

Hosts and renters are responsible for agreeing on cancellation and no-show terms.

ToyRental.ca is not responsible for host cancellations, renter cancellations, no-shows, late arrivals, scheduling conflicts, bad weather, changed plans, unavailable items, or missed rental opportunities.

ToyRental.ca may take platform action for repeated cancellations, no-shows, unreliable conduct, or policy violations, but ToyRental.ca does not guarantee compensation, refunds, credits, recovery, or dispute resolution.

16. Safety and Proper Use

Hosts and renters are responsible for safety.

The host should disclose safety requirements, provide appropriate instructions, and refuse to release an item if the rental appears unsafe or unlawful.

The renter should not use an item unless the renter understands how to use it safely and lawfully.

Users must follow all laws, manufacturer instructions, warning labels, host instructions, venue rules, licence requirements, permit requirements, safety requirements, and insurance requirements that apply.

ToyRental.ca is not responsible for injury, death, property damage, unsafe use, improper use, improper instruction, lack of training, lack of supervision, defective items, or user negligence.

17. Pickup, Delivery, Loading, and Transport

Hosts and renters should clearly agree on who is responsible for pickup, delivery, loading, unloading, securing, transport, setup, takedown, and return.

Users should not attempt to lift, move, load, tow, transport, assemble, install, or operate an item unless they can do so safely and lawfully.

ToyRental.ca is not responsible for injury, death, property damage, vehicle damage, trailer damage, item damage, improper loading, improper unloading, improper securing, improper towing, failed pickup, failed return, or delivery disputes.

18. User Disputes

ToyRental.ca is not responsible for disputes between hosts and renters.

User disputes may include:

  • Payment disputes.
  • Deposit disputes.
  • Refund disputes.
  • Damage disputes.
  • Theft disputes.
  • Loss disputes.
  • Late return disputes.
  • Missing part disputes.
  • Cleaning disputes.
  • Safety disputes.
  • Condition disputes.
  • Cancellation disputes.
  • No-show disputes.
  • Instruction disputes.
  • Injury or property damage disputes.

ToyRental.ca may review disputes for support, safety, fraud prevention, moderation, or policy enforcement purposes, but ToyRental.ca does not guarantee that it will investigate, mediate, decide, resolve, compensate, refund, credit, recover, or take action on any dispute.

19. ToyRental.ca Records Are Not a Complete Rental Agreement

ToyRental.ca may keep records of listings, messages, booking requests, approvals, declines, payment status for ToyRental.ca fees, reviews, reports, and account activity.

These records may help users understand what happened on the platform, but they are not a complete substitute for a rental agreement between the host and renter.

ToyRental.ca does not guarantee that platform records will prove the full agreement, prove item condition, prove fault, recover money, recover property, or resolve disputes.

20. No Legal, Insurance, Tax, or Safety Advice

ToyRental.ca does not provide legal, insurance, tax, accounting, safety, engineering, mechanical, electrical, medical, or professional advice.

Any checklist, policy, notice, warning, article, tooltip, or platform message provided by ToyRental.ca is general information only and may not apply to your specific rental.

Users are responsible for getting professional advice where appropriate.

21. Reporting Problems

Users may report safety concerns, fraud, theft, damage, non-return, harassment, prohibited items, policy violations, or disputes to ToyRental.ca.

ToyRental.ca may review reports for platform safety, support, fraud prevention, moderation, policy enforcement, or legal compliance.

ToyRental.ca does not guarantee that any report will result in action, compensation, recovery, refund, credit, account removal, listing removal, or dispute resolution.

Emergencies, crimes, threats, thefts, accidents, injuries, dangerous situations, or immediate safety concerns should be reported to emergency services, law enforcement, insurers, legal advisors, or other appropriate authorities.

22. Changes to This Notice

ToyRental.ca may update this Rental Agreement Notice from time to time.

When we update this notice, we will change the “Last Updated” date at the top of this page.

ToyRental.ca may provide additional notice or require renewed acceptance for material changes.

Your continued use of ToyRental.ca after an updated notice is posted means you accept the updated notice. If you do not agree with the updated notice, you must stop using ToyRental.ca.

  • You understand that ToyRental.ca does not provide insurance.
  • You understand that ToyRental.ca is not responsible for theft, loss, damage, late return, non-return, injury, death, property damage, user disputes, or failed rentals.
  • You understand that users should inspect items, document condition, agree on payment and deposit terms, and use written agreements where appropriate.
