This Product Safety and Recall Notice explains the safety responsibilities that apply to items listed, requested, rented, transported, used, stored, supervised, returned, reported, or discussed through ToyRental.ca.
ToyRental.ca is an online advertising, listing, communication, booking request, and connection platform. ToyRental.ca allows users to advertise items for rent and allows other users to discover, request, and arrange rentals directly with those listing owners.
ToyRental.ca is not a rental company, product manufacturer, importer, distributor, retailer, supplier, inspector, certifier, insurer, repair provider, safety authority, regulator, expert, broker, agent, escrow provider, payment holder, mediator, arbitrator, court, or party to rental agreements between users.
ToyRental.ca does not inspect, test, certify, approve, repair, maintain, clean, sanitize, insure, deliver, operate, supervise, or guarantee any item listed on the platform.
By creating an account, posting a listing, requesting a rental, approving a rental, releasing an item, accepting an item, transporting an item, using an item, returning an item, sending a message, submitting a report, or otherwise using ToyRental.ca, you agree to this Product Safety and Recall Notice.
If you do not agree with this notice, do not list, request, rent, release, accept, transport, use, or return items through ToyRental.ca.
This Product Safety and Recall Notice should be read together with ToyRental.ca’s:

ToyRental.ca does not guarantee that any item:
Users are responsible for making their own safety decisions before listing, requesting, approving, releasing, accepting, transporting, using, supervising, storing, or returning any item.
Hosts are solely responsible for the items they list and rent.
Before listing an item, a host must take reasonable steps to confirm that the item is safe, lawful, complete, properly maintained, and suitable for rental use.
Before each rental, a host should inspect the item again and confirm that it remains safe and suitable for the intended rental.
Hosts must not list or release an item if they know or reasonably believe the item is unsafe, recalled, dangerous, defective, illegal, stolen, counterfeit, prohibited, incomplete, improperly maintained, or unsuitable.
Hosts must clearly disclose known safety issues, risks, defects, damage, missing parts, missing accessories, requirements, restrictions, and limits before the renter accepts the item.
Renters are solely responsible for deciding whether to request, accept, transport, operate, use, supervise, store, and return an item.
Before accepting an item, a renter should inspect it carefully and ask the host questions.
Renters should not accept or use an item if:
Renters must stop using an item immediately if the item becomes unsafe, defective, damaged, unstable, overheating, malfunctioning, incomplete, or otherwise unsuitable during the rental.
Hosts must not list, advertise, offer, approve, release, rent, or provide an item that is subject to a safety recall, recall order, voluntary recall, stop-use notice, safety advisory, corrective action, or other safety-related recall process.
This applies whether the recall was issued by:
If a host learns that an item is recalled after listing it, the host must immediately remove the listing, stop offering the item, stop approving rentals, notify affected renters where appropriate, and follow the recall instructions.
ToyRental.ca may remove recalled-item listings without notice and may restrict or terminate accounts that list recalled items.
Hosts must not list, advertise, offer, approve, release, rent, or provide an item that the host knows or should reasonably know is dangerous, defective, unsafe, or unsuitable for rental use.
Dangerous or defective items may include, without limitation:
If an item may be unsafe, the host should not list or release it unless the issue is properly resolved before rental.
Hosts must not list counterfeit, fake, unauthorized replica, improperly modified, or misrepresented items.
Hosts must not falsely claim that an item:
ToyRental.ca may remove listings where the brand, model, certification, safety status, condition, or legality appears misleading or unverifiable.
Hosts are responsible for checking whether their items are recalled, unsafe, defective, prohibited, or subject to safety notices.
Hosts should check recall and safety information before listing and periodically while a listing is active.
Hosts should also check recall and safety information if:
A host should not assume an item is safe simply because the host has used it before or because the item has not yet caused a known incident.
Renters are responsible for asking questions and checking whether an item appears safe and suitable before accepting or using it.

Hosts should not remove or hide warning labels, safety stickers, capacity plates, age labels, weight labels, model numbers, serial numbers, manufacturer labels, certification labels, or safety information.
Renters should read and follow all available manuals, labels, warnings, instructions, host directions, manufacturer instructions, venue rules, laws, and safety requirements.
If an item lacks warnings, instructions, labels, manuals, or safety information that appear necessary for safe use, the renter should not use the item unless safe and lawful use is clearly understood.
Higher-risk items require extra caution.

Hosts should clearly disclose higher-risk requirements and should refuse to release higher-risk items where the host believes the renter cannot use them safely or lawfully.
Renters should not rent or use higher-risk items unless they have the ability, equipment, supervision, training, licence, permit, insurance, and judgment needed to use them safely and lawfully.
ToyRental.ca may remove or restrict higher-risk listings at any time.
Items used by or around children require extra caution.
Hosts listing child-related items, toys, games, party items, event items, inflatables, furniture, recreational items, or other items used by or around children should clearly disclose:
Hosts must not list recalled, unsafe, broken, incomplete, unsanitary, unstable, or inappropriate child-related items.
Renters are responsible for adult supervision and safe use of items used by or around children.
ToyRental.ca is not responsible for injury, death, unsafe setup, lack of supervision, unsafe use, or child-related rental incidents.
Items involving electricity, batteries, fuel, propane, heat, charging, flame, ventilation, pressure, or fire risk require extra caution.
Hosts should disclose known requirements, limitations, warnings, fuel type, battery type, charger requirements, ventilation needs, outdoor-only use, fire risks, overheating risks, and safe storage requirements.
Renters must use these items only in safe, lawful, appropriate, properly ventilated, properly supervised, and suitable locations.
Users must stop using an item immediately if it overheats, smokes, sparks, leaks, smells unusual, malfunctions, causes shock, trips circuits, or creates fire, explosion, poisoning, ventilation, or safety concerns.
ToyRental.ca is not responsible for fires, electrical damage, battery issues, fuel issues, propane issues, heating issues, ventilation issues, poisoning risks, property damage, injury, death, or related harm.
Trailers, towing equipment, vehicle-related items, and road-use items may require special inspection, legal compliance, proper vehicle compatibility, loading limits, towing capacity, registration, lights, brakes, tires, safety chains, straps, licences, permits, insurance, and road safety compliance.
Hosts should clearly disclose known road-use requirements, compatibility limits, weight limits, load limits, towing requirements, condition, and safety information.
Renters are responsible for confirming that they can safely and lawfully tow, transport, load, unload, secure, park, operate, and return the item.
ToyRental.ca does not verify roadworthiness, vehicle compatibility, towing capacity, licences, permits, registration, insurance, lights, brakes, tires, or legal compliance.
ToyRental.ca is not responsible for tickets, fines, collisions, towing incidents, vehicle damage, trailer damage, cargo damage, property damage, injury, death, improper loading, improper securing, improper towing, or road safety incidents.
Water-related, outdoor, recreational, camping, event, sports, and weather-dependent items may involve increased risk.
Hosts should disclose known risks, restrictions, required equipment, required experience, location limits, weather limits, capacity limits, safety rules, and supervision requirements.
Renters are responsible for deciding whether weather, water, terrain, venue, road, trail, property, event, or environmental conditions make use unsafe or unlawful.
Users must not use an item where conditions make use unsafe.
ToyRental.ca is not responsible for weather, water conditions, terrain, venue rules, property hazards, outdoor hazards, wildlife, event cancellation, permit issues, unsafe conditions, injury, death, property damage, or loss.
Hosts are responsible for accurately describing the cleanliness and condition of their items.
Hosts should disclose relevant cleaning, sanitation, odour, smoke, pet, food, chemical, mould, dust, outdoor-use, or allergen concerns where applicable.
Renters are responsible for inspecting items and deciding whether an item is clean, safe, and suitable for their needs.
ToyRental.ca does not clean, sanitize, disinfect, inspect, or certify items.
ToyRental.ca is not responsible for illness, contamination, allergic reactions, odours, sanitation issues, cleaning disputes, or cleanliness disputes, to the maximum extent permitted by law.
Hosts must not make false, misleading, deceptive, unsupported, or exaggerated safety claims.
Hosts must not falsely claim that an item:
ToyRental.ca may remove listings that contain unsafe, false, misleading, deceptive, unsupported, or inappropriate safety claims.
Users may report unsafe, recalled, defective, dangerous, illegal, prohibited, stolen, counterfeit, misleading, or suspicious listings to ToyRental.ca.
A useful safety report should include:
ToyRental.ca may review reports for platform safety, support, moderation, fraud prevention, policy enforcement, legal compliance, and platform protection.
ToyRental.ca does not guarantee that any report will be investigated, that any listing will be removed, that any account will be suspended, that any item will be recovered, that any money will be recovered, or that any dispute will be resolved.
ToyRental.ca may review listings, reports, messages, photos, account records, booking records, payment records, support records, moderation records, public information, third-party notices, and other information where ToyRental.ca believes a safety issue may exist.
ToyRental.ca may take platform action, including:
ToyRental.ca is not required to provide warnings before taking safety-related action.
ToyRental.ca’s decision to allow a listing to remain on the platform does not mean ToyRental.ca has inspected, tested, certified, verified, insured, approved, or guaranteed the item.
Users should immediately stop using an item if:
Users should contact the host, stop further use, preserve evidence, document the condition, and contact appropriate authorities, professionals, insurers, or advisors where needed.

If an item causes or may cause injury, death, fire, electrical danger, poisoning, dangerous malfunction, property damage, crime, threat, theft, or immediate safety danger, users should contact emergency services, law enforcement, medical professionals, fire services, insurers, legal advisors, property owners, venue operators, regulators, or other appropriate authorities.
Users may also report the issue to ToyRental.ca for platform review, but ToyRental.ca does not provide emergency response, medical help, police services, insurance adjustment, legal advice, expert inspection, product certification, repair service, or guaranteed dispute resolution.

ToyRental.ca does not provide insurance of any kind.
ToyRental.ca does not insure items, hosts, renters, listings, rentals, rental agreements, rental money, deposits, ToyRental.ca fees, injury, death, property damage, theft, loss, late return, non-return, damage, unsafe items, defective items, recalled items, or safety incidents.
ToyRental.ca does not operate a damage fund, repair fund, replacement fund, compensation fund, safety fund, guarantee fund, or escrow service.
Hosts and renters are responsible for their own insurance and legal remedies.
Product safety disputes between hosts and renters are generally user-to-user disputes.

ToyRental.ca may review safety disputes for platform purposes, but ToyRental.ca does not decide legal liability, negligence, fault, damages, insurance coverage, contract rights, ownership rights, repair costs, replacement costs, deposit rights, or compensation claims.
Users must resolve safety disputes directly with each other or through insurance, legal advice, law enforcement, regulators, small claims court, court, payment providers, professional advisors, or other available remedies.
Users should check appropriate safety and recall resources before listing, renting, or using items.

ToyRental.ca may provide links or general references to safety resources, but ToyRental.ca does not guarantee that any resource is complete, current, accurate, or applicable to a particular item or rental.
ToyRental.ca does not provide engineering, mechanical, electrical, product safety, legal, insurance, medical, inspection, repair, maintenance, training, or professional advice.
Any safety information, checklist, warning, article, tooltip, policy language, or support response from ToyRental.ca is general information only and may not apply to a specific item, rental, user, location, law, or situation.
Users are responsible for obtaining professional advice where appropriate.

Some laws may not allow certain exclusions or limitations of liability. In those cases, ToyRental.ca’s liability is limited to the maximum extent permitted by law.

Nothing in this notice is intended to limit, exclude, waive, or reduce any legal right or legal obligation that cannot be limited, excluded, waived, or reduced under applicable law.
If any part of this notice conflicts with a non-waivable legal right or legal obligation, that legal right or obligation will apply only to the extent required by law, and the rest of this notice will continue to apply.

ToyRental.ca may provide additional notice or require renewed acceptance for material changes.
