Cancellation Policy

1. Introduction

This Cancellation Policy explains how cancellations, declined booking requests, expired booking requests, no-shows, unavailable items, weather issues, changed plans, and failed rentals are handled on ToyRental.ca.

ToyRental.ca is an online advertising, listing, communication, booking request, and connection platform. ToyRental.ca allows users to advertise items for rent and allows other users to discover, request, and arrange rentals directly with those listing owners.

ToyRental.ca is not a rental company, insurer, broker, agent, payment holder, escrow provider, collection agency, mediator, arbitrator, court, or party to rental agreements between users.

By creating an account, posting a listing, requesting a rental, approving a rental, cancelling a rental, paying a ToyRental.ca fee, sending a message, or otherwise using ToyRental.ca, you agree to this Cancellation Policy.

If you do not agree with this Cancellation Policy, do not use ToyRental.ca to post, request, approve, cancel, or arrange rentals.

2. Relationship to Other Policies

This Cancellation Policy should be read together with ToyRental.ca’s:

If this Cancellation Policy conflicts with another ToyRental.ca policy, ToyRental.ca may decide which policy applies based on the circumstances, the fee involved, applicable law, user safety, platform integrity, and the purpose of the policy.

Nothing in this policy limits any legal right that cannot be waived or limited under applicable law.

3. Key Cancellation Summary

The most important cancellation rules are:

  • Rental arrangements are directly between the host and renter.
  • ToyRental.ca is not a party to the rental agreement between users.
  • ToyRental.ca does not collect, hold, manage, release, guarantee, or refund rental money between users.
  • Hosts and renters are responsible for agreeing on their own cancellation terms.
  • A host cancellation does not automatically create a ToyRental.ca cash refund.
  • A renter cancellation does not automatically create a ToyRental.ca cash refund.
  • A no-show does not automatically create a ToyRental.ca cash refund.
  • Bad weather does not automatically create a ToyRental.ca cash refund.
  • Item condition, item availability, or user disputes do not automatically create a ToyRental.ca cash refund.
  • If ToyRental.ca decides a remedy is appropriate, the normal remedy will usually be a ToyRental.ca credit.
  • Cash refunds are limited and are governed by the Refund and Credit Policy.
  • ToyRental.ca may take platform action against users who repeatedly cancel, no-show, mislead, abuse the platform, or create risk.

4. Definitions

For the purpose of this policy:

  • “Host” means a user who lists, owns, controls, manages, approves, releases, delivers, or offers an item for rent.
  • “Renter” means a user who browses, requests, reserves, receives, transports, uses, stores, supervises, or returns an item listed by a host.
  • “Booking Request” means a request submitted by a renter through ToyRental.ca to rent an item from a host.
  • “Approved Booking” means a booking request that has been accepted, approved, or confirmed by a host through ToyRental.ca.
  • “Cancelled Booking” means a booking request or approved booking that does not proceed because a host or renter cancels, refuses to proceed, changes plans, fails to respond, fails to appear, or otherwise does not complete the rental.
  • “Expired Booking Request” means a booking request that expires because the host did not respond within the required time, the requested rental period passed, checkout expired, payment was not completed, or the platform otherwise marked the request expired.
  • “No-Show” means a host or renter does not appear, does not release an item, does not pick up an item, does not return an item, or does not attend the agreed pickup, delivery, or return appointment.
  • “Rental Money” means rental payments, deposits, damage deposits, security deposits, cleaning fees, delivery fees, pickup fees, late fees, fuel charges, repair costs, replacement costs, cancellation charges, or any other rental-related money exchanged directly between host and renter.
  • “ToyRental.ca Fee” means any platform fee, booking fee, connection fee, administrative fee, listing fee, featured listing fee, subscription fee, advertising fee, promotional fee, or other fee charged directly by ToyRental.ca.
  • “Credit” means a ToyRental.ca platform credit that may be applied toward eligible future ToyRental.ca fees, subject to ToyRental.ca policy.

5. Rental Cancellations Are Between Users

Hosts and renters are responsible for agreeing on cancellation terms directly with each other.

ToyRental.ca does not create, control, enforce, or guarantee cancellation terms between users.

Users should discuss and agree on cancellation terms before proceeding with a rental, including:

  • Whether the renter may cancel before pickup.
  • Whether the host may cancel before pickup.
  • Whether any rental money is refundable.
  • Whether any deposit is refundable.
  • Whether any cancellation fee applies.
  • Whether weather affects the rental.
  • Whether illness, emergencies, traffic, delivery issues, or scheduling conflicts affect the rental.
  • Whether an item may be substituted.
  • Whether the rental may be rescheduled.
  • What happens if a user is late.
  • What happens if a user does not appear.

ToyRental.ca recommends that hosts and renters keep written records of any cancellation terms they agree to, including messages, receipts, written agreements, or booking notes.

6. ToyRental.ca Fees and Cancellations

ToyRental.ca fees are separate from rental money between hosts and renters.

ToyRental.ca fees are not rental payments to hosts, deposits, damage deposits, security deposits, insurance premiums, protection plans, escrow payments, compensation funds, or guarantees.

ToyRental.ca fees may be charged for platform-related services, including booking tools, connection features, messaging access, listing tools, administrative processing, support tools, account tools, platform maintenance, and other platform services.

A rental cancellation does not automatically mean a ToyRental.ca fee will be refunded.

ToyRental.ca refunds and credits are governed by the Refund and Credit Policy.

In most cases, if ToyRental.ca decides that a remedy is appropriate, the remedy will usually be a ToyRental.ca credit rather than a cash refund.

7. Renter Cancels Before Host Approval

If a renter cancels a booking request before the host approves it and before any ToyRental.ca fee has been paid, no ToyRental.ca refund is required because no ToyRental.ca fee has been paid.

If ToyRental.ca later offers a booking flow where a fee is paid before host approval, the cancellation terms shown at checkout and the Refund and Credit Policy will apply.

A renter who paid rental money or a deposit directly to a host before host approval must handle any refund request directly with the host.

8. Host Declines a Booking Request

If a host declines a booking request before the renter pays a ToyRental.ca fee, no ToyRental.ca refund is required because no ToyRental.ca fee has been paid.

If a host declines or refuses a request after the renter paid rental money or a deposit directly to the host, the renter must handle any refund request directly with the host.

ToyRental.ca may monitor repeated declines, false availability, misleading listings, or unreliable host conduct and may take platform action where appropriate.

9. Booking Request Expires

A booking request may expire if:

  • The host does not respond within the platform response period.
  • The requested rental date passes.
  • The renter does not complete checkout within the required time.
  • The checkout session expires.
  • The payment fails.
  • The platform marks the request expired for technical, safety, account, or policy reasons.

If no ToyRental.ca fee was paid, no ToyRental.ca refund is required.

If a ToyRental.ca fee was paid and ToyRental.ca determines that the platform service was not provided or the fee was charged in error, ToyRental.ca may issue a credit, refund, reversal, or other remedy in accordance with the Refund and Credit Policy and applicable law.

If a renter paid rental money or a deposit directly to a host, any refund issue must be handled directly with the host.

10. Renter Cancels After Host Approval

If a renter cancels after the host approves a booking request, the renter must handle any rental money, deposit, or cancellation issue directly with the host.

ToyRental.ca is not responsible for renter cancellations, changed plans, scheduling conflicts, weather concerns, illness, transportation issues, failure to pick up an item, failure to complete a rental, or renter dissatisfaction.

A renter cancellation after host approval does not automatically create a ToyRental.ca refund.

ToyRental.ca may, in its discretion and subject to applicable law, review the cancellation and decide whether a credit, refund, warning, account restriction, or other platform action is appropriate.

11. Host Cancels After Approval

If a host cancels after approving a booking request, the renter must handle any rental money, deposit, or refund issue directly with the host.

ToyRental.ca is not responsible for host cancellations, host scheduling conflicts, host changed plans, host failure to update availability, host refusal to release an item, host no-shows, host delivery failures, or host inability to proceed.

A host cancellation after approval does not automatically create a ToyRental.ca cash refund.

ToyRental.ca may, in its discretion and subject to applicable law, review the cancellation and decide whether a credit, refund, warning, account restriction, listing removal, reduced visibility, suspension, or other platform action is appropriate.

Repeated host cancellations, inaccurate availability, misleading listings, or unreliable host conduct may result in enforcement action.

12. Host Cancels Because of Safety Concerns

A host may refuse to release an item if the host reasonably believes the rental would be unsafe, unlawful, fraudulent, inappropriate, or in violation of ToyRental.ca policy.

Examples may include:

  • The renter appears impaired.
  • The renter appears unable to safely use the item.
  • The renter lacks required training, experience, licence, permit, insurance, or safety equipment.
  • The renter refuses reasonable safety instructions.
  • The renter refuses agreed deposit or payment terms.
  • The renter provides suspicious, false, or incomplete information.
  • The renter plans to use the item unlawfully or unsafely.
  • The rental would violate laws, venue rules, road rules, safety rules, insurance requirements, or ToyRental.ca policy.

A safety-based host cancellation does not automatically create a ToyRental.ca cash refund.

ToyRental.ca may review the situation and may take platform action where appropriate.

13. Renter Refuses the Item at Pickup

A renter may decide not to accept an item at pickup if the item appears unsafe, defective, damaged, incomplete, materially different from the listing, unavailable as agreed, or unsuitable for the agreed rental.

The renter and host are responsible for resolving any rental money, deposit, cancellation, or rescheduling issue directly with each other.

ToyRental.ca does not inspect items and does not guarantee that any item is safe, available, functional, lawful, insured, properly maintained, or as described.

A renter refusing an item at pickup does not automatically create a ToyRental.ca cash refund.

ToyRental.ca may review credible reports of unsafe, false, misleading, prohibited, or repeated problem listings and may take platform action where appropriate.

14. Item Is Unavailable

If an item is unavailable despite being listed as available, the host and renter must resolve any rental money, deposit, cancellation, or rescheduling issue directly with each other.

ToyRental.ca is not responsible for item unavailability, duplicate rentals, host mistakes, outdated availability, calendar errors, offline arrangements, or a host renting the item to someone else.

ToyRental.ca may take platform action against hosts who repeatedly list unavailable items, fail to update availability, approve rentals they cannot honour, or mislead renters.

15. Weather, Outdoor Conditions, and Event Conditions

Weather, outdoor conditions, site conditions, road conditions, water conditions, event conditions, venue rules, permit issues, and safety conditions may affect whether a rental can proceed.

Hosts and renters are responsible for agreeing on whether bad weather, unsafe conditions, event cancellation, venue refusal, road closures, or other conditions affect cancellation, rescheduling, deposits, or rental money.

ToyRental.ca is not responsible for bad weather, unsafe weather, unsuitable sites, venue issues, cancelled events, permit issues, road closures, unsafe water conditions, unsafe ground conditions, power issues, or environmental conditions.

Weather or event-related cancellation does not automatically create a ToyRental.ca cash refund.

16. No-Shows

A no-show occurs when a host or renter fails to appear, release an item, pick up an item, return an item, receive an item, deliver an item, or attend an agreed pickup, delivery, or return appointment.

Hosts and renters are responsible for resolving no-show issues directly with each other.

ToyRental.ca is not responsible for no-shows, late arrivals, failed pickup, failed delivery, failed return, missed messages, missed emails, wrong addresses, traffic, transportation problems, or user scheduling mistakes.

A no-show does not automatically create a ToyRental.ca cash refund.

Repeated no-shows may result in warnings, account restrictions, listing removal, reduced visibility, suspension, or termination.

17. Late Pickup or Late Return

Hosts and renters are responsible for agreeing on pickup times, return times, late fees, grace periods, delivery windows, and consequences for late pickup or late return.

ToyRental.ca is not responsible for late pickup, late delivery, late return, transportation delays, traffic, missed messages, missed emails, unavailable users, storage issues, or disputes about timing.

Late return fees, late pickup issues, late delivery issues, or timing disputes are handled directly between host and renter.

ToyRental.ca does not collect or guarantee late fees.

18. Rescheduling

Hosts and renters may choose to reschedule a rental if both users agree.

ToyRental.ca does not guarantee that rescheduling will be available, accepted, possible, or reflected correctly outside the platform.

Users should clearly confirm any rescheduled rental dates, times, payment terms, deposits, pickup, return, and availability in writing.

If a ToyRental.ca fee was paid for the original booking, ToyRental.ca may decide whether and how the fee, credit, booking record, or platform status applies to a rescheduled rental.

19. Direct Payments, Deposits, and Host Refunds

Any rental money paid directly between host and renter is outside ToyRental.ca’s control.

If a renter paid a host directly and the rental is cancelled, the renter must request any refund directly from the host.

If a host collected a deposit, damage deposit, security deposit, or other amount directly from a renter, any refund or return of that money must be handled directly between the host and renter.

ToyRental.ca is not responsible for host refunds, renter refunds, deposit returns, damage deposit disputes, security deposit disputes, e-transfer disputes, cash disputes, chargebacks, collection, or enforcement of direct user-to-user payment terms.

20. Disputes About Cancellations

Cancellation disputes are disputes between users unless they specifically involve a ToyRental.ca fee, ToyRental.ca payment error, ToyRental.ca credit, ToyRental.ca account issue, or ToyRental.ca policy enforcement issue.

ToyRental.ca may review cancellation disputes for support, safety, fraud prevention, moderation, or policy enforcement purposes.

ToyRental.ca does not act as a court, arbitrator, mediator, insurer, collection agency, payment guarantor, escrow agent, or legal representative for any user.

ToyRental.ca does not guarantee that it will investigate, decide fault, recover money, recover deposits, issue credits, issue refunds, remove users, remove listings, or resolve cancellation disputes.

21. Abuse of Cancellations

ToyRental.ca may take action against users who abuse cancellations, no-shows, booking requests, refunds, credits, reports, or support tools.

Cancellation-related abuse may include:

  • Repeatedly cancelling after approval.
  • Repeatedly failing to appear.
  • Repeatedly listing unavailable items.
  • Approving requests without intending to proceed.
  • Submitting fake booking requests.
  • Using cancellations to manipulate reviews or ratings.
  • Using cancellations to obtain credits or refunds dishonestly.
  • Falsely claiming a host or renter cancelled.
  • Falsely claiming a no-show.
  • Providing altered screenshots or misleading support records.
  • Creating duplicate accounts to avoid cancellation history.
  • Harassing users after cancellation.
  • Retaliating against users after cancellation.

ToyRental.ca may respond with warnings, listing removal, reduced visibility, account restriction, credit revocation, refund denial, suspension, termination, or other platform action.

22. Platform Action After Cancellation

ToyRental.ca may take platform action after a cancellation or failed rental where ToyRental.ca believes the action is appropriate.

Platform action may include:

  • No action.
  • Requesting more information.
  • Issuing a warning.
  • Issuing a platform credit.
  • Issuing a refund where appropriate or required by law.
  • Removing a listing.
  • Restricting a listing.
  • Reducing listing visibility.
  • Restricting booking features.
  • Restricting messaging features.
  • Removing reviews that violate policy.
  • Suspending an account.
  • Terminating an account.
  • Preserving records.
  • Reporting conduct where appropriate.

ToyRental.ca is not required to provide warnings before taking platform action.

23. Documentation Recommended

Users should document cancellation-related communications and rental terms.

Useful records may include:

  • Messages confirming cancellation terms.
  • Messages confirming pickup and return times.
  • Messages confirming weather or event terms.
  • Payment receipts.
  • Deposit receipts.
  • Photos or videos of item condition.
  • Screenshots of booking status.
  • Emails or platform notifications.
  • Written rental agreements.
  • Support tickets.

ToyRental.ca does not guarantee that records will prove fault, recover money, recover deposits, resolve disputes, or establish legal liability.

24. Emergency, Theft, Fraud, or Safety Issues

ToyRental.ca support is not an emergency service.

If a cancellation or failed rental involves theft, threats, assault, fraud, injury, dangerous conduct, unsafe conditions, criminal activity, or immediate danger, users should contact emergency services, law enforcement, insurers, legal advisors, medical professionals, or other appropriate authorities.

Users may also report the issue to ToyRental.ca for platform review, but ToyRental.ca does not provide emergency response, police services, insurance services, legal advice, medical assistance, debt collection, or guaranteed dispute resolution.

25. Limitation of Liability

To the maximum extent permitted by law, ToyRental.ca and its owners, operators, directors, officers, employees, contractors, agents, affiliates, service providers, successors, and assigns are not liable for any direct, indirect, incidental, special, consequential, punitive, aggravated, exemplary, economic, or other damages or losses arising from or related to cancellations, no-shows, failed rentals, expired requests, unavailable items, bad weather, scheduling conflicts, payment disputes, deposit disputes, direct user payments, item condition disputes, injury, death, property damage, theft, loss, damage, late return, non-return, lost income, lost opportunity, inconvenience, emotional distress, or user disputes.

Some laws may not allow certain exclusions or limitations of liability. In those cases, ToyRental.ca’s liability is limited to the maximum extent permitted by law.

26. Legal Rights

This Cancellation Policy applies to the maximum extent permitted by law.

Nothing in this Cancellation Policy is intended to limit, exclude, waive, or reduce any legal right that cannot be limited, excluded, waived, or reduced under applicable law.

If any part of this Cancellation Policy conflicts with a non-waivable legal right, the legal right will apply only to the extent required by law, and the rest of this policy will continue to apply.

27. Changes to This Policy

ToyRental.ca may update this Cancellation Policy from time to time.

When we update this policy, we will change the “Last Updated” date at the top of this page.

ToyRental.ca may provide additional notice or require renewed acceptance for material changes.

Your continued use of ToyRental.ca after an updated Cancellation Policy is posted means you accept the updated policy. If you do not agree with the updated policy, you must stop using ToyRental.ca.

29. User Acceptance

By creating an account, posting a listing, requesting a rental, approving a rental, cancelling a rental, paying a ToyRental.ca fee, sending a message, or otherwise using ToyRental.ca, you confirm that:

  • You have read this Cancellation Policy.
  • You understand this Cancellation Policy.
  • You agree to this Cancellation Policy.
  • You are at least 18 years old.
  • You understand that rental cancellation terms are between the host and renter.
  • You understand that ToyRental.ca is not a party to rental agreements between users.
  • You understand that ToyRental.ca does not collect, hold, manage, release, guarantee, or refund rental money between users.
  • You understand that ToyRental.ca fees are separate from rental money paid to hosts.
  • You understand that ToyRental.ca fees are not insurance, deposits, damage deposits, security deposits, escrow payments, or guarantees.
  • You understand that cancellations, no-shows, bad weather, unavailable items, changed plans, and user disputes do not automatically create ToyRental.ca cash refunds.
  • You understand that refunds and credits are governed by the Refund and Credit Policy.
  • You understand that ToyRental.ca may take platform action against users who abuse cancellations, no-show, mislead users, or violate policies.
