1. Introduction

This Dispute Resolution Policy explains how disputes, complaints, reports, payment concerns, safety concerns, listing issues, booking issues, user conduct issues, damage claims, theft claims, loss claims, late return claims, non-return claims, refund requests, and related matters may be reported to ToyRental.ca.

ToyRental.ca is an online advertising, listing, communication, booking request, and connection platform. ToyRental.ca allows users to advertise items for rent and allows other users to discover, request, and arrange rentals directly with those listing owners.

ToyRental.ca is not a rental company, insurer, broker, agent, payment holder, escrow provider, collection agency, police service, emergency service, mediator, arbitrator, court, legal advisor, or party to rental agreements between users.

This policy does not guarantee that ToyRental.ca will investigate, decide, resolve, compensate, refund, credit, recover money, recover property, remove a user, remove a listing, or take any specific action.

By creating an account, posting a listing, requesting a rental, approving a rental, paying a ToyRental.ca fee, sending a message, submitting a report, contacting support, or otherwise using ToyRental.ca, you agree to this Dispute Resolution Policy.

If you do not agree with this Dispute Resolution Policy, do not use ToyRental.ca.

2. Relationship to Other Policies

This Dispute Resolution Policy should be read together with ToyRental.ca’s:

If this Dispute Resolution Policy conflicts with another ToyRental.ca policy, ToyRental.ca may decide which policy applies based on the circumstances, the type of dispute, the fee involved, applicable law, safety risk, fraud risk, user risk, platform integrity, and the purpose of the policy.

Nothing in this policy limits any legal right that cannot be waived or limited under applicable law.

3. Key Dispute Summary

The most important dispute rules are:

  • Rental disputes are generally between the host and renter.
  • ToyRental.ca is not a party to user-to-user rental agreements.
  • ToyRental.ca does not collect, hold, manage, release, guarantee, or refund rental money between users.
  • ToyRental.ca does not provide insurance.
  • ToyRental.ca does not guarantee item return, payment, refund, repair, replacement, recovery, safety, or dispute resolution.
  • ToyRental.ca may review reports for support, safety, fraud prevention, moderation, policy enforcement, legal compliance, and platform protection.
  • ToyRental.ca may take platform action, but platform action is not the same as legal dispute resolution.
  • ToyRental.ca does not decide legal liability, fault, damages, contract rights, ownership rights, insurance coverage, or legal remedies between users.
  • Users remain responsible for their own agreements, records, payments, deposits, insurance, legal rights, and remedies.
  • Emergencies, crimes, threats, thefts, injuries, dangerous situations, or immediate danger should be reported to emergency services, law enforcement, insurers, legal advisors, or other appropriate authorities.

4. Definitions

For the purpose of this policy:

  • “ToyRental.ca,” “we,” “us,” and “our” means ToyRental.ca and its owners, operators, administrators, contractors, service providers, affiliates, successors, and assigns.
  • “User,” “you,” and “your” means any person who accesses or uses ToyRental.ca.
  • “Host” means a user who lists, owns, controls, manages, approves, releases, delivers, or offers an item for rent.
  • “Renter” means a user who browses, requests, reserves, receives, transports, uses, stores, supervises, or returns an item listed by a host.
  • “Dispute” means any disagreement, complaint, claim, report, concern, issue, or conflict involving users, listings, items, rental money, deposits, ToyRental.ca fees, bookings, messages, reviews, safety, damage, theft, loss, late return, non-return, injury, death, property damage, cancellation, user conduct, or platform use.
  • “User-to-User Dispute” means a dispute between a host and renter or between users involving a rental, item, payment, deposit, agreement, pickup, delivery, use, return, conduct, or communication.
  • “Platform Dispute” means a dispute involving ToyRental.ca fees, account access, platform records, checkout, credits, technical errors, moderation action, privacy requests, or ToyRental.ca policy enforcement.
  • “Rental Money” means rental payments, deposits, damage deposits, security deposits, cleaning fees, delivery fees, pickup fees, late fees, fuel charges, repair costs, replacement costs, cancellation charges, or other rental-related money exchanged directly between host and renter.
  • “ToyRental.ca Fee” means a platform fee, booking fee, connection fee, administrative fee, listing fee, featured listing fee, subscription fee, advertising fee, promotional fee, or other fee charged directly by ToyRental.ca.
  • “Platform Action” means action ToyRental.ca may take on the platform, including a warning, listing removal, review removal, message restriction, account restriction, credit, refund, suspension, termination, preservation of records, or report to a third party where appropriate.

5. User-to-User Disputes Are Between Users

Most disputes involving rentals are disputes between the host and renter.

User-to-user disputes may include, without limitation:

  • Rental payment disputes.
  • Deposit disputes.
  • Damage deposit disputes.
  • Security deposit disputes.
  • Refund disputes between host and renter.
  • Cancellation disputes.
  • No-show disputes.
  • Late pickup disputes.
  • Late return disputes.
  • Delivery disputes.
  • Pickup disputes.
  • Item condition disputes.
  • Item availability disputes.
  • Item performance disputes.
  • Item safety disputes.
  • Item damage disputes.
  • Missing parts or accessory disputes.
  • Cleaning disputes.
  • Fuel, battery, charging, or return condition disputes.
  • Theft claims.
  • Loss claims.
  • Non-return claims.
  • Repair cost disputes.
  • Replacement cost disputes.
  • Personal injury claims.
  • Property damage claims.
  • Insurance disputes.
  • Communication disputes.
  • Review disputes.
  • Harassment or misconduct disputes.

Users are responsible for resolving user-to-user disputes directly with each other or through insurance, legal advice, law enforcement, small claims court, court, regulators, payment providers, professional advisors, or other available external processes.

ToyRental.ca is not responsible for resolving user-to-user disputes.

6. ToyRental.ca Is Not a Court, Mediator, Arbitrator, or Collection Agency

ToyRental.ca may review reports and may take platform action where appropriate, but ToyRental.ca does not act as:

  • A court.
  • A judge.
  • An arbitrator.
  • A mediator.
  • A lawyer.
  • A paralegal.
  • A legal advisor.
  • A police service.
  • An emergency service.
  • An insurer.
  • An insurance adjuster.
  • A debt collector.
  • A payment guarantor.
  • An escrow agent.
  • A repair provider.
  • A replacement provider.
  • A damage fund.
  • A compensation fund.

ToyRental.ca does not decide legal liability, ownership rights, contract rights, insurance coverage, negligence, fault, damages, repair value, replacement value, rental value, deposit entitlement, criminal responsibility, or whether one user owes money to another.

Any platform action taken by ToyRental.ca is for platform safety, platform integrity, policy enforcement, fraud prevention, support, or business purposes. Platform action is not a legal judgment.

7. First Step: Users Should Communicate Directly Where Safe

Where it is safe and appropriate, users should first try to resolve ordinary rental issues directly with each other.

Users should communicate clearly, respectfully, and in writing where possible.

A user should consider confirming:

  • What happened.
  • The booking or rental involved.
  • The amount in dispute, if any.
  • The item condition before pickup.
  • The item condition after return.
  • The deposit terms.
  • The cancellation terms.
  • The pickup and return times.
  • The requested resolution.
  • Any deadline for response.

Users should not communicate directly if doing so would be unsafe, threatening, abusive, harassing, fraudulent, unlawful, or inappropriate.

If there is danger, threat, theft, assault, criminal activity, injury, or immediate risk, users should contact emergency services, law enforcement, insurers, legal advisors, or other appropriate authorities.

8. When to Report a Dispute to ToyRental.ca

Users may report a dispute to ToyRental.ca if the issue involves the platform, another user, a listing, a booking request, a message, a review, a ToyRental.ca fee, a safety concern, a prohibited item, fraud, harassment, theft, non-return, or a policy violation.

Reports may be appropriate where:

  • A listing appears fake, misleading, illegal, unsafe, prohibited, or fraudulent.
  • An item appears stolen, counterfeit, recalled, dangerous, or not owned by the host.
  • A user appears to be scamming, threatening, harassing, abusing, or discriminating against another user.
  • A host repeatedly cancels, no-shows, refuses approved bookings, or lists unavailable items.
  • A renter repeatedly no-shows, damages items, fails to return items, or misuses the platform.
  • A user sends suspicious payment instructions or fake payment confirmations.
  • A user asks another user to violate laws, safety rules, permits, licences, or ToyRental.ca policies.
  • A review appears fake, retaliatory, abusive, private, misleading, or policy-violating.
  • A ToyRental.ca fee appears duplicated, unauthorized, or charged in error.
  • A technical issue affected a booking, checkout, message, listing, or account.
  • A privacy, data, account access, or security issue needs review.

ToyRental.ca may review reports at its discretion and may decide whether any platform action is appropriate.

9. How to Submit a Dispute Report

A user may submit a dispute report through the reporting tools available on ToyRental.ca or by contacting ToyRental.ca support.

A useful dispute report should include:

  • The user’s account email.
  • The booking number, listing number, payment reference, or other relevant reference.
  • The name or display name of the other user involved.
  • The item involved.
  • The rental dates.
  • A clear summary of what happened.
  • The amount of money involved, if any.
  • The requested outcome.
  • Relevant messages.
  • Photos or videos.
  • Receipts or payment records.
  • Deposit records.
  • Condition checklists.
  • Rental agreements or written terms, if any.
  • Police report number, insurance claim number, or legal file number, if applicable.
  • Any other information reasonably needed to understand the issue.

Users should provide accurate, complete, and truthful information.

Users must not submit false reports, altered evidence, misleading screenshots, fake receipts, fake police reports, fake insurance documents, exaggerated claims, or reports made for harassment, retaliation, or competitive reasons.

10. Evidence and Documentation

Users are responsible for keeping their own records.

Useful records may include:

  • Listing screenshots.
  • Booking request records.
  • Approval or decline records.
  • Messages between users.
  • Photos before pickup.
  • Photos after return.
  • Videos before pickup.
  • Videos after return.
  • Condition checklists.
  • Serial numbers.
  • Accessory lists.
  • Pickup records.
  • Return records.
  • Rental agreements.
  • Receipts.
  • Payment confirmations.
  • Deposit receipts.
  • Repair estimates.
  • Replacement estimates.
  • Insurance communications.
  • Police report numbers.
  • Support tickets.

ToyRental.ca may review submitted evidence for platform purposes, but ToyRental.ca does not guarantee that evidence will prove fault, recover money, recover property, establish damages, establish legal liability, or resolve a dispute.

11. ToyRental.ca May Review Platform Records

When reviewing a report or dispute, ToyRental.ca may review relevant platform records where appropriate and permitted by law.

Platform records may include:

  • Account records.
  • Profile records.
  • Email verification records.
  • Listing records.
  • Listing edits.
  • Listing photos or media.
  • Booking request records.
  • Booking status records.
  • Checkout records.
  • ToyRental.ca fee payment records.
  • Refund or credit records.
  • Messages and attachments.
  • Notification records.
  • Review and rating records.
  • Reports submitted by users.
  • Support records.
  • Moderation notes.
  • IP addresses.
  • Device or browser information.
  • Login records.
  • Security logs.
  • Technical logs.
  • Other records reasonably related to the issue.

Messages sent through ToyRental.ca are not guaranteed to be private from ToyRental.ca. ToyRental.ca may access, review, store, moderate, use, or disclose platform messages for support, safety, fraud prevention, dispute review, policy enforcement, legal compliance, security, and platform operation.

12. Privacy and Confidentiality During Dispute Review

ToyRental.ca may collect, use, disclose, store, and review personal information connected to a dispute in accordance with the Privacy Policy and applicable law.

ToyRental.ca may share limited information with another user where reasonably necessary to understand, respond to, investigate, or manage a dispute, report, complaint, safety issue, payment issue, or policy violation.

ToyRental.ca may refuse to disclose certain information where disclosure would reveal another person’s personal information, confidential business information, security information, fraud prevention information, legal privilege, investigation records, internal moderation notes, or information that cannot be disclosed for legal, safety, privacy, or platform reasons.

Users must not misuse personal information obtained through ToyRental.ca or a dispute process.

Users must not publicly post private information, payment information, identification documents, addresses, phone numbers, private messages, or sensitive details about another user except where they have a lawful basis to do so outside ToyRental.ca.

13. What ToyRental.ca May Do After a Report

After receiving or reviewing a report, ToyRental.ca may take one or more actions.

Possible actions include:

  • Taking no action.
  • Requesting more information.
  • Sending a warning.
  • Providing general support information.
  • Suggesting users communicate directly where safe and appropriate.
  • Suggesting users contact police, emergency services, insurers, legal advisors, payment providers, or other appropriate authorities.
  • Adding internal notes to an account, listing, booking, or report.
  • Removing a listing.
  • Requiring listing changes.
  • Reducing listing visibility.
  • Removing photos or media.
  • Removing or hiding reviews.
  • Restricting messages.
  • Restricting booking features.
  • Restricting payment-related features.
  • Restricting listing features.
  • Temporarily suspending an account.
  • Permanently terminating an account.
  • Issuing a ToyRental.ca credit.
  • Issuing a ToyRental.ca fee refund where appropriate or required by law.
  • Denying a refund or credit request.
  • Revoking credits where permitted.
  • Preserving records.
  • Cooperating with lawful requests from authorities.
  • Reporting conduct to service providers, payment processors, law enforcement, regulators, or other authorities where appropriate.
  • Taking other action ToyRental.ca believes is appropriate.

ToyRental.ca is not required to take any specific action and is not required to provide warnings before taking action.

14. What ToyRental.ca Will Not Do

ToyRental.ca generally will not:

  • Act as a court.
  • Act as a judge.
  • Act as a mediator or arbitrator.
  • Act as a lawyer or legal advisor.
  • Act as a police service or emergency service.
  • Act as an insurer or insurance adjuster.
  • Act as a collection agency.
  • Force a host to refund rental money.
  • Force a renter to pay rental money.
  • Force a host to return a deposit.
  • Force a renter to pay repair or replacement costs.
  • Recover stolen, lost, damaged, or unreturned items.
  • Pay for repair costs.
  • Pay for replacement costs.
  • Pay for lost rental income.
  • Pay for lost profits.
  • Pay for personal injury claims.
  • Pay for death claims.
  • Pay for property damage claims.
  • Guarantee that a user will cooperate.
  • Guarantee that a user will pay.
  • Guarantee that a user will return an item.
  • Guarantee that a dispute will be resolved.

ToyRental.ca may provide platform support, but platform support is not legal representation, insurance coverage, debt collection, or dispute adjudication.

15. Rental Money Disputes

ToyRental.ca does not collect, hold, manage, release, guarantee, or refund rental money between hosts and renters.

Rental money disputes may include:

  • Unpaid rental charges.
  • Cash disputes.
  • E-transfer disputes.
  • Deposit disputes.
  • Damage deposit disputes.
  • Security deposit disputes.
  • Cleaning fee disputes.
  • Delivery fee disputes.
  • Late fee disputes.
  • Repair charge disputes.
  • Replacement charge disputes.
  • Cancellation fee disputes.
  • Refund demands between users.

Users must resolve rental money disputes directly with each other or through payment providers, insurers, legal advisors, small claims court, court, regulators, or other external remedies.

ToyRental.ca may review a rental money dispute for platform safety, fraud prevention, moderation, or policy enforcement purposes, but ToyRental.ca does not guarantee recovery, payment, refund, compensation, or enforcement.

16. ToyRental.ca Fee Disputes

Disputes about ToyRental.ca fees are different from disputes about rental money between users.

ToyRental.ca fee disputes may include:

  • Duplicate ToyRental.ca charges.
  • Possible unauthorized ToyRental.ca charges.
  • Checkout errors.
  • Payment processor errors.
  • Refund requests for ToyRental.ca fees.
  • Credit requests.
  • Platform fee disclosure concerns.
  • Subscription or promotional fee concerns, if applicable.

ToyRental.ca fee disputes are governed by the Refund and Credit Policy and the Payment and Platform Fee Disclosure.

A problem with a host, renter, rental item, rental money, deposit, cancellation, damage, theft, loss, late return, or non-return does not automatically create a ToyRental.ca fee refund.

17. Damage, Theft, Loss, Late Return, and Non-Return Disputes

Damage, theft, loss, late return, and non-return disputes are serious user-to-user disputes.

Hosts should document item condition before release and after return.

Renters should document item condition before accepting the item and when returning the item.

Users should preserve:

  • Photos.
  • Videos.
  • Serial numbers.
  • Condition checklists.
  • Accessory lists.
  • Messages.
  • Rental agreements.
  • Payment records.
  • Deposit records.
  • Pickup and return records.
  • Repair estimates.
  • Replacement estimates.
  • Police report numbers, where applicable.
  • Insurance claim records, where applicable.

ToyRental.ca may take platform action if it believes a user has damaged an item, stolen an item, failed to return an item, made a false claim, abused the platform, or violated policy.

ToyRental.ca does not guarantee item recovery, money recovery, repair payment, replacement payment, deposit return, legal enforcement, insurance coverage, or dispute resolution.

18. Injury, Death, Safety, and Property Damage Disputes

Disputes involving injury, death, safety issues, dangerous items, unsafe use, defective items, property damage, vehicle damage, trailer damage, event damage, or other serious harm should be treated seriously.

ToyRental.ca is not an emergency service and does not provide medical assistance, legal advice, insurance adjustment, accident investigation, expert safety opinions, or emergency response.

Users should contact emergency services, medical professionals, law enforcement, insurers, legal advisors, property owners, venue operators, or other appropriate authorities where appropriate.

Users may report safety issues to ToyRental.ca for platform review.

ToyRental.ca may remove listings, restrict users, preserve records, cooperate with lawful requests, or take other platform action where appropriate.

ToyRental.ca does not decide legal liability for injury, death, property damage, unsafe use, defective items, negligence, or safety incidents.

19. Harassment, Threats, Abuse, and Unsafe Conduct

Users must not harass, threaten, abuse, intimidate, stalk, shame, exploit, discriminate against, sexually harass, defraud, or retaliate against another user.

If a user receives threatening, abusive, discriminatory, harassing, fraudulent, or unsafe messages or conduct, the user may report the issue to ToyRental.ca.

ToyRental.ca may review messages, account records, booking records, listings, reviews, reports, and other platform records where appropriate.

ToyRental.ca may restrict messages, remove content, suspend accounts, terminate accounts, preserve records, or take other platform action.

If there is immediate danger, threats of harm, criminal conduct, stalking, assault, theft, or other urgent safety risk, users should contact emergency services or law enforcement immediately.

20. Review and Rating Disputes

ToyRental.ca may allow users to leave reviews and ratings after eligible rental activity.

Reviews must be honest, relevant, and based on real rental experiences.

ToyRental.ca may remove, hide, restrict, or moderate reviews that ToyRental.ca believes are:

  • Fake.
  • Misleading.
  • Retaliatory.
  • Abusive.
  • Threatening.
  • Discriminatory.
  • Defamatory.
  • Unrelated to the rental experience.
  • Containing private information.
  • Containing prohibited content.
  • Posted to manipulate ratings, rankings, trust, or search results.

ToyRental.ca does not guarantee removal of a review simply because another user disagrees with it, dislikes it, believes it is unfair, or believes it affects reputation.

21. Listing Disputes

Listing disputes may involve claims that a listing is false, misleading, unsafe, illegal, prohibited, unavailable, stolen, counterfeit, recalled, defective, mispriced, improperly described, or using unauthorized photos or content.

ToyRental.ca may review listings and may remove, restrict, edit, require changes to, or reduce the visibility of listings where appropriate.

ToyRental.ca’s decision to allow a listing to remain on the platform does not mean ToyRental.ca has inspected, tested, certified, verified, insured, approved, or guaranteed the listing or item.

ToyRental.ca may remove a listing even if the host disagrees with the removal.

22. Account Disputes

Account disputes may involve account access, account suspension, account termination, duplicate accounts, verification issues, login issues, security concerns, impersonation, suspicious activity, policy violations, or moderation action.

ToyRental.ca may restrict, suspend, or terminate accounts where ToyRental.ca believes there is fraud, abuse, policy violation, safety risk, legal risk, payment risk, privacy risk, technical risk, or platform risk.

Users may contact ToyRental.ca support to ask for review of an account action.

ToyRental.ca is not required to restore an account, listing, review, message, credit, feature, or platform access.

23. Privacy and Personal Information Disputes

Privacy-related disputes, access requests, correction requests, deletion requests, account data concerns, and personal information concerns are governed by the Privacy Policy and applicable privacy law.

Users may contact ToyRental.ca about privacy concerns using the contact information in the Privacy Policy.

ToyRental.ca may need to verify a user’s identity before responding to privacy-related requests.

ToyRental.ca may refuse, limit, redact, or delay certain responses where permitted or required by law, including where disclosure would reveal another person’s personal information, internal moderation notes, fraud prevention information, legal privilege, security information, or information that cannot be disclosed for legal reasons.

24. Emergency, Crime, Theft, or Immediate Danger

ToyRental.ca is not an emergency service.

Do not use ToyRental.ca support as a substitute for emergency services, law enforcement, medical assistance, insurance claims, legal advice, or urgent safety response.

Users should contact emergency services, law enforcement, insurers, legal advisors, medical professionals, property owners, venue operators, or other appropriate authorities where a dispute involves:

  • Immediate danger.
  • Threats.
  • Assault.
  • Harassment or stalking.
  • Theft.
  • Fraud.
  • Injury.
  • Death.
  • Unsafe equipment.
  • Property damage.
  • Criminal conduct.
  • Missing property.
  • Non-return of valuable property.
  • Any urgent safety issue.

Users may also report the issue to ToyRental.ca for platform review, but ToyRental.ca cannot provide emergency response or guarantee any specific action.

25. Law Enforcement and Legal Requests

ToyRental.ca may preserve, use, or disclose information where ToyRental.ca believes it is appropriate or required for legal compliance, safety, fraud prevention, policy enforcement, legal claims, or cooperation with lawful requests.

ToyRental.ca may respond to court orders, warrants, subpoenas, production orders, regulator requests, law enforcement requests, payment processor requests, or other legal processes where ToyRental.ca determines that a response is required or appropriate.

ToyRental.ca may refuse informal requests for user information where the request does not meet legal, privacy, safety, or policy requirements.

Users seeking records for legal proceedings should obtain legal advice about the proper process for requesting records.

26. External Remedies

Users may have external remedies outside ToyRental.ca depending on the dispute.

External remedies may include:

  • Direct negotiation with the other user.
  • Insurance claims.
  • Payment provider processes.
  • Chargeback processes where available and lawful.
  • Police reports.
  • Consumer protection complaints.
  • Privacy complaints.
  • Small claims court.
  • Court proceedings.
  • Legal advice.
  • Other regulators or authorities.

ToyRental.ca does not provide legal advice and does not advise users which remedy to choose.

Users are responsible for understanding limitation periods, deadlines, filing requirements, evidence rules, costs, court procedures, insurance deadlines, payment provider deadlines, and legal requirements that may apply to them.

27. Chargebacks and Payment Disputes

Users should contact ToyRental.ca support before starting a chargeback or payment dispute about a ToyRental.ca fee.

ToyRental.ca may dispute chargebacks where ToyRental.ca believes the charge was authorized, valid, disclosed, correctly processed, or connected to platform services that were made available.

Chargebacks involving ToyRental.ca fees are governed by the Payment and Platform Fee Disclosure and the Refund and Credit Policy.

Payment disputes involving rental money paid directly between host and renter must be handled directly between users or through their payment provider, bank, card issuer, insurer, legal advisor, court, or other available remedy.

28. False Reports and Abuse of the Dispute Process

Users must not abuse ToyRental.ca’s reporting, support, refund, credit, review, or dispute tools.

Prohibited conduct includes:

  • Submitting false reports.
  • Submitting misleading reports.
  • Submitting altered screenshots.
  • Submitting fake receipts.
  • Submitting false police report information.
  • Submitting false insurance information.
  • Exaggerating damages.
  • Making false theft claims.
  • Making false non-return claims.
  • Making false unauthorized payment claims.
  • Using reports to harass another user.
  • Using reports to retaliate against another user.
  • Reporting competitors in bad faith.
  • Threatening bad reviews or reports to force payment or refunds.
  • Creating duplicate accounts to avoid enforcement.
  • Coordinating with another user to manipulate refunds, credits, reviews, bookings, or platform action.

ToyRental.ca may deny requests, remove content, restrict features, revoke credits, suspend accounts, terminate accounts, preserve records, or take other action where ToyRental.ca believes the dispute process has been abused.

29. No Admission of Liability

Any support response, credit, refund, listing removal, account restriction, warning, review removal, investigation, moderation action, or other platform action by ToyRental.ca is not an admission of fault, liability, wrongdoing, negligence, breach of contract, legal responsibility, or responsibility for user conduct.

ToyRental.ca may take platform action to protect users, reduce risk, enforce policies, improve the platform, preserve trust, or resolve support issues without admitting liability.

30. Record Retention

ToyRental.ca may retain records related to disputes, reports, safety issues, support requests, moderation actions, refunds, credits, payment issues, account restrictions, fraud prevention, legal compliance, and platform enforcement.

Records may be retained after a listing is removed, a booking is completed, an account is closed, or a dispute is resolved where ToyRental.ca believes retention is reasonably necessary for legal, accounting, tax, safety, fraud prevention, security, support, platform operation, policy enforcement, or business purposes.

Record retention is governed by the Privacy Policy and applicable law.

31. Time Limits for Reporting to ToyRental.ca

Users should report disputes, safety issues, payment issues, technical issues, fraud, damage, theft, loss, late return, non-return, harassment, or policy violations to ToyRental.ca as soon as possible.

Delayed reports may be harder to review because evidence may be unavailable, platform records may be limited, memories may fade, users may become unreachable, listings may change, accounts may be closed, payment deadlines may pass, or external remedies may be affected.

ToyRental.ca may decline to review, limit review, or take no action on old reports, repeated reports, unsupported reports, or reports that cannot reasonably be investigated.

ToyRental.ca reporting deadlines do not replace legal limitation periods, insurance deadlines, payment provider deadlines, police reporting decisions, court deadlines, or other external deadlines that may apply to users.

32. Appeals or Review Requests

A user may contact ToyRental.ca support to request review of a platform action, such as a listing removal, account restriction, review removal, credit denial, refund denial, suspension, or termination.

A review request should include:

  • The user’s account email.
  • The action being challenged.
  • The listing, booking, message, review, payment, or account involved.
  • A clear explanation of why the user believes the action should be reconsidered.
  • Supporting information or records.

ToyRental.ca may approve, deny, partially grant, or decline to review an appeal.

ToyRental.ca is not required to restore listings, accounts, reviews, messages, credits, refunds, paid features, or platform access.

33. Limitation of Liability

To the maximum extent permitted by law, ToyRental.ca and its owners, operators, directors, officers, employees, contractors, agents, affiliates, service providers, successors, and assigns are not liable for any direct, indirect, incidental, special, consequential, punitive, aggravated, exemplary, economic, or other damages or losses arising from or related to disputes, reports, user-to-user rental agreements, rental money, deposits, damage, theft, loss, late return, non-return, injury, death, property damage, cancellations, no-shows, unsafe items, defective items, user misconduct, support responses, platform action, failure to take action, moderation decisions, account restrictions, listing removals, review removals, payment disputes, chargebacks, refunds, credits, privacy disputes, legal requests, or external remedies.

Some laws may not allow certain exclusions or limitations of liability. In those cases, ToyRental.ca’s liability is limited to the maximum extent permitted by law.

34. Legal Rights

This Dispute Resolution Policy applies to the maximum extent permitted by law.

Nothing in this Dispute Resolution Policy is intended to limit, exclude, waive, or reduce any legal right that cannot be limited, excluded, waived, or reduced under applicable law.

If any part of this Dispute Resolution Policy conflicts with a non-waivable legal right, the legal right will apply only to the extent required by law, and the rest of this policy will continue to apply.

35. Changes to This Policy

ToyRental.ca may update this Dispute Resolution Policy from time to time.

When we update this policy, we will change the “Last Updated” date at the top of this page.

ToyRental.ca may provide additional notice or require renewed acceptance for material changes.

Your continued use of ToyRental.ca after an updated Dispute Resolution Policy is posted means you accept the updated policy. If you do not agree with the updated policy, you must stop using ToyRental.ca.

  • You understand this Dispute Resolution Policy.
  • You agree to this Dispute Resolution Policy.
  • You are at least 18 years old.
  • You understand that ToyRental.ca is not a party to rental agreements between users.
  • You understand that ToyRental.ca does not provide insurance.
  • You understand that ToyRental.ca does not collect, hold, manage, release, guarantee, or refund rental money between users.
  • You understand that most rental disputes are between host and renter.
