ToyRental.ca is an online advertising, listing, communication, booking request, and connection platform. ToyRental.ca allows users to advertise items for rent and allows other users to discover, request, and arrange rentals directly with those listing owners.

ToyRental.ca is not a rental company, product manufacturer, importer, distributor, retailer, supplier, inspector, certifier, insurer, repair provider, safety authority, regulator, expert, broker, agent, escrow provider, payment holder, mediator, arbitrator, court, or party to rental agreements between users.

ToyRental.ca does not inspect, test, certify, approve, repair, maintain, clean, sanitize, insure, deliver, operate, supervise, or guarantee any item listed on the platform.

By creating an account, posting a listing, requesting a rental, approving a rental, releasing an item, accepting an item, transporting an item, using an item, returning an item, sending a message, submitting a report, or otherwise using ToyRental.ca, you agree to this Product Safety and Recall Notice.

If you do not agree with this notice, do not list, request, rent, release, accept, transport, use, or return items through ToyRental.ca.

2. Relationship to Other Policies

This Product Safety and Recall Notice should be read together with ToyRental.ca’s:

If this notice conflicts with another ToyRental.ca policy, ToyRental.ca may decide which policy applies based on the circumstances, safety risk, legal risk, user risk, platform integrity, and the purpose of the policy.

Nothing in this notice limits any legal right or legal obligation that cannot be waived, limited, or excluded under applicable law.

3. Key Safety Summary

The most important product safety rules are:

• Hosts must not list recalled, dangerous, defective, illegal, stolen, counterfeit, unsafe, or prohibited items.
• Hosts must inspect items before listing and before each rental.
• Hosts must disclose known defects, damage, missing parts, safety limits, risks, and requirements.
• Hosts must not release an item they know or reasonably believe is unsafe.
• Renters must inspect items before accepting them.
• Renters must not use items they cannot use safely and lawfully.
• Users must stop using an item immediately if it appears unsafe, defective, damaged, recalled, unstable, overheating, malfunctioning, incomplete, or unsuitable.
• ToyRental.ca does not inspect, test, certify, approve, maintain, repair, insure, supervise, or guarantee any listed item.
• ToyRental.ca does not provide insurance.
• Users list, rent, transport, operate, use, supervise, store, and return items at their own risk.
• ToyRental.ca may remove listings or restrict accounts where safety concerns exist.
• Emergency, injury, dangerous condition, fire, crime, threat, theft, or immediate safety issues should be reported to emergency services, law enforcement, medical professionals, insurers, legal advisors, property owners, regulators, or other appropriate authorities.

4. Definitions

For the purpose of this notice:

• “ToyRental.ca,” “we,” “us,” and “our” means ToyRental.ca and its owners, operators, administrators, contractors, service providers, affiliates, successors, and assigns.
• “User,” “you,” and “your” means any person who accesses or uses ToyRental.ca.
• “Host” means a user who lists, owns, controls, manages, approves, releases, delivers, or offers an item for rent.
• “Renter” means a user who browses, requests, reserves, receives, transports, uses, stores, supervises, or returns an item listed by a host.
• “Item” means any product, tool, toy, game, equipment, trailer, machine, device, event item, party item, recreational item, outdoor item, watercraft-related item, vehicle-related item, accessory, attachment, or other property listed, advertised, requested, rented, discussed, transported, used, stored, supervised, or returned through ToyRental.ca.
• “Recall” means a recall order, voluntary recall, safety recall, manufacturer recall, importer recall, distributor recall, retailer recall, regulator recall, corrective action, safety advisory, warning, stop-use notice, repair notice, replacement notice, or similar safety notice affecting an item.
• “Unsafe Item” means an item that is recalled, dangerous, defective, damaged, incomplete, unstable, improperly assembled, improperly installed, missing safety parts, missing guards, missing warnings, missing instructions, modified unsafely, contaminated, unsanitary, unlawful, unsuitable, or otherwise not safe for its ordinary or intended rental use.
• “Higher-Risk Item” means an item that may create increased risk because of its design, purpose, power source, movement, weight, height, speed, temperature, pressure, electrical use, fuel use, towing use, outdoor use, water use, child use, event use, or need for training, supervision, licence, permit, insurance, protective equipment, or special handling.

5. ToyRental.ca Does Not Inspect or Certify Items

ToyRental.ca does not inspect, test, examine, approve, certify, verify, repair, maintain, clean, sanitize, install, assemble, deliver, operate, supervise, or insure items listed by users.

ToyRental.ca does not guarantee that any item:

• Exists.
• Is available.
• Is owned by the host.
• Is lawful to rent.
• Is lawful to use.
• Is not stolen.
• Is not counterfeit.
• Is not recalled.
• Is not defective.
• Is safe.
• Is clean.
• Is properly maintained.
• Is properly repaired.
• Is properly assembled.
• Is properly installed.
• Is suitable for the renter’s intended use.
• Matches the listing description.
• Includes all parts, accessories, instructions, warnings, or safety equipment.

Users are responsible for making their own safety decisions before listing, requesting, approving, releasing, accepting, transporting, using, supervising, storing, or returning any item.

6. Host Product Safety Responsibilities

Hosts are solely responsible for the items they list and rent.

Before listing an item, a host must take reasonable steps to confirm that the item is safe, lawful, complete, properly maintained, and suitable for rental use.

Before each rental, a host should inspect the item again and confirm that it remains safe and suitable for the intended rental.

Hosts must not list or release an item if they know or reasonably believe the item is unsafe, recalled, dangerous, defective, illegal, stolen, counterfeit, prohibited, incomplete, improperly maintained, or unsuitable.

Hosts must clearly disclose known safety issues, risks, defects, damage, missing parts, missing accessories, requirements, restrictions, and limits before the renter accepts the item.

7. Renter Product Safety Responsibilities

Renters are solely responsible for deciding whether to request, accept, transport, operate, use, supervise, store, and return an item.

Before accepting an item, a renter should inspect it carefully and ask the host questions.

Renters should not accept or use an item if:

• The item appears unsafe.
• The item appears recalled.
• The item appears defective.
• The item appears damaged.
• The item appears incomplete.
• The item appears unstable.
• The item appears improperly assembled.
• The item appears improperly installed.
• The item is missing guards, warnings, instructions, or safety parts.
• The item is different from the listing in a material way.
• The renter does not understand how to use the item safely.
• The renter lacks required training, experience, licence, permit, insurance, supervision, or protective equipment.
• The intended use is unsafe, unlawful, prohibited, or unsuitable.

Renters must stop using an item immediately if the item becomes unsafe, defective, damaged, unstable, overheating, malfunctioning, incomplete, or otherwise unsuitable during the rental.

8. Recalled Items Are Prohibited

Hosts must not list, advertise, offer, approve, release, rent, or provide an item that is subject to a safety recall, recall order, voluntary recall, stop-use notice, safety advisory, corrective action, or other safety-related recall process.

This applies whether the recall was issued by:

• Health Canada.
• Another Canadian regulator.
• A provincial or territorial authority.
• A manufacturer.
• An importer.
• A distributor.
• A retailer.
• A certification body.
• A foreign regulator where the same or similar product is affected.
• Any other authority, supplier, or organization responsible for product safety.

If a host learns that an item is recalled after listing it, the host must immediately remove the listing, stop offering the item, stop approving rentals, notify affected renters where appropriate, and follow the recall instructions.

ToyRental.ca may remove recalled-item listings without notice and may restrict or terminate accounts that list recalled items.

9. Dangerous or Defective Items Are Prohibited

Hosts must not list, advertise, offer, approve, release, rent, or provide an item that the host knows or should reasonably know is dangerous, defective, unsafe, or unsuitable for rental use.

Dangerous or defective items may include, without limitation:

• Items with missing guards or safety covers.
• Items with disabled safety switches.
• Items with damaged cords, plugs, batteries, chargers, brakes, lights, tires, straps, locks, or latches.
• Items with structural cracks, leaks, corrosion, instability, sharp damage, or excessive wear.
• Items that overheat, smoke, spark, leak, jam, wobble, stall, or malfunction.
• Items that have been modified in a way that makes them unsafe or unlawful.
• Items missing required labels, instructions, warnings, parts, accessories, or manuals.
• Items that cannot be cleaned or sanitized safely where cleanliness matters.
• Items not suitable for the renter’s intended use.
• Items that require professional inspection, repair, setup, or operation before safe rental use.
• Items that should not be used because of age, condition, storage history, damage history, or unknown safety status.

If an item may be unsafe, the host should not list or release it unless the issue is properly resolved before rental.

10. Counterfeit, Modified, or Misrepresented Items

Hosts must not list counterfeit, fake, unauthorized replica, improperly modified, or misrepresented items.

Hosts must not falsely claim that an item:

• Is a specific brand, model, year, edition, or certification.
• Meets a safety standard if it does not.
• Has been inspected if it has not.
• Has been repaired if it has not.
• Has been maintained if it has not.
• Has all required parts if it does not.
• Is suitable for a use if it is not.
• Is safe for children if it is not.
• Is safe for commercial, event, towing, water, road, outdoor, or other use if it is not.

ToyRental.ca may remove listings where the brand, model, certification, safety status, condition, or legality appears misleading or unverifiable.

11. Host Duty to Check Recalls and Safety Notices

Hosts are responsible for checking whether their items are recalled, unsafe, defective, prohibited, or subject to safety notices.

Hosts should check recall and safety information before listing and periodically while a listing is active.

Hosts should also check recall and safety information if:

• The item is older.
• The item was purchased used.
• The item was bought from a marketplace, auction, liquidation sale, garage sale, or unknown source.
• The item has no manual or documentation.
• The item has missing labels, serial numbers, or model numbers.
• The item has been repaired or modified.
• The item is used by or around children.
• The item has electrical, battery, fuel, propane, mechanical, towing, lifting, water, or heating risks.
• The item appears damaged, worn, unstable, or unreliable.
• The host receives a complaint, injury report, malfunction report, or safety concern.

A host should not assume an item is safe simply because the host has used it before or because the item has not yet caused a known incident.

12. Renter Duty to Check and Ask Questions

Renters are responsible for asking questions and checking whether an item appears safe and suitable before accepting or using it.

Renters should consider asking the host:

• Is the item subject to any recall or safety notice?
• When was the item last inspected?
• When was the item last used?
• Has the item been repaired or modified?
• Are any parts missing?
• Are there any known defects?
• Are there any safety warnings?
• Are there any limits on use?
• Does the item require training or experience?
• Does the item require a licence or permit?
• Does the item require protective equipment?
• Does the item require adult supervision?
• Does the item require specific setup, anchoring, installation, towing, transport, or return steps?
• Is a manual or instruction sheet available?

Renters should not rely only on a listing title, photo, or short description when safety matters.

13. Inspection Before Listing, Release, Acceptance, and Return

Users should inspect items carefully.

Hosts should inspect items:

• Before listing.
• Before approving a rental where appropriate.
• Before releasing the item.
• When the item is returned.
• After any complaint, malfunction, damage, injury, or safety concern.

Renters should inspect items:

• Before accepting the item.
• Before transporting the item.
• Before using the item.
• During use if safety concerns arise.
• Before returning the item.

Inspection should consider, where relevant:

• Visible damage.
• Missing parts.
• Missing accessories.
• Missing guards.
• Missing warning labels.
• Loose components.
• Cracks.
• Leaks.
• Corrosion.
• Instability.
• Unusual noises.
• Heat, sparks, smoke, smell, or electrical concerns.
• Brakes, lights, tires, locks, latches, straps, cords, chargers, batteries, switches, or safety devices.
• Cleanliness or sanitation concerns.
• Fuel, battery, tire pressure, fluid levels, or other relevant operating details.
• Whether the item matches the listing and agreed rental terms.

14. Manuals, Instructions, Warnings, and Labels

Hosts should provide manuals, instructions, warnings, and safety information where appropriate and available.

Hosts should not remove or hide warning labels, safety stickers, capacity plates, age labels, weight labels, model numbers, serial numbers, manufacturer labels, certification labels, or safety information.

Renters should read and follow all available manuals, labels, warnings, instructions, host directions, manufacturer instructions, venue rules, laws, and safety requirements.

If an item lacks warnings, instructions, labels, manuals, or safety information that appear necessary for safe use, the renter should not use the item unless safe and lawful use is clearly understood.

15. Higher-Risk Items

Higher-risk items require extra caution.

Higher-risk items may include, without limitation:

• Tools.
• Power equipment.
• Machinery.
• Generators.
• Heating equipment.
• Electrical equipment.
• Battery-powered equipment.
• Fuel-powered equipment.
• Propane-related equipment.
• Trailers.
• Vehicle-related items.
• Watercraft-related items.
• Towing equipment.
• Lifting equipment.
• Access equipment.
• Outdoor equipment.
• Recreational equipment.
• Party rentals.
• Event items.
• Inflatables.
• Items used by or around children.
• Items that require setup, anchoring, supervision, licence, permit, insurance, protective equipment, or training.

Hosts should clearly disclose higher-risk requirements and should refuse to release higher-risk items where the host believes the renter cannot use them safely or lawfully.

Renters should not rent or use higher-risk items unless they have the ability, equipment, supervision, training, licence, permit, insurance, and judgment needed to use them safely and lawfully.

ToyRental.ca may remove or restrict higher-risk listings at any time.

16. Items Used by or Around Children

Items used by or around children require extra caution.

Hosts listing child-related items, toys, games, party items, event items, inflatables, furniture, recreational items, or other items used by or around children should clearly disclose:

• Age limits.
• Weight limits.
• Capacity limits.
• Supervision requirements.
• Setup requirements.
• Surface requirements.
• Anchoring requirements.
• Weather restrictions.
• Cleaning condition.
• Known defects.
• Missing parts.
• Safety rules.
• Prohibited uses.

Hosts must not list recalled, unsafe, broken, incomplete, unsanitary, unstable, or inappropriate child-related items.

Renters are responsible for adult supervision and safe use of items used by or around children.

ToyRental.ca is not responsible for injury, death, unsafe setup, lack of supervision, unsafe use, or child-related rental incidents.

17. Electrical, Battery, Fuel, Propane, Heat, and Fire Risks

Items involving electricity, batteries, fuel, propane, heat, charging, flame, ventilation, pressure, or fire risk require extra caution.

Hosts should disclose known requirements, limitations, warnings, fuel type, battery type, charger requirements, ventilation needs, outdoor-only use, fire risks, overheating risks, and safe storage requirements.

Renters must use these items only in safe, lawful, appropriate, properly ventilated, properly supervised, and suitable locations.

Users must stop using an item immediately if it overheats, smokes, sparks, leaks, smells unusual, malfunctions, causes shock, trips circuits, or creates fire, explosion, poisoning, ventilation, or safety concerns.

ToyRental.ca is not responsible for fires, electrical damage, battery issues, fuel issues, propane issues, heating issues, ventilation issues, poisoning risks, property damage, injury, death, or related harm.

18. Trailers, Towing, Vehicle-Related Items, and Road Use

Trailers, towing equipment, vehicle-related items, and road-use items may require special inspection, legal compliance, proper vehicle compatibility, loading limits, towing capacity, registration, lights, brakes, tires, safety chains, straps, licences, permits, insurance, and road safety compliance.

Hosts should clearly disclose known road-use requirements, compatibility limits, weight limits, load limits, towing requirements, condition, and safety information.

Renters are responsible for confirming that they can safely and lawfully tow, transport, load, unload, secure, park, operate, and return the item.

ToyRental.ca does not verify roadworthiness, vehicle compatibility, towing capacity, licences, permits, registration, insurance, lights, brakes, tires, or legal compliance.

ToyRental.ca is not responsible for tickets, fines, collisions, towing incidents, vehicle damage, trailer damage, cargo damage, property damage, injury, death, improper loading, improper securing, improper towing, or road safety incidents.

19. Water, Outdoor, Weather, and Recreational Risks

Water-related, outdoor, recreational, camping, event, sports, and weather-dependent items may involve increased risk.

Hosts should disclose known risks, restrictions, required equipment, required experience, location limits, weather limits, capacity limits, safety rules, and supervision requirements.

Renters are responsible for deciding whether weather, water, terrain, venue, road, trail, property, event, or environmental conditions make use unsafe or unlawful.

Users must not use an item where conditions make use unsafe.

ToyRental.ca is not responsible for weather, water conditions, terrain, venue rules, property hazards, outdoor hazards, wildlife, event cancellation, permit issues, unsafe conditions, injury, death, property damage, or loss.

20. Cleaning, Sanitation, Allergens, and Contamination

Hosts are responsible for accurately describing the cleanliness and condition of their items.

Hosts should disclose relevant cleaning, sanitation, odour, smoke, pet, food, chemical, mould, dust, outdoor-use, or allergen concerns where applicable.

Renters are responsible for inspecting items and deciding whether an item is clean, safe, and suitable for their needs.

ToyRental.ca does not clean, sanitize, disinfect, inspect, or certify items.

ToyRental.ca is not responsible for illness, contamination, allergic reactions, odours, sanitation issues, cleaning disputes, or cleanliness disputes, to the maximum extent permitted by law.

21. Prohibited Safety Claims

Hosts must not make false, misleading, deceptive, unsupported, or exaggerated safety claims.

Hosts must not falsely claim that an item:

• Is certified when it is not.
• Is inspected when it is not.
• Is professionally maintained when it is not.
• Is repaired when it is not.
• Is safe for children when it is not.
• Is safe for commercial use when it is not.
• Is safe for towing when it is not.
• Is safe for water use when it is not.
• Is safe for road use when it is not.
• Meets a standard when it does not.
• Has insurance coverage when it does not.
• Has no defects when the host knows of defects.
• Is not recalled when the host knows or should reasonably know it is recalled.

ToyRental.ca may remove listings that contain unsafe, false, misleading, deceptive, unsupported, or inappropriate safety claims.

22. User Reports of Unsafe Items

Users may report unsafe, recalled, defective, dangerous, illegal, prohibited, stolen, counterfeit, misleading, or suspicious listings to ToyRental.ca.

A useful safety report should include:

• The listing link or listing number.
• The item name.
• The host account involved.
• A clear description of the safety concern.
• Photos or videos, if available.
• Messages with the host or renter, if relevant.
• Recall information, if known.
• Manufacturer, model, serial number, or product label information, if known.
• Incident details, if an incident occurred.
• Police report, insurance claim, medical record, or regulator reference numbers, if applicable.

ToyRental.ca may review reports for platform safety, support, moderation, fraud prevention, policy enforcement, legal compliance, and platform protection.

ToyRental.ca does not guarantee that any report will be investigated, that any listing will be removed, that any account will be suspended, that any item will be recovered, that any money will be recovered, or that any dispute will be resolved.

23. ToyRental.ca Safety Review and Platform Action

ToyRental.ca may review listings, reports, messages, photos, account records, booking records, payment records, support records, moderation records, public information, third-party notices, and other information where ToyRental.ca believes a safety issue may exist.

ToyRental.ca may take platform action, including:

• Taking no action.
• Requesting more information.
• Warning a user.
• Requiring listing changes.
• Removing photos.
• Removing a listing.
• Restricting a listing.
• Reducing listing visibility.
• Blocking booking requests.
• Restricting messaging.
• Restricting account features.
• Suspending an account.
• Terminating an account.
• Preserving records.
• Cooperating with lawful requests.
• Reporting conduct where appropriate.
• Taking other action ToyRental.ca believes is appropriate.

ToyRental.ca is not required to provide warnings before taking safety-related action.

ToyRental.ca’s decision to allow a listing to remain on the platform does not mean ToyRental.ca has inspected, tested, certified, verified, insured, approved, or guaranteed the item.

24. Stop-Use Situations

Users should immediately stop using an item if:

• The item appears recalled.
• The item appears dangerous.
• The item appears defective.
• The item appears unstable.
• The item appears improperly assembled or installed.
• The item has missing safety parts.
• The item has missing guards or warnings.
• The item overheats, smokes, sparks, leaks, jams, stalls, wobbles, cracks, breaks, or malfunctions.
• The item causes injury, property damage, fire risk, electrical risk, chemical risk, or other safety concern.
• The user no longer understands how to use the item safely.
• Conditions become unsafe.
• Using the item would be unlawful or against instructions.

Users should contact the host, stop further use, preserve evidence, document the condition, and contact appropriate authorities, professionals, insurers, or advisors where needed.

ToyRental.ca support is not an emergency service.

25. Injury, Death, Fire, Crime, or Immediate Danger

ToyRental.ca is not an emergency service.

If an item causes or may cause injury, death, fire, electrical danger, poisoning, dangerous malfunction, property damage, crime, threat, theft, or immediate safety danger, users should contact emergency services, law enforcement, medical professionals, fire services, insurers, legal advisors, property owners, venue operators, regulators, or other appropriate authorities.

Users may also report the issue to ToyRental.ca for platform review, but ToyRental.ca does not provide emergency response, medical help, police services, insurance adjustment, legal advice, expert inspection, product certification, repair service, or guaranteed dispute resolution.

26. Documentation Recommended

Users should document item condition and safety issues.

Useful records may include:

• Photos before pickup.
• Videos before pickup.
• Photos during use if a problem occurs.
• Videos during use if safe to record.
• Photos after return.
• Videos after return.
• Serial numbers.
• Model numbers.
• Brand information.
• Warning labels.
• Manuals or instructions.
• Messages between users.
• Booking records.
• Receipts or deposit records.
• Repair estimates.
• Replacement estimates.
• Medical records, where applicable.
• Police report numbers, where applicable.
• Insurance claim numbers, where applicable.
• Recall notices or safety advisory records, where applicable.

ToyRental.ca does not guarantee that records will prove fault, recover money, recover property, establish legal liability, or resolve disputes.

27. No Insurance or Compensation Fund

ToyRental.ca does not provide insurance of any kind.

ToyRental.ca does not insure items, hosts, renters, listings, rentals, rental agreements, rental money, deposits, ToyRental.ca fees, injury, death, property damage, theft, loss, late return, non-return, damage, unsafe items, defective items, recalled items, or safety incidents.

ToyRental.ca does not operate a damage fund, repair fund, replacement fund, compensation fund, safety fund, guarantee fund, or escrow service.

Hosts and renters are responsible for their own insurance and legal remedies.

28. User-to-User Safety Disputes

Product safety disputes between hosts and renters are generally user-to-user disputes.

These may include disputes about:

• Whether an item was safe.
• Whether an item was recalled.
• Whether an item was defective.
• Whether an item was properly maintained.
• Whether a host disclosed known risks.
• Whether a renter used the item properly.
• Whether a renter followed instructions.
• Whether damage was pre-existing.
• Whether injury or property damage occurred.
• Whether a deposit should be returned.
• Whether repair or replacement costs are owed.

ToyRental.ca may review safety disputes for platform purposes, but ToyRental.ca does not decide legal liability, negligence, fault, damages, insurance coverage, contract rights, ownership rights, repair costs, replacement costs, deposit rights, or compensation claims.

Users must resolve safety disputes directly with each other or through insurance, legal advice, law enforcement, regulators, small claims court, court, payment providers, professional advisors, or other available remedies.

29. Product Safety Resources

Users should check appropriate safety and recall resources before listing, renting, or using items.

Depending on the item, useful resources may include:

• Manufacturer recall pages.
• Manufacturer manuals and safety notices.
• Health Canada recall information.
• Government safety advisories.
• Product labels and warning labels.
• Certification body information where applicable.
• Insurance provider guidance.
• Professional inspection, repair, or maintenance advice.
• Applicable laws, bylaws, regulations, permits, licences, and safety rules.

ToyRental.ca may provide links or general references to safety resources, but ToyRental.ca does not guarantee that any resource is complete, current, accurate, or applicable to a particular item or rental.

30. No Professional Safety Advice

ToyRental.ca does not provide engineering, mechanical, electrical, product safety, legal, insurance, medical, inspection, repair, maintenance, training, or professional advice.

Any safety information, checklist, warning, article, tooltip, policy language, or support response from ToyRental.ca is general information only and may not apply to a specific item, rental, user, location, law, or situation.

Users are responsible for obtaining professional advice where appropriate.

31. Host Indemnity for Unsafe or Recalled Items

To the maximum extent permitted by law, hosts agree to defend, indemnify, and hold harmless ToyRental.ca and its owners, operators, directors, officers, employees, contractors, agents, affiliates, service providers, successors, and assigns from any claims, demands, damages, losses, liabilities, fines, penalties, costs, expenses, and legal fees arising from or related to:

• The host’s item.
• The host’s listing.
• The host’s failure to check recalls or safety notices.
• The host’s listing of a recalled, unsafe, defective, dangerous, illegal, prohibited, stolen, counterfeit, or misrepresented item.
• The host’s failure to disclose defects, risks, damage, missing parts, warnings, instructions, requirements, or limitations.
• The host’s failure to inspect, repair, maintain, clean, sanitize, or safely provide an item.
• The host’s instructions or failure to provide instructions.
• The host’s release of an item to a renter.
• Any injury, death, property damage, theft, loss, damage, late return, non-return, dispute, legal claim, regulatory issue, or safety incident involving the host’s item.
• The host’s violation of any law, regulation, bylaw, recall instruction, safety rule, manufacturer instruction, insurance requirement, ToyRental.ca policy, or third-party right.

32. Renter Indemnity for Unsafe Use

To the maximum extent permitted by law, renters agree to defend, indemnify, and hold harmless ToyRental.ca and its owners, operators, directors, officers, employees, contractors, agents, affiliates, service providers, successors, and assigns from any claims, demands, damages, losses, liabilities, fines, penalties, costs, expenses, and legal fees arising from or related to:

• The renter’s request, acceptance, possession, custody, control, transport, storage, operation, supervision, or return of an item.
• The renter’s failure to inspect an item before accepting or using it.
• The renter’s unsafe, improper, unlawful, negligent, or unauthorized use of an item.
• The renter’s failure to follow instructions, warnings, manuals, laws, permits, licences, safety rules, insurance requirements, or ToyRental.ca policies.
• The renter’s failure to stop using an item after a safety concern appears.
• The renter’s failure to obtain required training, experience, supervision, protective equipment, insurance, licence, or permit.
• Any injury, death, property damage, theft, loss, damage, late return, non-return, dispute, legal claim, regulatory issue, or safety incident involving the renter’s rental or use of an item.

33. Limitation of Liability

To the maximum extent permitted by law, ToyRental.ca and its owners, operators, directors, officers, employees, contractors, agents, affiliates, service providers, successors, and assigns are not liable for any direct, indirect, incidental, special, consequential, punitive, aggravated, exemplary, economic, or other damages or losses arising from or related to recalled items, dangerous items, defective items, unsafe listings, unsafe use, item condition, item maintenance, item repair, item inspection, product safety, product recalls, safety notices, warnings, missing parts, missing guards, missing instructions, user conduct, injury, death, property damage, theft, loss, damage, late return, non-return, rental disputes, legal claims, regulatory issues, or platform action.

Some laws may not allow certain exclusions or limitations of liability. In those cases, ToyRental.ca’s liability is limited to the maximum extent permitted by law.

34. Legal Rights

This Product Safety and Recall Notice applies to the maximum extent permitted by law.

Nothing in this notice is intended to limit, exclude, waive, or reduce any legal right or legal obligation that cannot be limited, excluded, waived, or reduced under applicable law.

If any part of this notice conflicts with a non-waivable legal right or legal obligation, that legal right or obligation will apply only to the extent required by law, and the rest of this notice will continue to apply.

ToyRental.ca may provide additional notice or require renewed acceptance for material changes.

• You are at least 18 years old.
• You understand that ToyRental.ca does not inspect, test, certify, approve, maintain, repair, insure, supervise, or guarantee items.
• You understand that recalled, dangerous, defective, illegal, stolen, counterfeit, unsafe, or prohibited items must not be listed or rented.
• You understand that hosts are responsible for checking recalls, inspecting items, disclosing risks, and not releasing unsafe items.
• You understand that renters are responsible for inspecting items, asking questions, using items safely and lawfully, and stopping use if safety concerns arise.
• You understand that ToyRental.ca does not provide insurance or a compensation fund.
• You understand that users list, rent, transport, operate, use, supervise, store, and return items at their own risk.
• You understand that ToyRental.ca may remove listings, restrict accounts, preserve records, or take other platform action where safety concerns exist.
